【正文】 d) In particular circumstances, which are not violating national laws or regulations or applicable CBA, Shipowner allow seafarers to terminate the seafarer Employment Agreement at shorter notice or without notice without penalty for passionate or other urgent reason.作為特殊情況，在不違背國家法律或條例或《集體談判協(xié)議》前提下，公司允許海員出于值得同情的原因或其他緊急原因提前較短時間通知或不通知就終止就業(yè)協(xié)議，而不受懲罰。b) Seafarers signing a seafarers’ employment agreement shall be given an opportunity by the Shipowner to examine and seek advice on the agreement before signing, to ensure that they have freely entered into an agreement with a sufficient understanding of their rights and responsibilities.公司與每位海員在簽訂《海員就業(yè)協(xié)議》時，應(yīng)給予時間讓海員有機(jī)會對《海員就業(yè)協(xié)議》進(jìn)行審查和征詢意見，在充分理解了其權(quán)利和義務(wù)及自愿情況下簽署。n) Any other particulars (which national laws of the flag state may require).其他事項（根據(jù)船旗國法律要求的其它細(xì)節(jié)）。 and如果海員于工作期間死于船上或岸上，公司須支付喪葬費(fèi)用；以及v. The length of service includes the period of traveling to join the ship and the period of his repatriation from abroad to his proper return port. Justified absences from work is not considered as annual leave。ii. 準(zhǔn)許海員上岸休息以利于海員的健康和福利以及身體狀況滿足要求Seafarers is granted shore leave to benefit their health and wellbeing and with the operational requirements of their positions。 and海員在有權(quán)得到遣返前在船上服務(wù)的最長期間；以及iii. the precise entitlements to be accorded by shipowners for repatriation, including those relating to the destinations of repatriation, the mode of transport, the items of expense to be covered and other arrangements to be made by shipowners公司同意給予的具體遣返權(quán)利，包括關(guān)于遣返的目的地、旅行方式、船東將負(fù)擔(dān)的費(fèi)用項目和將做出的其他安排方面的內(nèi)容。 and also被海員出于合理的理由終止；以及c) When the seafarers are no longer able to carry out their duties under their employment agreement or cannot be expected to carry them out in the specific circumstances.如果海員不再具備履行其就業(yè)協(xié)議中職責(zé)的能力或在具體情形下不能指望其履行這些職責(zé)。如果當(dāng)海員在國外時海員就業(yè)協(xié)議到期；2. when their seafarers’ employment agreement is terminated:如果其海員就業(yè)協(xié)議：a) by the shipowner。s name and address,公司的名稱和地址；c) the place where and date when the seafarers’ employment agreement is entered into,訂立海員就業(yè)協(xié)議的地點和日期；d) the capacity in which the seafarer is to be employed,海員將擔(dān)任的職務(wù)；e) the amount of the seafarer’s wages,海員的工資待遇；f) the amount of paid annual leave,帶薪年假的計算天數(shù)；g) the termination of the agreement and the conditions, 協(xié)議的終止及其終止條件h) the seafarer39。3. Job description of each seafarer is clearly defined in the Company’s SMS Manuals. These are explained to the seafarer prior to joining the vessel. A copy of the job description is maintained by Seafarer work on board.公司的安全管理手冊中對每個海員的職責(zé)予以明確的界定。船員部應(yīng)參照香港船旗國的相關(guān)法律和慣例，以及香港船旗國和公司簽訂的集體談判協(xié)議的相關(guān)要求制訂《海員就業(yè)協(xié)議》，協(xié)議由海員能理解的語言編寫。并在海員服務(wù)期間，妥善保存這些證書并在海員證書清單中對證書的有效期進(jìn)行登記。b) When the seafarers’passport /passport that is about to expire within 12 months prior to his / her boarding, he / she shall apply to the marine administration for renewal. 當(dāng)海員上船前持有的海員證/護(hù)照即將在12個月內(nèi)過期時，應(yīng)向海事部門申請換新c) The master shall review accuracy, sufficiency and validity of Seafarer certificates while he/she board the ship海員上船時，船長須審核其持有的證書是否齊全、有效，證書記載的信息是否與實際一致d) The master discovered the forged or altered certificate should inform shipowner as soon as possible so as to take appropriate measures by shipowner.船長發(fā)現(xiàn)證書涂改或者偽造時，立即報告公司以便公司采取相應(yīng)的措施3. Certificate Care證書管理a) When confirming the certificate to be true，valid and fit for his/her duty on board, Marine Personnel Department scan and copy the Certificate and keep the hardcopy and softcopy in safe custody. 船員部檢查證書真實有效能夠適任船上工作后，對其證書進(jìn)行掃描和復(fù)印，并妥善保管電子版的掃描件和復(fù)印版本b) Corresponding Certificate shall be applied in accordance with the requirements of the flag state if the seafarer is assigned to work on a nonChinese ship, to ensure the identity information appeared on the Certificate is in consistent with the certificates of Chinese nationality by Marine Personnel Department. 如果在非中國籍船舶工作，根據(jù)所派船舶的船旗國的要求，船員部按照海員證書信息辦理相對應(yīng)的外籍證書，以確保海員證書信息一致性。c) Masters, officers and watchkeeping seafarers shall hold valid petency certificates and petency certificates of professional trainings in pliance with served navigation zone, ship type, tonnage or type of the main engine and assigned duties plying w
