【正文】 Scope本手冊就海斯坦普金屬成型(武漢)有限公司(以下簡稱“海斯坦普武漢公司”或公司)的勞動(dòng)條件及公司員工(以下簡稱“員工”)的工作職責(zé)做出規(guī)定。其他未在本手冊里規(guī)定的事宜應(yīng)按照海斯坦普武漢公司和員工簽訂的書面勞動(dòng)合同的條款執(zhí)行。海斯坦普武漢公司的員工應(yīng)遵守本手冊。This Employee Manual regulates the employment conditions and job responsibilities of employees of Gestamp Metal Forming(Wuhan)Ltd. (GMF WUHAN or Company for short). The Employee Manual is the basis of employment at GMF WUHAN. Additional and individual conditions are agreed upon in he written labor contract signed between the Company and every employee. All employees of GMF WUHAN must obey these rules. ◆2 雇傭程序 Employment 根據(jù)中國法律規(guī)定,海斯坦普武漢公司作為一家外商獨(dú)資企業(yè)擁有其相關(guān)的管理權(quán)限。公司有權(quán)按中國勞動(dòng)法自行聘用和解雇員工或終止勞動(dòng)合同。According to relevant Chinese Legislation, as a whollyforeign owned enterprise, GMF WUHAN enjoys certain management rights. The Company has the right to employ and dismiss employees or terminate their labor contracts, restricted only by the Chinese labor law. 公司員工數(shù)及其任職要求由公司根據(jù)公司業(yè)務(wù)發(fā)展需要決定。According to the pany’s business and development, the management determines the number of employees and their required qualifications. 試用期 Probation period試用期根據(jù)具體情況為16個(gè)月(根據(jù)勞動(dòng)合同約定)。試用期屆滿,由員工上級(jí)完成試用期回顧并給予反饋。The probation period is 1 to 6 months, according to the individual situation (Based on labor contract). At the end of the probation period, the superior of this employee will review the probation development and provide feedback. 公司應(yīng)與每位員工簽訂個(gè)人勞動(dòng)合同。The Company signs an individual labor contract with every employee. 公司每年將免費(fèi)給員工提供一次健康體檢服務(wù)。The Company will provide the employee a free medical check every year. 員工需在上崗第一天提交下列文件的復(fù)印件一份;同時(shí)需查驗(yàn)原件。如果沒有原件,需要提交經(jīng)證明核準(zhǔn)的復(fù)印件。Employees must submit the following items to GMF WUHAN at the 1st day of work. Documents must be presented in original and 1 copy. In cases where original documents are not on hand, certified copies must be presented.a) 與先前公司解除勞動(dòng)合同的文件;A document confirming the termination of the labor contract with the previous pany。b) 下列證書原件及復(fù)印件:學(xué)位證書、畢業(yè)證書、職業(yè)資格證書、特殊工種的操作證書、技術(shù)等級(jí)證書、外語等級(jí)證書、前公司公積金證明等;公司有權(quán)對證書進(jìn)行核實(shí);Certificates and its certified copies of the following documents: education or graduation certificates, employment certificates , specific machine operating certificates and technical skills certificates,foreign language certificates, housing fund information。 The Company has right to check the authenticity of these certificates.c) 一份身份證或護(hù)照復(fù)印件;A passport or ID card photocopy。d) 體檢報(bào)告Health report。e) 在海斯坦普武漢公司任職時(shí)或在海斯坦普武漢公司任職前,海斯坦普武漢公司可能要求的其他信息或文件。GMF WUHAN may request any other messages and documents before or during the employment of the employee.f) 根據(jù)需要將人事檔案轉(zhuǎn)到“武漢光谷人才服務(wù)中心”的公司人事代理專戶下。Transfer the official personnel registration record to Wuhan East Lake HR Service Centre with the support of the Company39。s HR Dept if necessary. 海斯坦普武漢公司會(huì)根據(jù)個(gè)人數(shù)據(jù)保護(hù)規(guī)定及公司員工個(gè)人檔案管理的有關(guān)規(guī)定來負(fù)責(zé)收集、保持、處理和使用員工的個(gè)人資料。個(gè)人數(shù)據(jù)的收集權(quán)限于合法的以及與員工的聘用相關(guān)的目的,直接主管、部門經(jīng)理、總經(jīng)理有權(quán)了解這些資料。