【正文】 第四章 國(guó)際海上貨物運(yùn)輸與保險(xiǎn)法 ? 本章內(nèi)容： 提單的性質(zhì)、種類(lèi)、承運(yùn)人的責(zé)任以、租船運(yùn)輸合同的種類(lèi)。 ? 海上運(yùn)輸保險(xiǎn)的原則、承保的損失、承保的險(xiǎn)別、保險(xiǎn)人責(zé)任的起訖。 ? ? 教學(xué)要求： 掌握提單的性質(zhì)和種類(lèi)，以及承運(yùn)人的責(zé)任。 ? 了解海上運(yùn)輸保險(xiǎn)的原則，掌握承保的損失、承保的險(xiǎn)別，熟悉保險(xiǎn)人責(zé)任的起訖。 ? ? 第一節(jié) 國(guó)際海上貨物運(yùn)輸法 ? 一、提單 ? （一）調(diào)整提單的公約 ? 海牙規(guī)則 ? 維斯比規(guī)則 ? 漢堡規(guī)則 （二）提單的概念 ? 提單是一種用以證明海上運(yùn)輸合同和貨物已經(jīng)由承運(yùn)人接收并裝船，以及承運(yùn)人保證據(jù)以交付貨物的單證。 ? The Receipt Character Evidence of the Contract of Carriage by Sea The Bill of Lading as a Document of Title（權(quán)益憑證） ? （ 三 ） 提單的種類(lèi) 以貨物是否裝船分為已裝船提單和收貨待運(yùn)提單 （ 1）已裝船提單（ On Board B／ L or Shipped B／ L） ? ? 同一票貨物全部裝進(jìn)船艙或裝上艙面并經(jīng)大副簽收后，根據(jù)托運(yùn)人要求，由承運(yùn)人、船長(zhǎng)或代理人簽發(fā)給托運(yùn)人的提單。 （ 2）待運(yùn)提單（ Received for Shipment B／ L） ? 承運(yùn)人收到并掌管托運(yùn)貨物等待裝船期間，經(jīng)托運(yùn)人要求所簽發(fā)的提單。 按收貨人抬頭分為記名提單、指示提單和不記名提單 （ 1）記名提單（ straight B／ L） ? 指記名貨物交付或指定給具體人的憑證。 ? 記名提單安全，但在多數(shù)國(guó)家不具備流通性。 （ 2）不記名提單（ Blank B/L； Open B／ L； Bearer B/L） 指發(fā)貨人沒(méi)有指明任何收貨人，收貨人欄內(nèi)僅注明“交與持有人”（ to bearer）的 提單。 ? 缺乏安全性。 ? （ 3）指示提單（ Order B/L) ? 處理提單所列貨物的人經(jīng)背書(shū)指示交付貨物的提單。 指示提單發(fā)生遺失或被盜，不致被他人任意冒領(lǐng)提貨；并可經(jīng)背書(shū) 轉(zhuǎn)讓。 以提單上是否有不良批注分為清潔提單和不清潔提單 ? （ 1）清潔提單（ Clean B／ L） ? 指對(duì)貨物外表未加不良批注的提單。 （ 2）不清潔提單（ Foul B／ L） ? 明顯聲明貨物及或包裝有缺陷的提單。 ? （四） Carrier’ s Duty under a Bill of Lading ? to exercise due diligence to the ship seaworthy, before and at the beginning of the voyage ? To Exercise Due Diligence to Properly and Carefully Loading, Handing, Stowing（積載） , Carrying, Keeping（保管） , Caring for（照料） , and Discharging the Goods Carried. 管貨過(guò)失與管船過(guò)失不同：前者不能免責(zé)；后者可免責(zé)。 unlawful deviation is not allowed ? （五） Carrier’ s Immunities ? Article 4(2) of the Hague Rules provides: ? “ Neither the carrier nor the ship shall be responsible for loss or damage arising or resulting from ? Act, neglect, or default of the master ? mariner, pilot, or the servants ? of the carrier in the navigation（駕駛） or in the management（管理） of the ship。 ? Fire, unless caused by the actual fault or privity of the carrier ? Perils, dangers, and accidents of the sea or other navigable water(海難） 。 Act of God(天災(zāi)）； ? Act of war。 ? Act of public enemies。 ? Arrest or restraint of princes, rules, ? or people, or seizure under legal process。 ? Quarantine（檢疫）
