【文章內(nèi)容簡介】 0。uponexamination,theapplicationmaterialsareinpleteorfailtosatisfythestatutoryforms,theSAQSIQshall,eitheronthespotorwithin5workingsdays,notifytheapplicantforoneoffoccasionoftheentirecontentsnecessarytobesupplementedorcorrected,andsignandissuethe“NoticeofSupplementationandCorrectionofRegistrationApplicationMaterialsofForeignSuppliersofImportedSolidWastesthatCanbeUsedasRawMaterials”(pleaserefertoAnnex3)tonotifytheapplicanttomakesupplementationsorcorrections.IftheSAQSIQfailstonotifytheapplicantwithinthetimelimit,itshallbeconsideredthattheSAQSIQhasentertainedtheapplicationasofthedateuponreceiptoftheapplicationmaterials.(3)Aftertheapplicantsupplementsorcorrectsthematerials,iftheapplicationmaterialsarepleteandsatisfythestatutoryformsuponexamination,theSAQSIQshallsignandissuetheNoticeofEntertaining.Ifthematerialsarestillinpleteorfailtosatisfythestatutoryforms,thesituationshallberegardedasabandonmentofapplicationandthe“NoticeofRejectionofRegistrationApplicationsofForeignSuppliersofImportedSolidWastesthatCanbeUsedasRawMaterials”(pleaserefertoAnnex4).第八條國家質(zhì)檢總局收到注冊(cè)登記申請(qǐng)書面材料之日起5個(gè)工作日內(nèi),做出是否受理注冊(cè)登記申請(qǐng)的決定:(一)經(jīng)審查,申請(qǐng)材料齊全、符合法定形式的,簽發(fā)《進(jìn)口可用作原料的固體廢物國外供貨商注冊(cè)登記申請(qǐng)受理通知書》(見附件2,以下簡稱“受理通知書”)。(二)經(jīng)審查,申請(qǐng)材料不齊全或者不符合法定形式的,當(dāng)場或者在5個(gè)工作日內(nèi)一次告知申請(qǐng)人需要補(bǔ)正的全部內(nèi)容,并簽發(fā)《進(jìn)口可用作原料的固體廢物國外供貨商注冊(cè)登記申請(qǐng)補(bǔ)正材料通知書》(見附件3),通知申請(qǐng)人補(bǔ)正。逾期不告知的,自收到申請(qǐng)材料之日起即為受理。(三)申請(qǐng)人補(bǔ)正材料后,經(jīng)審查資料齊全、符合法定形式的,簽發(fā)受理通知書。資料仍不齊全或者不符合法定形式的,視為放棄申請(qǐng),簽發(fā)《進(jìn)口可用作原料的固體廢物國外供貨商注冊(cè)登記申請(qǐng)不予受理通知書》(見附件4)。Article9 TheSAQSIQshall,within10workingdaysasofthedateuponentertainingoftheregistrationapplicationofaforeignsupplier,formanevaluationteamofexpertstocarryouttheevaluationinwriting.Thetimenecessaryfortheevaluationbyexpertsshallbeexcluded.Theevaluationteamshallcarryoutanevaluationinwritingontheapplicationmaterialssubmittedbytheforeignsupplier,andcarryoutexaminationthereononanitembyitembasisaccordingtotherequirementsofthe“RecordsonEvaluationRegardingtheRegistrationofForeignSuppliersofImportedSolidWastesthatCanbeUsedasRawMaterials”(pleaserefertoAnnex5).Theevaluationteamshall,afteracplishingtheevaluationwork,makeanevaluationconclusionandsubmitanevaluationreporttotheSAQSIQ.第九條國家質(zhì)檢總局自受理國外供貨商注冊(cè)登記申請(qǐng)之日起10個(gè)工作日內(nèi)組成專家評(píng)審組,實(shí)施書面評(píng)審。專家評(píng)審所需時(shí)間不計(jì)算在內(nèi)。評(píng)審組對(duì)國外供貨商提交的申請(qǐng)材料進(jìn)行書面評(píng)審,并按《進(jìn)口可用作原料的固體廢物國外供貨商注冊(cè)登記評(píng)審記錄》(見附件5)的要求逐項(xiàng)審核。評(píng)審組應(yīng)當(dāng)在評(píng)審工作結(jié)束后作出評(píng)審結(jié)論,向國家質(zhì)檢總局提交評(píng)審報(bào)告。Article10 TheSAQSIQshall,within10workingdaysasofthedateuponreceiptoftheevaluationreport,makethedecisiononwhetherornottoapprovearegistration.Ifaforeignsupplieriseligibleuponevaluation,theSAQSIQshallapproveitsregistrationandissuethe“CertificateofRegistrationofForeignSuppliersofImportedSolidWastesthatCanbeUsedasRawMaterials”(pleaserefertoAnnex6,hereinafterreferredtoasthe“CertificateofRegistration”。ifaforeignsupplierisineligibleuponexamination,theSAQSIQshallrejectitsapplication,signandissuethe“NoticeofRejectionoftheRegistrationofForeignSuppliersofImportedSolidWastesthatCanbeUsedasRawMaterials”(pleaserefertoAnnex7),statethereasonsforrejectioninwritingandnotifytheapplicantthatitisentitledtoapplyforadministrativereconsiderationorlodgeanadministrativeactionaccordingtolaw.第十條國家質(zhì)檢總局自收到評(píng)審報(bào)告之日起10個(gè)工作日內(nèi)作出是否準(zhǔn)予注冊(cè)登記的決定,對(duì)評(píng)審合格的國外供貨商,準(zhǔn)予注冊(cè)登記,并頒發(fā)《進(jìn)口可用作原料的固體廢物國外供貨商注冊(cè)登記證書》(見附件6,以下簡稱“注冊(cè)登記證書”)。對(duì)評(píng)審不合格的,不予注冊(cè),簽發(fā)《進(jìn)口可用作原料的固體廢物國外供貨商不予注冊(cè)登記通知書》(見附件7),并書面說明理由,告知申請(qǐng)人享有依法申請(qǐng)行政復(fù)議或者提起行政訴訟的權(quán)利。Article11 TheperiodofvalidityfortheCertificateofRegistrationforforeignsuppliersofimportedwastesourcedrawmaterialsshallbe3years.第十一條進(jìn)口廢物原料國外供貨商注冊(cè)登記證書有效期為3年。Article12 TheSAQSIQmaycarryoutsupervisionandselectiveexaminationovertheperformanceofevaluationteamsaccordingtocircumstances.ChapterIIIChange,ReapplicationandExtension第十二條國家質(zhì)檢總局根據(jù)情況可對(duì)評(píng)審組的工作質(zhì)量進(jìn)行監(jiān)督和抽查。第三章變更、重新申請(qǐng)和延續(xù)Article13 Iftheregisteredcontentsofaforeignsupplierundergoanychange,itshall,within30daysasofthedateofchange,submittotheSAQSIQanelectronicapplicationandalsothecorrespondingwrittenmaterialsaccordingtotheprovisionsofParagraph1ofArticle7oftheseRules:(1)ifthenameorstatutoryrepresentativeischanged,thematerialsprescribedbyItem(1)andItem(2)ofArticle6oftheseRulesshallbesubmitted。(2)iftheaddressischange
