【正文】 nd regulations legally stipulated by Party A are annexes of this Contract.十三、 勞動(dòng)爭(zhēng)議Article Thirteen Labor Dispute甲乙雙方若發(fā)生勞動(dòng)爭(zhēng)議，應(yīng)通過(guò)友好協(xié)商解決；若不能解決，可以向當(dāng)?shù)赜泄茌牂?quán)的勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁；對(duì)仲裁不服的，可向人民法院起訴。 The modification of this contract shall be mutually agreed by both parties and shall be facilitated with the relevant procedure. The modified content can be agreed by both parties. 本合同一式二份，甲、乙雙方各執(zhí)一份。This contract is effective by signatures of both parties and shall be submitted to the surveyor.十五、 其它Article Fifteen Miscellaneous 本合同未盡事宜，可由甲、乙雙方另行訂立補(bǔ)充條款，補(bǔ)充條款與本合同具有相同的法律效力。Party A forces Party B to work by means of force, threat or illegal restriction of personal freedom.十一、 違約責(zé)任Article Eleven Liability for Breach of Contract 甲方依第9條提前解除合同，應(yīng)按法律規(guī)定向乙方支付經(jīng)濟(jì)補(bǔ)償金。 Party B is ill or nonworkrelated injured, and unable to do the former job or other job assigned by Party A after medical treatment. 乙方不能勝任工作，經(jīng)過(guò)培訓(xùn)或調(diào)整工作崗位，仍不能勝任的。 Party B shall strictly keep Party A’s trade secret and can not divulge to any third party 如實(shí)陳述履歷和學(xué)歷。Party A shall transact social insurance and pay them for Party B. Party A shall withhold the social security contribution legally undertook by Party B when paying the remuneration every month. 乙方享有國(guó)家規(guī)定的所有法定假日。 Party A may legitimate arrange Party B to work overtime or work on general holidays due to business requirements on condition that Party B is willing to do so. 甲方由于工作需要更改工時(shí)制度，經(jīng)政府有關(guān)部門批準(zhǔn)后，乙方應(yīng)密切配合執(zhí)行。According to the Labor Law of PRC and relevant laws and regulations, Party A and Party B sign this contract on the basis of equality, free will and mutual consultation.一、 工作內(nèi)容Article One Working Contents 甲方因生產(chǎn)需要，同意聘用乙方為本公司員工，職位為 。經(jīng)雙方協(xié)商一致的，可以解除或續(xù)訂勞動(dòng)合同。 Party A shall pay the wage on the day every month.五、 勞動(dòng)保護(hù)與勞動(dòng)條件Article Five Labor Protection and Labor Conditions 甲方須對(duì)乙方進(jìn)行勞動(dòng)安全、業(yè)務(wù)技術(shù)及勞動(dòng)紀(jì)律等方面的教育和培訓(xùn)，并根據(jù)國(guó)家對(duì)勞動(dòng)保護(hù)、安全生產(chǎn)的要求，為乙方提供必要的生產(chǎn)（工作）條件，保障乙方的安全健康。 Party B shall strictly implement the rules and regulations and Handbook legally stipulated by Party A. 乙方應(yīng)愛(ài)護(hù)甲方的財(cái)物，對(duì)由于本人責(zé)任造成的直接經(jīng)濟(jì)損失，必須予以賠償并接受甲方的處罰。 Party B seriously neglects his/her duty and grafts resulting in Party A’s great loss. 乙方違反中國(guó)法律，受到司法處罰或追究刑事責(zé)任。 Under the following circumstances, Party B may inform Party A to terminate the Contract at any time.a. 在試用期內(nèi)。提出仲裁的一方應(yīng)當(dāng)在勞動(dòng)爭(zhēng)議發(fā)生之日起60天內(nèi)向勞動(dòng)爭(zhēng)議仲裁委員會(huì)提出書面申請(qǐng)；當(dāng)事人對(duì)仲裁裁決不服的，可以在收到仲裁裁決書之日起15天內(nèi)向人民法院起訴
