【正文】 接問題：買方遲派船 ―― 《 INCOTERMS 2023》 買方責(zé)任 B B6： 如果買方未能給予賣方有關(guān)船名、裝船點(diǎn)和要求交貨時(shí)間的通知，或其指定的船只未按時(shí)到達(dá)，或未接收貨物，或較他所通知的交貨時(shí)間提早停止裝貨， 則自約定交貨日期或交貨期限屆滿之日起，有關(guān)貨物滅失或損壞的一切風(fēng)險(xiǎn)以及由此而發(fā)生的一切額外費(fèi)用。 25 CIF買賣雙方主要義務(wù) 賣方（ seller） ? 提供合同規(guī)定的貨物； ? 租船 /訂艙，支付運(yùn)費(fèi)； ? 辦理貨運(yùn)保險(xiǎn)，支付保險(xiǎn)費(fèi)； ? 在合同規(guī)定的裝運(yùn)期限內(nèi)在裝運(yùn)港將貨物交至運(yùn)往指定目的港的船上，并給予買方充分的通知； ? 承擔(dān)貨物裝載于船上為止的一切費(fèi)用和風(fēng)險(xiǎn)； ? 辦理出口清關(guān)手續(xù)，取得出口許可證和 /或其他證件，支付出口關(guān)稅和 /或其他費(fèi)用； ? 提供有關(guān)單據(jù)。 CIF買賣雙方主要義務(wù) 使用 CIF貿(mào)易術(shù)語 應(yīng)當(dāng)注意的 問題 CIF 不是到岸價(jià) 賣方對貨物裝上船后的情況不可能、也無必要承擔(dān)責(zé)任 賣方租船 /訂艙責(zé)任 按合同約定 。 CIF Ex Ship’s Hold。 賣方必須向買方提交 商業(yè)發(fā)票、保險(xiǎn)單和貨運(yùn)單據(jù) CIF的費(fèi)用結(jié)構(gòu) ? The seller delivers the goods, cleared for export, to the carrier nominated by the buyer at the named place. ? If the buyer nominated a person other than a carrier to receive the goods, the sell is deemed to have fulfilled his obligation to deliver the goods when they are delivered to that person FCA 貨交承運(yùn)人 … 指定地點(diǎn) ? If delivery occurs at the seller’s premises, the seller is responsible for loading. If delivery occurs at any other place, the seller is not responsible for unloading. ? Carrier means any person who, in a contract of carriage, undertakes to perform or to procure the performance of transport by rail, road, air, sea, inland waterway or by a bination of such modes. DAT … Delivery at terminal （ named terminal at port or place of destination）目的地終點(diǎn)卸貨后交貨（指定目的地） ―The seller delivers when the goods, once unloaded from the arriving means of transport , are placed at the disposal of the buyer at a named terminal at the named port or place of destination‖ ― the seller bears all risks involved in bringing the goods to and unloading them at the terminal at the named port or place of destination‖ ―Terminal includes any place, whether covered or not, such as a quay, warehouse, container yard or road, rail or air cargo terminal. DAT requires the seller to clear the goods for export, where applicable.
