【正文】 f leave. For every accumulated 22 days of passionate leave, one day of entitled annual leave will be deducted. . Special leaves Besides the annual leave voluntarily granted by the pany the employees might be entitled to enjoy special leaves with full pay under certain circumstances. Most special leaves, their conditions, frequency (if applicable) and duration are stipulated by national law or provincial respectively municipal regulations. The following table shows the leaves granted by the pany. Any special leave has to be timed in connection with the respective event or during the respective entitlement period. It cannot be accrued or transferred over time. Any special leave should be approved of HR. . Sick/medical leave General rules for absence related to sickness/medical treatment (applicable also to offthejob injuries): For any absence related to sickness/medical treatment (sick leave) notice must be given without delay (in advance or on the first working day of/after occurrence). Sick leave has to be certified by doctors of hospitals designated or permitted by the involved insurance pany. hold the right to doublecheck the employee’s sickness in appointed hospital. Sick leave duration and sick pay (caused by illness and injury which is not due to work): If the total yearly sick leave does not exceed 24 working days, no deduction from payment will be done. Total yearly sick leave exceeding 24 working days will cause a respective deduction from annual target pensation. The deduction will be followed after the respective government regulations. In case that sick leave day exceeds the maximum period, the pany has the right to rescind the employment contract with the employee. The following table shows the maximum period, which the government regulates. Service years in Maximum period 1 3 months =1 Additional 1 month for addition 1 service year, the maximum is 24 months . Application for leave/leave record The employee has to apply for any kind of leave (with the exception of pany closing days) by pleting an application form with the requested information. Where applicable, ., sick, marriage, maternity leave, appropriate original certificates have to be delivered. If the applied leave takes more than 3 consecutive days, the applicant should inform the immediate supervisor one week in advance, in order to arrange the worksubstitution and coordination. Each leave has to be approved in advance by the superior according to the pany39。s signature mandates. After approval HR keeps the original copy for recording. HR updates the record statistics monthly and publicly shares it. In case of later changes to the originally planned leave, the application procedure has to be undergone once again. Any leave without application procedure or approval will be regarded as absence, and the salary of the day must be deducted. The accrued discipline action may be applied. . Contribution and usage of social security funds . Principles In accordance with relevant Chinese labor and financial rules and regulations, the pany will contribute its share to the various social funds. In case the employee also has to contribute an individual share to such funds, the pany will deduct the required amount of his/her salary and transfer it to the respective fund management center on his/her behalf. The authority will adjust the contribution percentage and the calculation basis every year and HR will announce it to the employee accordingly. The funds explained as below. Articles , , , below are applied for those whose social benefits are contributed in Shanghai. For those employees whose social benefits are contributed in other cities, local regulations by the government authority will be followed and if there are options, will choose the better choice from the view of employees’ benefit while it should not be more than that in Shanghai. . Pension fund Both the pany and the employee contribute to the Pension Fund. A part of the pany’s contribution plus the total contribution of the employee are booked in the individual saving account. The amount to be paid out, when entitled, depends on the total amount in the individual savings account of the employee and his/her service years following local regulations. The local authorities control the fund. It will be used to finance payments after retirement or in case of death of the employee. Besides this fund, pany also grants a supplementary pension fund to the staff whose average monthly salary of previous year exceeding the ceiling of the contribution calculation basis. This contribution is totally booked in the individual saving account. . Public medical fund The pany and the employee have to contribute to the public Medical Fund, which is controlled by the labor authority. It is mainly used to finance sickness or nonworkrelated i
