【正文】 : This contract signed in three copies, the seller holds one copy and the buyer hold two copies. 其它：本合同一式叁份，賣方執(zhí)壹份, 買方執(zhí)貳份。仲裁費用由敗訴方承擔。按照申請仲裁時該會現(xiàn)行有效的仲裁規(guī)則進行仲裁。 17. ARBITRATION: Any dispute arising from or in connection with this Contract shall be submitted to China International Economic and Trade Arbitration Commission for arbitration which shall be conducted in accordance with the Commission’s arbitration rules in effect at the time of applying for arbitration. The arbitral award is final and binding upon both partied. Arbitration fee shall be borne by the losing party. 仲裁：與此合同有關的爭議應通過友好協(xié)商解決。罰金的金額不超過遲交貨的合同貨物部分的價值的5%，%計算，少于7日的增加天數(shù)按7日計。如果事故持續(xù)十周，買方有權取消該合同。賣方應立即在不可抗力產生的十四日內將有關情況通知買方，并且賣方應用航空郵件將有關政府當局部門出具的證明不可抗力產生的文件寄送給買方。 如果賣方在收到買方的上述索賠后一個月內未能作出答復，則視為索賠已為賣方所接受。由于貨物內在的質量、差的做工、選材不當而造成操作中的貨物損壞，買方應立即書面通知賣方，并同時隨附中國商檢局出具的檢驗報告作為索賠依據(jù)。 14. CLAIMS: Within 90 days after the arrival of the goods at destination, should the quality, specification, or quantity be found in unconformity with the stipulations of the Contract except those claims for which the insurance pany or not the owners of the vessel are liable, the Buyers shall, on the strength of the Inspection Certificate issued by the State Administration for EntryExit Inspection and Quarantine of . or the site inspection report issued by the seller’s engineer, have the right to claim for replacement with new goods, or for pensation, and all expenses (such as inspection charges, freight for returning the goods and for sending the replacement, insurance premium, storage and loading and unloading charges etc.) shall be borne by the Sellers.
