【正文】 B shall guarantee the legal use rights of the cars, it will not be limited by the ownership of the cars. 乙方應(yīng)負(fù)責(zé)辦理好車輛的保險(xiǎn)，保險(xiǎn)費(fèi)全部由乙方承擔(dān)。 Party B shall be full in charge of car insurance and totally bear the insurance fee. 乙方應(yīng)負(fù)責(zé)其提供的轎車的日常維修工作。 Party B should be responsible for daily car maintenance. 乙方有權(quán)利按本合同約定獲得利潤(rùn)及有義務(wù)承擔(dān)相應(yīng)責(zé)任。 Party B has the right to obtain the stipulated share of profit and is obliged to related responsibilities 四、 甲方客人用車費(fèi)用的收取 Guest Transportation charge 本合作事項(xiàng)所產(chǎn)生的收益，即甲方客人的用車費(fèi)用，由甲方先行收取。 Party A can charge for guest first on behalf of Party B according to the profits made by the cooperation business. 五、 經(jīng)營(yíng)成本負(fù)擔(dān) Management cost 甲方的管理成本由甲方自行承擔(dān)，均包含在本合同約定的甲方收入內(nèi)。 According to the contract party A’ s management cost is to be borne by Party A , which is included in party A’ s ine 下列經(jīng)營(yíng)、管理成本由乙方承擔(dān)： Management cost hereinafter is to be borne by Party B: A、乙方所提供的轎車購置成本費(fèi)用由乙方自行承擔(dān)，車輛所有權(quán)屬于乙方。甲方對(duì)乙方提供的車輛不享有所有權(quán)。 Car purchasing expense is to be borne by Party B. Party B has the ownership of the cars. Party A does not have the ownership of the cars. B、駕駛員工資收入。 Driver salary C、車輛 及駕駛員的保險(xiǎn)費(fèi)用。 Car and Driver Insurance D、車輛的維修、保養(yǎng)費(fèi)用，油費(fèi)，過路、過橋、養(yǎng)路費(fèi)用等。 Car maintenance fee / petrol fee /road toll fee. 六、 收入分配 Revenue distribution 本合作事項(xiàng)為雙方利潤(rùn)分成形式。即因本合作每月所產(chǎn)生的收入，甲方獲得 25%作為本合作收入，其余 75%全部收入由乙方所得。 Based on the terms and conditions of the contract the benefit pattern is that both sides share the profits. All the ine from every month’ s cooperation, Party A can obtain 30% of the revenue, party B can obtain 70% of the rest revenue. 以上收入是指乙方每月接、送客人后，由甲方客人支付的全部用車費(fèi)用。所有收入均由甲方代為收取，乙方不可向客 人收取用車費(fèi)用。甲方有償使用乙方車輛所產(chǎn)生的用車 費(fèi)用不包含在此，需另行結(jié)算。 Above revenue includes all guest transportation charge from hotel, all the ine shall be charged by party A, party B is not entitled to charge for guests. Party A’ s pensation use of the car is not included in the revenue, it will be checked up by another way. 本條所指收入，雙方按月予以結(jié)算。即在每月 15號(hào)內(nèi)結(jié)算上月收入，并在結(jié)算后 2日內(nèi)予以分配。 Revenue should be cleared on the 1st to 5th of each month and distributed in 2 days. 甲方客人所需車型超出乙方提供車型，由乙方負(fù)責(zé)協(xié)調(diào)外調(diào)。外調(diào)車除去調(diào)車成本后，所余利潤(rùn)部分甲方獲取 25%，乙方獲取75%。 If the guests of Party A want another type of car which Party B can’ t provide, Party B is responsible for coordinating it. Deducting the coordination costs, Party A will own 30% of the rest profits。 Party B will own 70% of the rest profits. 七、 經(jīng)營(yíng)相關(guān)責(zé)任承擔(dān) Distribution of the related responsibilities 因本合作事項(xiàng)產(chǎn)生損害結(jié)果，包括但不限于車輛損失、駕乘人員損傷、第三方損失均由乙方自行承擔(dān)與解決。 Party B shall be borne damages which includes, without limitation, car damage, driver and passenger injury and all third party loss. 若以上損害系第三方原因造成的，需 以甲方名義予以解決的，則甲方應(yīng)予以解決。屆時(shí)，甲方可自行或委托乙方處理，但甲方因此產(chǎn)生的各項(xiàng)費(fèi)用由乙方承擔(dān)。