【正文】 rty and person and against all actions, suits, claims, demands, charges and expenses arising in connection therewith which shall be occasioned by the negligence of the Contractor or any of his subcontractors or by defective design, materials or workmanship but not otherwise.　　3. In the event of any claim being made or actions brought against the Owner arising out of any matter in respect of which the Contractor is or may be liable under this Article, the Owner shall promptly notify the Contractor in writing thereof and the Contractor shall at his own expense take over and conduct in the name of the Owner all negotiations for the settlement of the same and any litigation that may arise therefrom. The Owner shall at the request of the Contractor afford all such information and assistance as the Contractor may reasonably require for the purpose of dealing with any such claim or action.　　第十條 保險(xiǎn)　　1. 在不限制承包商責(zé)任的情況下，承包商將自費(fèi)投保下列險(xiǎn)：　　a. 機(jī)器設(shè)備從工廠交貨到目的地的運(yùn)輸險(xiǎn)?！　?. 在最后驗(yàn)收合格證書簽發(fā)之前，凡因承包商或其分包商的疏忽，或設(shè)計(jì)、材料或工藝上的缺陷而產(chǎn)生的任何財(cái)產(chǎn)損失或人身傷害，承包商應(yīng)向業(yè)主賠償，并保護(hù)業(yè)主免受由此而產(chǎn)生的各種訴訟、索賠、要求或費(fèi)用支出。　　3. 如果業(yè)主認(rèn)為工地上承包商的雇員品行不端、不能勝任工作或有失職行為，可要求承包商將此人調(diào)離或更換。s property and the adjoining premises, driveways and streets free of construction materials and rubbish caused by the Works, and at the pletion of the Works shall remove all remaining materials from and about the premises and shall leave the Site and Plant safe, clean and ready for use.　　第八條 承包商的工作人員　　1. 承包商將自費(fèi)為其全部工作人員提供飲食、交通及一切必要的便利?！　?. 在總體上得到上述保證的前提下，承包商應(yīng)提供下列各項(xiàng)必需品：　　a. 建筑設(shè)備；　　b. 工地上使用的運(yùn)輸工具，包括臨時(shí)道路；　　c. 保護(hù)人員和財(cái)產(chǎn)安全所需的籬笆、燈光、崗哨以及所有其他材料和服務(wù)；　　d. 為材料和施工人員（包括業(yè)主雇員）提供臨時(shí)倉(cāng)庫(kù)、辦公室和其他房屋建筑；　　e. 在整個(gè)工程移交之前提供電話、滅火設(shè)備和急救設(shè)備；　　f. 供施工人員使用的衛(wèi)生設(shè)備和食堂。　　4. 承包商應(yīng)根據(jù)業(yè)主的合理要求，為徹底而有效的檢測(cè)提供所需要的協(xié)助、勞力、材料、電力、燃料、設(shè)備、備用品和儀器。　　Article 5Drawings　　1. The Contractor shall submit to the Owner for approval and review within the time specified in Appendix (…) such drawings as may be required for Construction of the Plant under this Contract. Within one month after receiving such drawings the Owner shall review and approve or disapprove the drawing.　　2. The Contractor shall be responsible for any defects, errors or omissions in the above drawings unless such defects, errors or omissions are caused by inaccurate information furnished in writing to the Contractor by the Owner.　　3. All drawings and technical documentation delivered by the Owner or the Contractor to the other party shall be treated as confidential by the receiving party unless agreed otherwise, and shall not be used by that party for purposes other than those connected with this Contract.　　第六條 檢驗(yàn)　　1. 承包商應(yīng)該按法律和正常的工程慣例的要求，負(fù)責(zé)工廠所有的檢驗(yàn)和試驗(yàn)工作?！　rticle 4Contract Price　　1. The Contractor shall perform all inspection and testing of the Plant required by law and normal engineering practice.　　2. The Owner shall be entitled at all reasonable times and at its own cost to inspect, examine and test the materials and workmanship of the Plant under construction. Such inspection, examination or testing if made shall not release the Contractor from any obligation under the Contract.　　3. The pleted Plant shall be inspected, examined and tested by the Owner, and the Contractor shall give the Owner reasonable notice in writing of the date on which the Plant will be ready for testing.　　4. The Contractor shall provide such assistance, labour, materials, electricity , fuels, apparatus, stores and instruments as may be required and as may be reasonably demanded to carry out such tests by the Owner proper
