【文章內(nèi)容簡(jiǎn)介】 目的口岸之后的12個(gè)月內(nèi)，在使用過(guò)程中若由于質(zhì)劣而出現(xiàn)損壞，買(mǎi)方應(yīng)通過(guò)書(shū)面立即通知賣(mài)方并憑________檢驗(yàn)局所頒發(fā)之檢驗(yàn)證書(shū)為依據(jù)，提出索賠要求。根據(jù)買(mǎi)方的要求，賣(mài)方應(yīng)負(fù)責(zé)立即排除缺陷，必要時(shí)，買(mǎi)方可自行排除缺陷，費(fèi)用由賣(mài)方負(fù)責(zé)，若賣(mài)方收到上述要求之后1個(gè)月內(nèi)未能答復(fù)買(mǎi)方，則便視為賣(mài)方已接受要求。第十六條 延遲交貨和罰款本合同內(nèi)所述的全部或部分商品，若賣(mài)方不能按時(shí)交貨或延遲交貨，且賣(mài)方同意罰款，則買(mǎi)方應(yīng)同意其延遲交貨，但本合同第16條規(guī)定的由于人力不可抗拒的原因而造成延遲交貨則不罰款，所罰的款項(xiàng)經(jīng)協(xié)商可由付款銀行從付款中扣除。罰款不應(yīng)超過(guò)延遲交貨的貨物總值之5%，%，不足7天的天數(shù)按7天算。若賣(mài)方超過(guò)本合同規(guī)定的裝運(yùn)時(shí)間10個(gè)星期仍然不能交貨，則買(mǎi)方有權(quán)取消本合同。盡管合同已取消，賣(mài)方仍然應(yīng)毫不延遲地支付上述罰款給買(mǎi)方。第十八條
