Index to Part VI 文庫專用 26 ? 我國的強制保險制度概況 ?我國在 1995年 《 保險法 》 生效前，已經形成部分車輛全國性強制保險（如拖拉機和在華外國人的機動車）、部分省市通過地方法規(guī)對所有車輛實行強制保險（據(jù)保監(jiān)會統(tǒng)計，大約有 24個省市區(qū)）的 “ 條塊式機動車強制保險 ” 制度 。比如 ,廣東省從 1982年起已經實行了機動車第三者責任強制保險。 ?《保險法》規(guī)定，除法律、行政法規(guī)規(guī)定必須投保的險種以外，保險公司和其他任何單位不得強制他人訂立保險合同。 從而使上述強制保險制度涉嫌違法。 文庫專用 27 ?2022年 《 道路交通安全法 》 第 17條規(guī)定： “ 國家實行機動車第三者責任強制保險制度，設立道路交通事故社會救助基金。具體辦法由國務院規(guī)定。 ”
