Key words:Marital Property System。例如法國的民法典規(guī)定，夫妻在締結(jié)財(cái)產(chǎn)協(xié)議的過程中，應(yīng)該有公證 5 人在現(xiàn)場，夫妻雙方對協(xié)議的內(nèi)容都表示接受并由在場的公證人簽章。夫妻財(cái)產(chǎn)協(xié)議對于雙方來說關(guān)系重大，涉及到的撫養(yǎng)、扶養(yǎng)、贍養(yǎng)關(guān)系，只有當(dāng)事人才能權(quán)衡輕重。從夫妻財(cái)產(chǎn)協(xié)議撤銷的原因上看，可能是自然撤銷，例如因?yàn)榛橐鲫P(guān)系解除、消滅或者像合同法上因?yàn)閰f(xié)議所附的條件不成立、喪失；也可能是合意撤銷，如夫妻雙方經(jīng)過協(xié)商解除。在如今的社會環(huán)境下，夫妻雙方財(cái)產(chǎn)關(guān)系日益復(fù)雜，夫妻約定財(cái)產(chǎn)制形式的種類局限于三選一，是無法滿足夫妻雙方 對財(cái)產(chǎn)約定多元化的要求。夫妻財(cái)產(chǎn)協(xié)議中約定財(cái)產(chǎn)歸一方所有時(shí)，另一方應(yīng)該承認(rèn)對方財(cái)產(chǎn)所有權(quán)的合法性，不得干涉對方對其財(cái)產(chǎn)行使權(quán)利。除此之外，從我國現(xiàn)行的《婚姻法》中可知，夫妻財(cái)產(chǎn)協(xié)議的主體身份是特殊的，因?yàn)?
