【正文】 2022 屆本科畢業(yè)論文 題目: FIDIC 合同條件下承包商的費(fèi)用索賠策略研究 Research on Contractor’s Cost Claim Strategy based on FIDIC Conditions of Contract for Construction 姓 名: 張坤 學(xué) 號(hào): 20222982 學(xué) 院: 管理學(xué)院 專(zhuān) 業(yè): 工程造價(jià) 班 級(jí): 08— 2 指導(dǎo)教師: 徐瑾 講師 FIDIC 合同條件下承包商的 費(fèi)用索賠策略研究 摘要 改革開(kāi)放以來(lái),我國(guó)許多大型乃至超大型國(guó)有施工企業(yè)在“走出去”的國(guó)家戰(zhàn)略指導(dǎo)下, 不斷 完善市場(chǎng)結(jié)構(gòu)合理化布局,積極拓展海外市場(chǎng)并取得了不小的成就。 國(guó)際工程承包市場(chǎng)向來(lái)競(jìng)爭(zhēng)激烈,特別是在 2022 年金融危機(jī)的背景下,基建投資計(jì)劃大面積收縮,許多大型工程項(xiàng)目被迫延期甚至取消,為了爭(zhēng)奪有限的工程項(xiàng)目,承包商不得不壓低投標(biāo)價(jià)格以獲取承包權(quán)。在此種情況下,承包商的索賠技巧及索賠管理水平對(duì)盈利能力的影響大大提高。 本文 從承包商的角度出發(fā), 以 國(guó)際工程承包中廣泛使用的 FIDIC 施工 合同條件( 1999 年第 一 版)為依據(jù), 通過(guò) 深入解讀 FIDIC 施工 合同條件 通用條件 中與索賠有關(guān) 的 條款 、 仔細(xì) 梳理承包商索賠 的 程序、 系統(tǒng)歸納 費(fèi)用索賠 的 內(nèi)容與計(jì)算方法以及 詳細(xì)介紹 索賠報(bào)告 的 內(nèi)容與編寫(xiě)要求, 引入索賠矩陣 —— 這一在國(guó)際工程索賠管理中的新工具 ,深入探討了在 FIDIC 合同條件下承包商的費(fèi)用索賠策略問(wèn)題并提出了運(yùn)用索賠矩陣 來(lái) 構(gòu)建初步的索賠專(zhuān)家系統(tǒng)模型的 新 思路。 關(guān)鍵詞: FIDIC 承包商 費(fèi)用索賠 索賠矩陣 Research on Contractor’s Cost Claim Strategy based on FIDIC Conditions of Contract for Construction ABSTRACT A large number of stateowned construction panies, especially giant conglomerates, under the direction of national strategy of “go abroad”, have been trying to perfect reasonably marketdriven structural layout and actively expand overseas market, and gain much achievement. The international project contracting market has been among fierce petition and because of the financial crisis emerging from 2022, the infrastructure investment plan is shrinking enormously and many huge projects have been forced to be delayed or concealed. The international contractors have to reduce their tender price to obtain the contract. In this circumstance, the petence of claims and level of claims management is being more and more important to the contractors’ profitability.
