Secondly, the Significance of China39。 1 依法行政的概念 依法行政，又稱行政法治，是指國家各級行政機關(guān)及其工作人員依據(jù)憲法和法律賦予的職責(zé)權(quán)限 ,在法律規(guī)定的職權(quán)范圍內(nèi)對國家的政治、經(jīng)濟(jì)、文化、教育、科技等各項社會事務(wù) ,依法進(jìn)行有效管理活動。 2 依法行政的基本要求 2021 年國務(wù)院《全面推進(jìn)依法行政實施綱要》對依法行政提出了六項基本要求：合法行政、合理行政、程序正當(dāng)、高效便民、誠實守信、權(quán)責(zé)統(tǒng)一。即職權(quán)法定，不得越權(quán)。行政機關(guān)實施行政管理，要符合法律、法規(guī)、規(guī)章關(guān)于實施機關(guān)、條件、幅度等內(nèi)容的規(guī)定具體步驟、形式、時間和順序，進(jìn)行活動和選擇，否則就構(gòu)成違法。行使自由裁量權(quán)應(yīng)當(dāng)符合法律，排除不相關(guān)因素；采取的措施和手段應(yīng)當(dāng)必要和適當(dāng)；行政機關(guān)執(zhí)行管理可以采用多種方式實現(xiàn)其目的，避免采用損害當(dāng)事人權(quán)益的方 式。 。
