【正文】 Personal insurance Concept ? Personal insurance is insurance under which the subject matter of insurance is the life and body of a person. ? 人身保險是以人的壽命和身體為保險標(biāo)的的保險。 Form ? An insurance contract shall contain the following: ? 保險合同應(yīng)當(dāng)包括下列事項： ? 1. Name and domicile of the insurer。 ? （一）保險人的名稱和住所； ? 2. Names and domiciles of the proposer and the insured, as well as the name and domicile of the beneficiary in the case of personal insurance。 （二）投保人、被保險人的姓名或者名稱、住所，以及人身保險的受益人的姓名或者名稱、住所； ? 3. The subject matter of insurance。 ? （三）保險標(biāo)的； ? 4. Insurance liability and liability exemptions。 （四）保險責(zé)任和責(zé)任免除； ? 5. Term and starting date of coverage。 ? （五）保險期間和保險責(zé)任開始時間； ? 6. The insured amount。 ? （六）保險金額； ? 7. Insurance premium and the payment method。 ? （七）保險費以及支付辦法 ? 8. Method for payment of indemnities or insurance benefits。 ? （八）保險金賠償或者給付辦法； ? 9. Liability for breach of contract and dispute resolution。 and ? （九）違約責(zé)任和爭議處理； ? 10. Date of conclusion of contract. ? （十）訂立合同的年、月、日。 ? The proposer and the insurer may agree upon other matters relating to the insurance. ? 投保人和保險人可以約定與保險有關(guān)的其他事項。 ? Personal Insurance Contract 人身保險合同 A beneficiary refers to a person who has been designated by the insured or the insurant to enjoy the right to insurance claims. ? 受益人是指一個人已經(jīng)指定被保險人或被保險人享受保險索賠的權(quán)利。 The insurant or the insured may be the appointing beneficiaries ,the insurant shall get the approval of the insured . ? 投保人或被保險人可以是受益人。在指定受益人 ,投保人必須經(jīng)被保險人同意。 ? If the insured is a person incapable of civil acts or whose capability of civil acts is restricted ,the guardian shall appoint the beneficiaries . ? 如果被保險人是一個無民事行為能力或限制民事行為能力人 ,監(jiān)護人應(yīng)指定受益人。 ? Personal Insurance Contract ? Article 31 ? A proposer shall have an insurable interest in the following persons: ? 1. him/herself。 ? 2. his/her spouse, children or parents。 ? 3. other family members or close relatives, in addition to those aforementioned, who have a foster, support or maintenance relationship with the proposer。 and ? 4. employees who have an employment relationship with the proposer. ? 第三十一條 投保人對下列人員具有保險利益： ? （一）本人； ? （二）配偶、子女、父母； ? （三）前項以外與投保人有撫養(yǎng)、贍養(yǎng)或者扶養(yǎng)關(guān)系的家庭其他成員、近親屬； ? （四）與投保人有勞動關(guān)系的勞動者。 ? In addition to the circumstances mentioned in the preceding paragraph, the proposer shall be deemed to have an insurable interest in the insured if the insured consents to theconclusion of the contract by the proposer on his/her behalf. ? 除前款規(guī)定外，被保險人同意投保人為其訂立合同的，視為投保人對被保險人具有保險利益。 ? If, at the time of the conclusion of the contract, the proposer does not have an insurable interest in the insured, the contract shall be invalid. ? 訂立合同時，投保人對被保險人不具有保險利益的，合同無效。 ? If the age of the insured reported by the proposer is false and the insured’ s true age does not ply with the age restriction specified in the contract, the insurer may terminate the contract and refund, in accordance with the contract, the cash value of the policy. The third paragraph and sixth paragraph of Article 16 hereof shall apply to the exercise by the insurer of its right to terminate the contract. ?投保人申報的被保險人年齡不真實，并且其真實年齡不符合合同約定的年齡限制的，保險人可以解除合同，并按照合同約定退還保險單的現(xiàn)金價值。保險人行使合同解除權(quán)，適用本法第十六條第三款、第六款的規(guī)定。 ? If
