Firms of a member country may be excluded if as a matter of law or regulation, Tanzania prohibits mercial relations with that country. Bidders should not be associated, or have been associated in thepast, directly or indirectly, with a firm or any of its affiliateswhich have been engaged by the Purchaser to provide consultingservices for the preparation of the design, specifications, andother documents to be used for the procurement of the goods to bepurchased under this Invitation for Bids. Governmentowned enterprises in the United Republic of Tanzania mayparticipate only if they are legally and financially autonomous, ifthey operate under mercial law, and if they are not adependent agency of the Purchaser. Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by the Government of the United Republic of Tanzania in accordance with ITB Clause . 3. Eligible Goods and Services All goods and related services to be supplied under the contract shall have their origin in eligible source countries, and all expenditures made under the contract will be limited to such goods and services. For purposes of this clause, origin means the place where thegoods are mined, grown, or produced, or the place from which therelated services are supplied. Goods are produced when, throughmanufacturing, processing, or substantial and major assembly ofponents, a merciallyrecognized product results that issubstantially different in basic characteristics or in purpose or utilityfrom its ponents. The origin of goods and services is distinct from the nationality ofthe Bidder.4. Cost of Bidding The Bidder shall bear all costs associated with the preparation andsubmission of its bid, and the Purchaser named in the Bid DataSheet, hereinafter referred to as the Purchaser, will in no case beresponsible or liable for those costs, regardless of the conduct oroute of the bidding process. B. The Bidding Documents 5. Content of Bidding Documents The goods required, bidding procedures, and contract terms areprescribed in the bidding documents. The bidding documentsinclude the following sections:(a) Invitation to Tender(b) Instructions to Bidders (ITB)(c) Bid Data Sheet(d) General Conditions of Contract (GCC)(e) Special Conditions of Contract (SCC)(f) Schedule of Requirements(g) Technical Specifications(h) Bid Form(i) Bill of Quantities(j) Bid Security Form(k) Contract Form(1) Performance Security Form(m) Bank Guarantee Form for Advance Payment(n) Manufacturer39。s Authorization Form The Bidder is expected to examine all instructions, forms, terms,and specifications in the bidding documents. Failure to furnishall information required by the bidding documents or to submit abid not substantially responsive to the bidding documents inevery respect will be at the Bidder39。s risk and may result in therejection of its bid. 6. Clarification of Bidding Documents A prospective Bidder requiring any clarification of the bidding documents may notify the Purchaser in writing or by cable[hereinafter, the term cable is deemed to include Electronic DataInterchange (EDI) and facsimile] at the Purchaser39。s addressindicated in the ITB Clause . The Purchaser will respond inwriting to any request for clarification of the bidding documentswhich it receives no later than ten (10) days prior to the deadlinefor the submission of bids prescribed in Bid Data Sheet. Writtencopies of the Purchaser39。s response (including an explanation of thequery but without identifying the source of inquiry) will be sent toall prospective bidders that have received the bidding documents. 7. Amendment of Bidding Documents At any time prior to the deadline for submission of bids, thePurchaser, for any reason, whether at its own initiative or inresponse to a clarification requested by a prospective Bidder,may modify the bidding documents by amendment. All prospective bidders that have received the bidding documentswill be notified of the amendment in writing or by cable, and willbe binding on them. In order to allow prospective bidders reasonable time in which totake the amendment into account in preparing their bids, thePurchaser, at its discretion, may extend the deadline for thesubmission of bids C. Preparation of Bids 8. Language of Bid The bid prepared by the Bidder, as well as all correspondence anddocuments relating to the bid exchanged by the Bidder and thePurchaser, shall be written in the language specified in the BidData Sheet. Supporting documents and printed literature furnishedby the Bidder may be in another language provided they areacpanied by an accurate translation of the relevant passages inthe language specified in the Bid Data Sheet, in which case, forpurposes of interpretation of the Bid, the translation shall govern.9. DocumentsConstitutingthe Bid The bid prepared by the Bidder shall prise the following ponents: (a) a Bid Form and a Price Schedule pleted in accordance with ITB Clauses 10, 11, and 12。 (b) documentary evidence established in accordance with ITB Clause 13 that the Bidder is eligible to bid and is qualified to perform the contract if its bid is accepted。 (c) documentary evidence established in accordance with ITB Clause 14 that the goods and ancillary services to be supplied by the Bidder are eligible goods and services and conform to the bidding documents。 and (d) bid security furnished in accordance with ITB Clause 15. 10.
