【正文】 Article49 Party B confirms the address in this contract as the one for the delivery of documents, letters and notices relevant to the labor relationship management. If the address changes or bees invalid, Party B shall notify Party A in time in writing. Otherwise, Party A?s delivery is deemed as valid. Labor Disciplines 第二十二條 甲方根據(jù)經(jīng)營需要，依法制定規(guī)章制度和勞動(dòng)紀(jì)律。 乙方不能勝任工作，經(jīng)過培訓(xùn)或者調(diào)整工作崗位，仍不能勝任工作的； 2. When Party B is incapable of performing its duties petently, even after the training has been provided or the position adjustments have been made。 甲方未依法為乙方繳納社會(huì)保險(xiǎn)費(fèi)的； the social insurance fee is not paid for the employee according to the law。若因故意漏報(bào)、隱瞞前述基本情況，騙取甲方簽訂勞動(dòng)合同的，經(jīng)甲方查出或被原單位追訴的，視為乙方的欺詐行為并導(dǎo)致甲方的嚴(yán)重誤解，甲方有權(quán)依法申請(qǐng)認(rèn)定本合同自始無效，由此給甲方造成的損失，應(yīng)由乙方全額承擔(dān)。 Article43 In the case that Party B accepts the training funded by Party A, Pary A and Party B may enter into a training agreement under mutual agreement, in which service term and penalty standard shall be stipulated. 十二、 爭(zhēng)議解決 12. Dispute Settlement 第四十四條 因履行本合同發(fā)生的勞動(dòng)爭(zhēng)議，首先進(jìn)行調(diào)解；調(diào)解不成，甲乙雙方應(yīng)向甲方所在地的勞動(dòng) 爭(zhēng)議 仲裁委員會(huì)申請(qǐng)仲裁。 其他：處理其他應(yīng)了而未了的事務(wù)。 （ 2） This renewed labor contract does not have a fixed period of validity.
