【文章內(nèi)容簡介】 方申請仲裁的，仲裁機構不予受理。 ? 仲裁協(xié)議分兩種： 合同中的仲裁條款。 提交仲裁協(xié)議。 二、仲裁協(xié)議的形式 ? 1．表明雙方當事人在發(fā)生爭議時自愿提交仲裁。 ? 2．排除法院對于爭議案件的管轄權。 ? 3．使仲裁機構取得對爭議案件的管轄權。 三、仲裁協(xié)議的作用 ? 臨時仲裁機構： 是為了解決爭議由雙方共同指定的仲裁員自行組成的臨時仲裁庭。爭議處理完畢，臨時仲裁庭即解散。 ? 常設仲裁機構： 是根據(jù)一國的法律或有關規(guī)定設立的仲裁機構。 我國的常設仲裁機構是中國國際經(jīng)濟貿(mào)易仲裁委員會，會址設在北京，深圳和上海分別設有分會。 四、仲裁機構 提出仲裁申請 仲裁裁決的執(zhí)行 仲裁庭組成 仲裁審理 仲裁裁決 五、仲裁程序 ? 仲裁條款：主要包括仲裁地點、仲裁機構、仲裁程序和仲裁裁決的效力等內(nèi)容。 ? 其中仲裁地點的選擇： (1)在我國仲裁； (2)在被告所在國仲裁； (3)在雙方同意的第三國仲裁。 六、仲裁條款的規(guī)定方法 ? 凡因執(zhí)行本合同所發(fā)生的或與本合同有關的一切爭議，雙方應通過友好協(xié)商解決；如果協(xié)商不能解決，應提交北京中國國際經(jīng)濟貿(mào)易仲裁委員會，根據(jù)該會的仲裁規(guī)則進行仲裁。仲裁裁決是終局的，對雙方都有約束力。仲裁費用除仲裁庭另有規(guī)定外，均由敗訴方負擔。 ?