海斯坦普武漢公司將采取一切實(shí)際可行的措施以保證員工個(gè)人資料的安全性,并防止未經(jīng)授權(quán)的人員接觸,銷毀或使用這些資料。GMF WUHAN will file, keep, handle and use the employee39。s personal information according to the document management rules and privacy protection regulation. The right to pile individual statistics is restricted by the law and can only be for purposes related to employment. Direct Supervisors, Department Managers and the General Manager have the right to see some of those documents. GMF WUHAN takes all the necessary measures to protect individual information and prevents unauthorized persons from accessing, removing or using this information. 本手冊將提供給員工每人一份。A copy of this manual is handed to every employee. 每位員工應(yīng)將下列任何事項(xiàng)的變動(dòng), 提交書面證明文件給人力資源部以更新員工信息:In case any of the following conditions change, the employee should inform HR department of the change by submitting relevant documents:a) 合法送達(dá)地址;Legal contact address。b) 教育程度、資歷證明;Level of education and qualification。c) 姓名;Surname and given name。d) 婚姻狀況;Marriage status。e) 其它重要個(gè)人資料或事宜。Other important personal issues. ◆3 員工辭職(退)程序 Procedure of leaving the Company 員工提出離職,須提前三十日以書面形式通知公司。試用期內(nèi)的員工提出離職,須提前三日以書面形式通知公司。 An employee may terminate his employment contract upon 30 days’ prior written notice to the pany. During his probation period, an Employee may terminate his employment contract by giving the pany three days’ prior notice. 如果員工離職,無論任何原因(勞動(dòng)合同到期、員工提出或公司提出解除勞動(dòng)合同)都必須履行正常的離職手續(xù),包括把與工作相關(guān)的文件(含電子文件)上交給他/她的上司,歸還公司的物品(手機(jī)、電腦、文具、洗凈的工作服、勞保用品、工具等),并向他/她的上司或被上司指定的同事說明工作的進(jìn)展?fàn)顩r。離職前確保所有交接工作完成,在完成程序的同時(shí),填寫《離職流程表》,取得相關(guān)人員及經(jīng)理的簽字同意,公司才為其辦理其他離職手續(xù)。If an employee leaves the Company, no matter for what reason (. expiration of labor contract, notice by the employee or by the Company to terminate the contract), he or she has to plete the proper leaving procedures. These include handing over all workrelated documents (including electronic documents) to his or her superior, returning all Company objects that he or she may have used during work (. mobile phone, puter, stationary, the washed work uniform, safety items, tools etc.), and explaining the status of his or her work to his or her superior or a colleague designated by the superior. A proper and plete handover to a colleague or superior is an important matter when terminating the employment. After pleting all these procedures, the employee should fill in and sign the Leaving Employee Checklist and submit it for approval by signature to his superior and relevant manager. Then Company can deal with the leaving procedures. ◆4 勞動(dòng)合同 Labor Contract本手冊任何一條規(guī)定,如果與員工和海斯坦普武漢公司之間勞動(dòng)合同不一致或有沖突,所涉及的員工的事宜應(yīng)該遵照或服從勞動(dòng)合同的條款執(zhí)行。If there is a conflict between any of these rules in this manual and the labor contract signed between GMF WUHAN and the employee, the issue shall be handled according to the individual labor contract. ◆5 公司規(guī)定 Company Regulations 員工必須遵守海斯坦普武漢公司的規(guī)定,聽從上級(jí)管理人員的工作要求,盡職盡責(zé)。The employees must obey the pany regulations, follow the instructions and orders of their superiors, and fulfill their duties and responsibilities as best they can. 上級(jí)管理人員必須正直地履行他們的職責(zé),以寬
