【正文】 d 5% of the total value of the goods involved in the late delivery. The rate of penalty is charged at % for every seven days, odd days less than seven days should be counted as seven days. In case the Sellers fail to make delivery ten weeks later than the time of shipment stipulated in the Contract, the Buyers shall have the right to cancel the contract and the Sellers, in spite of the cancellation, shall still pay the aforesaid penalty to the Buyers without delay.15. 仲裁ARBITRATION：與本合同有關(guān)的或由執(zhí)行本合同引起的矛盾應通過友好協(xié)商解決。如無法達成協(xié)議，應提交仲裁。仲裁在中國北京進行，并由中國國際貿(mào)易促進委員會所屬的對外經(jīng)濟貿(mào)易仲裁委員會按照仲裁機構(gòu)暫行的規(guī)定進行仲裁。仲裁結(jié)果應作為雙方的最終約束。任何一方不得向法庭或其他協(xié)會申請修改仲裁結(jié)果，仲裁費用由敗訴方承擔。仲裁期間，雙方應繼續(xù)執(zhí)行本合同中除仲裁條款外的其他條款。All disputes in connection with this Contract or the execution thereof shall be settled friendly through negotiations. In case no settlement can be reached, the case may then be submitted for arbitration to China International Economic and Trade Arbitration Commission in accordance with its Rules of Arbitration promulgated by the said Arbitration Commission. The Arbitration shall take place in Beijing and the decision of the Arbitration Commission shall be final and binding upon both parties。 neither party shall seek recourse to a law court nor other authorities to appeal for revision of the decision. Arbitration fee shall be borne by the losing party.
