淺析我國的夫妻約定財產(chǎn)制度畢業(yè)論文-文庫吧在線文庫
【正文】 撫養(yǎng)、扶養(yǎng)、贍養(yǎng)關(guān)系，只有當事人才能權(quán)衡輕重。雖然我國關(guān)于夫妻約定財產(chǎn)制度的立法受到了本國文化傳統(tǒng)、法律習慣、文化觀念等先天性因素的影響，但這種制度如果如果能夠更好地適用于夫妻雙方，更好的維護雙方的合法權(quán)益，那么應新的需求在民法和婚姻法基本原則的前提下適當改變勢在必行。例如法國的民法典規(guī)定，夫妻在締結(jié)財產(chǎn)協(xié)議的過程中，應該有公證 5 人在現(xiàn)場，夫妻雙方對協(xié)議的內(nèi)容都表示接受并由在場的公證人簽章。 [4]夫妻財產(chǎn)關(guān)系是一種時刻處于變化狀態(tài)的法律關(guān)系，因而夫妻財產(chǎn)協(xié)議自然會面對情勢變更問題。 參考文獻 [1]蔣月主編 .婚姻家庭與繼承法 [M].廈門大學出版社 .2020 年 8 月第二版 .第 146147 頁 .
