【正文】 制度相抵觸，乙方同意服從國家新規(guī)定和甲方新規(guī)章制度。乙方應(yīng)當認真履行自己的勞動職責，并親自完成本合同約定的工作任務(wù)。 八、勞動合同的解除、終止和續(xù)訂第二十條 經(jīng)甲、乙雙方當事人協(xié)商一致，本合同可以解除。第二十一條 乙方有下列情形之一的，甲方可以隨時解除本合同： 嚴重違反勞動紀律和規(guī)章制度的； 嚴重失職，營私舞弊，給甲方造成重大損失的； 乙方?jīng)]有經(jīng)過甲方同意，同時與其他用人單位建立勞動關(guān)系，對完成甲方的工作任務(wù)造成嚴重影響，或者經(jīng)甲方提出，拒不改正的； 因勞動合同期滿致使本合同無效的； 依法被追究刑事責任或勞動教養(yǎng)的； 乙方利用職務(wù)之便收受賄賂的或泄漏公司機密造成公司損失的。 在試用期內(nèi)的； 甲方以暴力、威脅或者非法限制人身自由的手段強迫勞動的； 甲方未按照勞動合同約定支付勞動報酬或者提供勞動條件的。第二十四條 乙方有下列情形之一的，甲方不得按本合同第二十四條的約定與乙方解除勞動和同： 在甲方工作期間患職業(yè)病或者因工負傷并被確認喪失或者部分喪失勞動能力的； 患病或因工負傷，在規(guī)定的醫(yī)療期間的； 女職工在孕期、產(chǎn)期、哺乳期的； 法律、行政法規(guī)規(guī)定的其他情形。九、賠償責任、違約責任第二十六條 乙方未能提前書面提出解除勞動合同的賠償金：未按照《勞動合同法》提前三十日書面形式通知甲方解除勞動合同，需按照乙方日工資的標準來補足時間的賠償。第二十八條 甲方根據(jù)乙方的要求出資為乙方辦理了外省市專業(yè)技術(shù)人員、管理人員的調(diào)動引進手續(xù)，在入戶手續(xù)完畢后，必須在本公司服務(wù)期滿 年。若在服務(wù)期內(nèi)自行離開公司或違紀被甲方解除合同的，按 元人民幣的賠償額，根據(jù)乙方未服務(wù)滿的年限，按比例折算（年平均賠償金額）賠償。第三十條 乙方不得在任何情況下將甲方的保密資料直接或者間接泄露給任何外人，如經(jīng)甲方發(fā)現(xiàn)按甲方損失大小賠償。第三十二條 甲乙雙方協(xié)商不成，可由爭議的一方申請勞動仲裁。第三十四條 從本合同簽訂生效之日起，原合同即日廢止。兩份合同具同等法律效力。s Republic of China, Labor Contract Law of the People’s Republic of China, and Regulations of Shanghai Municipality on Labor Contract, in the principles of fairness, legitimacy, equality, voluntariness, consensus through negotiation and good faith. 1.
