淺析我國的夫妻約定財(cái)產(chǎn)制度畢業(yè)論文-文庫吧在線文庫
【正文】 撫養(yǎng)、扶養(yǎng)、贍養(yǎng)關(guān)系，只有當(dāng)事人才能權(quán)衡輕重。雖然我國關(guān)于夫妻約定財(cái)產(chǎn)制度的立法受到了本國文化傳統(tǒng)、法律習(xí)慣、文化觀念等先天性因素的影響，但這種制度如果如果能夠更好地適用于夫妻雙方，更好的維護(hù)雙方的合法權(quán)益，那么應(yīng)新的需求在民法和婚姻法基本原則的前提下適當(dāng)改變勢(shì)在必行。例如法國的民法典規(guī)定，夫妻在締結(jié)財(cái)產(chǎn)協(xié)議的過程中，應(yīng)該有公證 5 人在現(xiàn)場(chǎng)，夫妻雙方對(duì)協(xié)議的內(nèi)容都表示接受并由在場(chǎng)的公證人簽章。 [4]夫妻財(cái)產(chǎn)關(guān)系是一種時(shí)刻處于變化狀態(tài)的法律關(guān)系，因而夫妻財(cái)產(chǎn)協(xié)議自然會(huì)面對(duì)情勢(shì)變更問題。 參考文獻(xiàn) [1]蔣月主編 .婚姻家庭與繼承法 [M].廈門大學(xué)出版社 .2020 年 8 月第二版 .第 146147 頁 .
