Text: This agreement has two copies and either party holds one copies. Each copy shall have the same legal effect. 本租賃合同由甲乙雙方法定代表人或授權(quán)代表于文首注明的日期在中國北京市簽訂,以昭信守。如任何一方的名稱、地址及法定代表人發(fā)生變更時(shí),該方必須及時(shí)直接以書面通知另一方。任何通知應(yīng)于下列日期生效。本協(xié)議及各條款標(biāo)題僅供參考,不得以任何方式影響本協(xié)議的詮釋或解釋。 The formation, validity, interpretation and implementation of, and resolution of any dispute under this agreement shall be construed and governed in accordance to the law of China. 因本合同產(chǎn)生的所有爭議,雙方應(yīng)友好協(xié)商解決。乙方繳付租金或其他款項(xiàng)如有不足額的情況,即使甲方接受不足額的費(fèi)用,均不得視為甲方同意乙方減額繳付,亦不影響甲方追索不足部的租金或欠款的權(quán)利,更不影響其按本租賃合同或法律規(guī)定采取其他措施的權(quán)利。s expenses and property. 十二、違約責(zé)任 Liabilities for Breach of the Agreement 除本合同另有約定外,如一方違反本合同中任何規(guī)定,另一方有權(quán)在違約行為發(fā)生后以書面形式通知違約方要求其履行合同。 If the premises are substantially destroyed or damaged by fire, bad weather, war, force major, or other causes beyond the control of Party A and not attributable directly or indirectly to the negligence or malice of Party B or are otherwise rendered unfit for use or occupation, Party A shall decide whether he repairs the premises or not based on its own opinion. However, Party A shall be under no obligation to repair the premises. If Party A determines not to repair the premises, the Lease is considered being terminated automatically, Party A shall return the deposit and the prepaid rent to Party B after Party B paid all the fees specified in clause 5 and other amounts (if any). 如果該公寓的全部或部分被政府征用,則本合同應(yīng)自該行為日起終止,乙方不應(yīng)就任何未履行租賃期的利益向甲方要求賠償,并且乙方應(yīng)將其因任何該等政府決定而獲得的全部利益無償轉(zhuǎn)讓給甲方。乙方不得因任何有關(guān)保安的問題,減少或停止支付租金、物業(yè)管理費(fèi)用、空調(diào)費(fèi)或其他根據(jù)本合同須支付的費(fèi)用。 To indemnify Party A for any loss of damage to the premises from negligent act or omission of Party B or any officer, director, employee, guest, visitor, servant, agent licensee or invitee of Party B (each referred to hereinafter individually as an “associate”), to permit Party A or his authorized representatives to enter the premises to repair any such loss or damage at the expenses of Party B. 未經(jīng)甲方書面同意, 屋外不得擅自放置標(biāo)示板及陳列任何設(shè)施,不允許在房外、窗及門上掛曬衣物以影響房屋外觀面貌,該同意不得被不合理拒絕。 Party B shall not damage, injure or deface any part of the public/ mon areas and shall not place or leave any obstructions in the public/mon area. 乙方不得使用客運(yùn)電梯搬運(yùn)貨物,如乙方需要搬運(yùn)貨物或大件物品,則乙方應(yīng)事先取得甲方的同意,并在甲方的監(jiān)督下搬運(yùn)前述物品。 Party B may not transfer, mortgage, sublease, subdivide the premises or any part thereof, or approve or permit any arrangement or transaction whereby any third party obtain the right to use, occupation enjoyment of the Premises or any part thereof, regardless of whether such third party pay any rents or other expenses. 乙方不得將其機(jī)動(dòng)車停放在或企圖停放在專為星城國際大廈的住戶、客戶或者其他承租方、星城國際大廈相應(yīng)區(qū)域的所有人或占有人保留的停車位,乙方亦不得將其機(jī)動(dòng)車停放或停留在機(jī)動(dòng)車出入口或星城國際大廈范圍內(nèi)的公共活動(dòng)區(qū)域。前述緊急情況包括但不限于煤氣報(bào)警或火災(zāi)警情、漏水現(xiàn)象、發(fā)生嚴(yán)重的可疑氣味、有被盜竊的可疑情形以及政府相關(guān)部門的檢查等。在緊急情況發(fā)生時(shí),乙方應(yīng)服從物業(yè)管理公司的安排。 and to notify Party A in writing within forty eight (48) hours after receipt of any government notice or summons with respect to the premises. 在租賃期間內(nèi)乙方應(yīng)自費(fèi)對該公寓的內(nèi)裝修和各種設(shè)備設(shè)施進(jìn)行維修保養(yǎng),并保持該公寓和其設(shè)施處于良好狀態(tài)。s living and other activities in the premises and with any of Party A39。 Party A has the right to dispose the premises during the leasing term, including but not limited to transfer, mortgage and etc. If Party A transfers the premises to other parties, the assignee shall obtain Party A’s rights and obligations under the agreement. 在合同終止前1個(gè)月內(nèi),甲方有權(quán)帶領(lǐng)潛在承租方或購買方參觀該公寓 One (1) month before the end of the agreement, Party A has the right to bring others prospective lessees or purchaser to view the premises. 九、乙方的權(quán)利和義務(wù) Rights and Responsibilities of Party B 乙方在征得甲方同意的情況下,可安排本公司其他人員入住本合同中所提之房屋,甲方不得以無理理由拒絕。但如因乙方自行裝修改造該公寓造成破壞的除外。 Party A shall pay to relevant government departments all taxes and fees which Party A is required to pay in accordance to the law, provided that any applicable stamp duty shall be borne equally by the parties. 在乙方按照合同的約定支付租金和其他費(fèi)用以及完全履行合同其他義務(wù)的前提下,甲方或其授權(quán)代表非因緊急情況不應(yīng)干擾乙方在租賃期間占有、使用該公寓。同時(shí),甲方亦有權(quán)向乙方追討因清除、清理、處理前述物品所產(chǎn)生的所有費(fèi)用,或從乙方所交付的押金內(nèi)先行扣除該等費(fèi)用,然后將余款退回給乙方,如乙方所繳付的押金不足以支付該等費(fèi)用時(shí),則甲方仍有權(quán)繼續(xù)向乙方追索不足部分的款項(xiàng)。如乙方在清理該公寓過程中對甲方或第三方造成損害和損失,乙方應(yīng)承擔(dān)一切責(zé)任。 Without prejudice to any other right and/or remedy, Party A has the right to deduct from the said deposit any cost, expenses, loss or damage sustained by Party A as the result of any nonobservance or nonperformance by Party B of any of the said物業(yè)管理處待租房屋使用 agreements, stipulations terms or conditions. The extended leasing term could increase the rent, but not more than 10%. 乙方同意無論甲方或星城國際大廈物業(yè)管理公司(以下簡稱“物業(yè)管理公司”)是否存在違約情形,乙方均應(yīng)按照本合同第四條的約定支付相應(yīng)的租金,其它事宜由雙方另行協(xié)商。 The parties mutually agree with the rents as stated in annex 1, the rents includes management fees, heating fees and cable TV fees. 雙方同意租金月付,每月開始前七日內(nèi)乙方向甲方一次性支付本月的租金,如乙方逾期支付租金(包括未足額支付租金)在10日之內(nèi),%的違約金。 The parties hereby confirm that the purpose of the premises shall be accordance with the laws and regulations..
