Party B shall arrange the surveillance assessment upon the receipt of surveillance fees. Party B reserves the right to suspend surveillance assessment if Party A fails to pay the full amount in time and could resume the assessment upon the receipt of full payment. If Party A fails to pay the full amount of relevant fee within 12 months, Party A could be regarded as to be inpliance with assessment criterion and Party B could suspend or withdraw the certification qualification of Party A according to relevant regulations.審核員的食、宿、交通費(fèi)用由甲方按實(shí)際發(fā)生數(shù)承擔(dān)。The acmodation, meals and travel expenses of auditors shall be borne by Party A四、風(fēng)險(xiǎn) Risks甲方建立的質(zhì)量／環(huán)境／職業(yè)安全健康管理體系，如達(dá)不到或不能持續(xù)滿足標(biāo)準(zhǔn)要求和乙方的規(guī)定要求，將承擔(dān)不能取得或暫停或被撤銷認(rèn)證注冊(cè)資格的風(fēng)險(xiǎn)。If the QMS/EMS/OHSMS established by Party A fails to meet or could not continuously meet the requirements of the standards and the regulations set up by Party B, Party A shall bear the risks that certification qualification could not be granted or could be suspended or withdrawn.乙方要承擔(dān)甲方獲證后質(zhì)量／環(huán)境／職業(yè)安全健康管理體系失效，發(fā)生重大質(zhì)量／環(huán)境／職業(yè)安全事故而引起委托方的顧客不滿意被投訴，乃至被國(guó)家認(rèn)可委暫停、撤銷實(shí)施認(rèn)證、注冊(cè)資格的風(fēng)險(xiǎn)。Party B shall bear the risks that unsatisfied customers might make appeals against Party B due to the ineffectiveness of the certified QMS/EMS/OHSMS and major quality/environment/occupational safety accidents of Party A, and even the risks that the qualification to conduct certification activities might be suspended or withdrawn by CNAB在認(rèn)證過(guò)程中甲方因乙方責(zé)任的任何損失，其索賠的賠償費(fèi)將不得超過(guò)甲方的認(rèn)證審核費(fèi)；乙方將不承擔(dān)超出認(rèn)證審核費(fèi)以外的任何損失賠償。For the losses of Party A caused by the failure of Party B, the pensations claimed by Party A shall not exceed the assessment fee paid by Party A. Party B does not bear any pensations that exceed the assessment fee.甲方應(yīng)承擔(dān)因證書誤用或認(rèn)證標(biāo)志使用不當(dāng)而引起的乙方損失。The losses of Party B caused by the misuse of certificates and logos of Party A shall be borne by Party A甲方、乙方因各自的原因不能在合同規(guī)定的期限內(nèi)如期認(rèn)證審核，責(zé)任方要向?qū)Ψ街Ц墩J(rèn)證費(fèi)用的20%作為違約金。甲方提出終止合同時(shí)應(yīng)支付審核費(fèi)的20％作為乙方準(zhǔn)備工作的費(fèi)用；乙方由于非甲方的原因而提出終止合同時(shí)應(yīng)支付審核費(fèi)的20％作為甲方的賠償。If assessments could not be conducted during the time prescribed in the Contract due to Party A or Party B’s reason, the responsible party shall pay 20% of the assessment fee as penalty. If Party A proposes the termination of assessment, Party A shall pay 20% of assessment fee to Party B for the preparation work that Party B has fulfilled. If Party B proposes the termination of assessment due to the reasons not related to Party A, Party B shall pay 20% of assessment fee to Party A as pensation.五、雙方的責(zé)任和義務(wù) Rights and Obligations of Both Parties 甲方責(zé)任 Obligations of Party A1） 甲方應(yīng)至少在認(rèn)證審核的兩個(gè)月之前提供管理體系文件由乙方進(jìn)行文件審核。Party A shall submit the management system documents to Party B for document review at least two months prior to the assessment. 2） 甲方在認(rèn)證審核時(shí)應(yīng)提供至少三個(gè)月的體系運(yùn)行的有效證據(jù)。Party A shall provide effective evidence that the system has been in operation for at least three months. 3） 甲方應(yīng)為乙方提供審核所需的全部文件和資料（施工、勘測(cè)、設(shè)計(jì)、監(jiān)理、物業(yè)管理、房地產(chǎn)開發(fā)企業(yè)還要提供近兩年完成和在建的所有工程項(xiàng)目名單以及工程項(xiàng)目業(yè)主的通訊聯(lián)絡(luò)電話和傳真）。Party A shall provide the full set of documents and material required by the assessment (organizations engaged in construction, exploration, design, supervision and management, property management and real estate development industries shall also provide the list of all the pleted projects and projects sites under construction within the last two years, and the contact details of the owners of the projects). 4） 甲方應(yīng)為乙方提供審核必需的工作條件和食、宿、行方便，并積極配合審核工作，確保其順利進(jìn)行。Party A shall provide necessary working conditions including meals, acmodations and transportation for Party B for the implementation of the assessment5） 甲方應(yīng)按期向乙方交付合同確定的費(fèi)用。Party A shall pay the certification fee as defined in the Contract to Party B within the defined time. 6） 甲方因故被暫停或撤消認(rèn)證注冊(cè)資格時(shí)，應(yīng)暫停使用證書和認(rèn)證標(biāo)志或向乙方交回全部認(rèn)證證書和銷毀全部認(rèn)證標(biāo)志。If the certification qualification of Party A has been suspended or withdrawn, Party A