同時(shí)，甲方向第三方獲得的各項(xiàng)賠償應(yīng)返還給乙方。 If the above damages are caused by a third party and need Party A to solve, Party A shall assist. All cost resulted shall be borne by Party B. The pensation that Party A obtained shall be returned to Party B. 八、 特別約定 Special agreement 客人所需要消費(fèi)發(fā)票由甲方提供，扣除甲方獲得利潤(rùn)，余下部分乙方每月結(jié)帳時(shí)全額開據(jù)發(fā)票結(jié)帳。 Party A shall provide invoice as required, Party B shall provide full invoice on monthly clearing. 本合同全作期限限為壹年，從簽約時(shí)算起，合同期滿后，如雙方就繼續(xù)合作沒有異議，此 合同自動(dòng)順延一個(gè)合同期。 This contract will take effect from the signing date. After expiration of contract it can be extended for another year thereafter if agreed. 九、 合同的解除，終止 Termination 本合同存續(xù)期間，任何一方非因法定或約定事由均不得解除本合同，否則，視為違約解除合同，應(yīng)按本合同作相應(yīng)處理。 The parties shall perform their obligations stipulated in the contract. No party shall unilaterally modify or rescind the contract. 本合同方經(jīng)協(xié)商一致，可以解除本合同。協(xié)商解除本合同的，雙方互不違約。 The Agreement can be terminated upon agreement of both sides. 合同到期，雙方如不再續(xù)簽合同，合同終止。雙方應(yīng)做好最后結(jié)算工作。 This agreement shall automatically terminate, without notice by either party to the other, when it expires. 十、 違約責(zé)任 Default 本合同存續(xù)期間，任何一方非因法定事由均不得無故解除本合同。否則，視為違 約，違約方應(yīng)向守約方支付違約金貳拾萬元整。此款包括了因一方解除合同后給另一方造成的全部損失、賠償金等。任何一方不得以本條約定的違約金過高為由向法院起訴要求降低。 The parties shall perform their obligations stipulated in the contract. No any party shall unilaterally modify or rescind the contract. Violation of this regulation, default party should pay 200,000 to the other party. 十一、爭(zhēng)議的解決 Dispute 甲乙雙方因本合同發(fā)生爭(zhēng)議的，應(yīng)協(xié)商處理，協(xié)商不成的，由甲方所在地人民法院管轄。 Any dispute during execution of the contract shall be resolved by mutual friendly negotiation. Upon failure of negotiation, disputes shall be submitted to arbitration mittee. 十二、其他 篇五：租車合同 (中英文版 ) 車輛租賃合同 Lease Agreement 甲方： Party A: 乙方： Party B: 本合同由 （以下簡(jiǎn)稱甲方）同（以下簡(jiǎn)稱乙方）本著互惠互利、平等自愿的原則，共同協(xié)商簽署。 The Party A and Party B hereby mutually agree, Party A rents the van of Buick GL8 （ ） which is owned by Party B. The lease term mence from the 1st of May 9th 2020 to May 8th 2020. The monthly rental of RMB13, 000 shall be paid by Party A with the official tax invoice offered by Party B. 經(jīng)甲乙雙方同意，甲方租用乙方和其所有權(quán)的 Buick GL8 轎車（第二輛，車號(hào) 0220）。租用期自 2020 年 5 月 9 日起，至 2020年 5 月 8 日止。租用期間甲方將在收到乙方提供的正式稅務(wù)發(fā)票之后按每月人民幣壹萬叁仟元的租金支付給乙方。 During the lease term, both parties are pursuant to the terms and conditions of this Agreement, as follows: 合同期內(nèi)，甲乙雙方認(rèn)真履行此合同所規(guī)定只責(zé)任，如下： 1． Party A shall pay the rental before or on the 31st day of each month to Party B。 甲方于每月 31日前支付租車費(fèi)用給乙方； 2． Part B’ driver is working from each Monday to Friday: 8:00 am to 17:00 pm. With a hour’ s break at noon。 Party A shall notify Party B in advance if Party A needs to use the van on Saturday or Sunday and pay OT payment at 30 RMB per hour。 holiday OT can be 40 RMB per hour. The overtime payment of the driver will be made upon Party A’ s confirmation with the tax invoice issued by Party B in 30 days. 乙方的司機(jī)在合同期內(nèi)的工作時(shí)間為每周一
