【正文】 SIP Labor and Social Security Bureau SIP Human Resource Department 4 (二)甲方必須為乙方提供符合國(guó)家規(guī)定 的勞動(dòng)安全衛(wèi)生條件和必要的勞動(dòng)防護(hù)用品,安排乙方從事有職業(yè)危害作業(yè)的,應(yīng)定期為乙方健康檢查,并在乙方離職前進(jìn)行健康檢查 Party A shall provide Party B with plied national occupational safety and health conditions and necessary labor protection articles, if Party A arrange Party B to engage in occupational hazards, periodic health checks and final health check is pulsory for Party B before he/she leave his/her job. (四) 甲方 依法安排 乙方 延長(zhǎng) 工作時(shí)間 或者在 休息日 、 法定休假日 加班 的 , 應(yīng)依法安排乙方補(bǔ)休或 支付 相應(yīng) 加班工資 。 As agreed by both parties, Party A shall take (□RMB _________□Collective contract or stated in rules and regulations) as basis for overtime wages calculation. (三) 如乙方發(fā)生工傷事故,甲方應(yīng)負(fù)責(zé)及時(shí)救治,或提供可能的幫助,并在規(guī)定時(shí)間 內(nèi)向勞動(dòng)保障部門(mén)提出工傷認(rèn)定申請(qǐng),為乙方依法辦理勞動(dòng)能力 鑒定,并為享受工傷醫(yī)療待遇履行必要的義務(wù)。 If Party B falls sick or suffers nonworkrelated injuries during the term of employment, Party B shall be entitled to the medical treatment leave and medical benefits in accordance with the regulations of State and regional, Party A shall reimburse medical expense in accordance with medical insurance and other relevant regulations, shall also pay Party B’s sick leave wage or sick relief funds within stated medical treatment leave. 七 、勞動(dòng)合同的 變更、 解除和終止 Article 7 Amendment, Termination and Ending of the Labor Contract (一) 任何一方要求變更本合同的有關(guān)內(nèi)容,都應(yīng)以書(shū)面形式通知對(duì)方。甲方發(fā)生合并或者分立等情況,本合同繼續(xù)有效,由承繼甲方權(quán)利和義務(wù)的單位繼續(xù)履行。其中由甲方提出解除本合同的,應(yīng)按規(guī)定支付經(jīng)濟(jì)補(bǔ)償。 Party B materially breaches the Employer’s rules and regulations。 Party B has additionally established an employment relationship with another Employer which materially affects the pletion of his/her tasks with Party A, or he refuses to rectify the matter after the same is brought to his/her attention by Party A。 Party B has his/her criminal liability pursued in accordance with the law。 Party B is inpetent and remains inpetent after training or adjustment of his/her position。 Party A shall give Party B 30 days’ prior written notice(or one month’s wage in lieu of notice) and pay economic pensation according to law under , or stipulated in this Contract, among Party A shall pay medical treatment pensations to Party B under article . 有下列情形之一,甲方在履行規(guī)定程序后,可以裁減人員,并按規(guī)定支付經(jīng)濟(jì)補(bǔ)償: ( 1)甲方依照企業(yè)破產(chǎn)法規(guī)定進(jìn)行重整的; ( 2)甲方生產(chǎn)經(jīng)營(yíng)發(fā)生嚴(yán)重困難的; ( 3)甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營(yíng)方式調(diào)整的; ( 4)其他因勞動(dòng)合同訂立時(shí)所依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生 重大變化,致使本合同無(wú)法履行的。 Party A has serious difficulties in production and/or business operations。 SIP Labor and Social Security Bureau SIP Human Resource Department 8 Party B may terminate this Contract upon 30 days’ prior written notice to Party A. During his/her probation period, Party B may terminate this Contract by giving Party A three days’ prior notice. 有下列情形之一的,乙方可以解除本合同,甲方應(yīng)按規(guī)定支付經(jīng)濟(jì)補(bǔ)償: ( 1)甲方未按照勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的; ( 2)甲方未及時(shí)足額支付勞動(dòng)報(bào)酬的; ( 3)甲方未依法為乙方繳納 社會(huì)保險(xiǎn)費(fèi) 的; ( 4)甲方的規(guī)章制度違反法律、法規(guī)的規(guī)定,損害乙方權(quán)益的; ( 5)甲方以欺詐、脅迫的手段或者乘人之危,使乙方在違背真實(shí)意思的情況下訂立或者變更本合同,致使本合同或者變更協(xié)議無(wú)效的; ( 6)甲方免除自己的法定責(zé)任、排除乙方權(quán)利,致使本合同無(wú)效的; ( 7)甲方違反法律、行政法規(guī)強(qiáng)制性規(guī)定,致使本合同無(wú)效的; ( 8)甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫乙方勞動(dòng),或者違章指揮、強(qiáng)令冒險(xiǎn)作業(yè)危及乙方人身安全的; ( 9)法律、行政法規(guī)規(guī)定乙方可以解除勞動(dòng)合同的其他情形。 In any of the following circumst
