【正文】 務書應該附在已完成的畢業(yè)設計（論文）的首頁。 北京航空航天大學畢業(yè)設計 (論文 ) 第 頁 本人聲明 我聲明，本論文及其研究工作 是由本人在導師指導下獨立完成的，在完成論文時所利用的一切資料均已在參考文獻中列出。 作者： 簽字： 時間： 北京航空航天大學畢業(yè)設計 (論文 ) 第 XI 頁 對我國離婚賠償制度的探討 摘 要 為適應改革開放 20 年來社會發(fā)展的新狀況，立法機關于 2021 年 4 月 28 日通過的《婚姻法》修正案（以下簡稱《婚姻法》）中新增了離婚損害賠償制度，即第 46 條之規(guī)定。該規(guī)定提出： “ 有下列情形之一，導致離婚的，無過錯方有權請求損害賠償：（一）重婚的；（二）有配偶者與他人同居的；（三）實施家庭暴力的；（四）虐待、遺棄家庭成員而導致離婚的。 ” 同年 12 月 24 日最高人民法院公布的《關于適用婚姻法若干問題的 司法解釋 》（以下簡稱司法解釋）中就如何適用離婚損害賠償制度作了具體規(guī)定?！痘橐龇ā芳捌渌痉ń忉寣﹄x婚賠償制度的明確規(guī)定，是在充分考慮我國婚姻家庭現狀，為維護健康的婚姻家庭關系而做出的，對制裁離婚過錯者，保護無過錯方，維護婚姻當事人的合法人身、精神權益，具有重要的立法意義。該制度是我國立法上的一個重大進步，但是還有一些不足之處，本文擬對離婚損害賠償制度進行理論分析，并對其完善提出一些建議。 ，并提出了自己的一些看法和建議。 關鍵詞： 婚姻法 ， 離婚損害賠償 北京航空航天大學畢業(yè)設計 (論文 ) 第 II 頁 Of our system of divorce damages Author : Zhu En Tutor : Zhang Chun Abstract To meet the 20 years of reform and opening up a new state of social development, the legislature on April 28, 2021 through the marriage amendment (hereinafter referred to as Marriage) added a divorce damages, that the provisions of Article 46 . The provisions: one of the following circumstances, lead to divorce, the innocent party the right to claim damages: (a) Bigamy。 (b) has a spouse living together with others。 (c) of domestic violence。 (d) abuse, abandonment of family members which led to divorce. Supreme People39。s Court on 24 December the same year published a number of issues concerning the application of judicial interpretation of the Marriage Law (hereinafter referred to judicial interpretation) on how to apply divorce damages made specific requirements. Marriage and its judicial interpretation of the pensation system for the clear provisions of the divorce is taking full account of our marriage and family situation, to maintain a healthy marriage and family relations made on sanctions fault divorce, to protect the innocent party, the parties to maintain the marriage legal person, the spirit of equity, an important legislative significance. The system is one of China39。s significant progress on the legislation, but there are some shortings, this paper intends to divorce damages the theoretical analysis and some suggestions for its improvement.
