五、結(jié)語(yǔ) 土地承包經(jīng)營(yíng)權(quán)是為解決在我國(guó)實(shí)行土地的完全公有制環(huán)境下的市場(chǎng)經(jīng)濟(jì)中土地農(nóng)業(yè)利用問題而創(chuàng)設(shè)的一種新型用益物權(quán),這一物權(quán)類型的設(shè)立,也使長(zhǎng)期存在的土地承包經(jīng)營(yíng)中的相關(guān)問題,如原來(lái)土地承包經(jīng)營(yíng)權(quán)性質(zhì)的債權(quán)與物權(quán)之爭(zhēng),等得到了解決。二次審議稿中所規(guī)定的土地承包經(jīng)營(yíng)權(quán),其性質(zhì)與日本,臺(tái)灣等大陸法系國(guó)家之永佃權(quán)制度極為相似,也與法國(guó),德國(guó)之用益權(quán)制度有一定的相似之處,因此其表達(dá)土地承包經(jīng)營(yíng)權(quán)的性質(zhì)的法條規(guī)定的構(gòu)造格局應(yīng)當(dāng)借鑒大陸法系國(guó)家之永佃權(quán)制度和用益權(quán)制度的成熟做法。二次審議稿對(duì)土地承包經(jīng)營(yíng)權(quán)的規(guī)定大體的使這一權(quán)利類型具備了其應(yīng)具有的特定的用益物權(quán)的性質(zhì),但在某些方面,還需要一是要充分考慮我國(guó)國(guó)情,另一方面也應(yīng)當(dāng)充分借鑒成熟做法,吸收合理的學(xué)說與理論,以便充分實(shí)現(xiàn)土地承包經(jīng)營(yíng)權(quán)之功能。 注釋: 「1」本文提到的農(nóng)業(yè),若非特別指出,均指廣義農(nóng)業(yè),包括農(nóng)業(yè),林業(yè),畜牧業(yè),副業(yè)(此項(xiàng)與本文討論無(wú)關(guān)),漁業(yè) 「2」參見梁慧星,陳華彬,《物權(quán)法》,第3頁(yè),法律出版社1999年版。 「3」參見《日本民法典》第269條,及二次審議稿第十一章。 「4」參見陳華彬,《外國(guó)物權(quán)法》第十一章,法律出版社2004年版。 「5」參見梁慧星,陳華彬,《物權(quán)法》第247頁(yè),法律出版社1999年版。 [Abstracts] A clear prehension of the nature of the right of the landscontractedmanagementright is helpful for the rationalization of the legislation of our country that is going on and for the solution to the problems of the agricultural use of lands. The landscontractedmanagementright will be a new type of the usufructuary right created by our country, the nature of which has many similaritieswith the usufruct and the leaseinperpetuityright traditional real laws. The progressing of our legislation should take reference from the successful examples set by other countries. The regulation about the landscontractedmanagement right in the second discussed draft of the real law given by the standing mittee of NPC is generally provided with the nature which is demanded, however, there is also some points that should be better.
