General Provisions and Definitions總則和定義Article 1Application of URC 522第一款：《托收統(tǒng)一規(guī)則》第522號(hào)的應(yīng)用。a. The Uniform Rules for Collections, 1995 Revision, ICC Publication , shall apply to all collections as defined in Article 2 where such rules are incorporated into the text of the “collection instruction” referred to in Article 4 and are binding on all parties thereto unless otherwise expressly agreed or contrary to the provisions of a national, state or local law and/or regulation which cannot be departed from. 國際商會(huì)第522號(hào)出版物《托收統(tǒng)一規(guī)則》1995年修訂本將適用于第二款所限定的、并在第四款托收指示中列明適用該項(xiàng)規(guī)則的所有托收項(xiàng)目。除非另有明確的約定，或與某一國家、某一政府，或與當(dāng)?shù)胤珊蜕性谏У臈l例有所抵觸，本規(guī)則對(duì)所有的關(guān)系人均具有約束力。b. Banks shall have no obligation to handle either a collection or any collection instruction or subsequent related instructions. 銀行沒有義務(wù)必須辦理某一托收或任何托收指示或以后的相關(guān)指示。c. If a bank elects, for any reason, not to handle a collection or any related instructions received by it, it must advise the party from whom it received the collection or the instructions by telemunication or, if that is not possible, by other expeditious means, without delay.如果銀行無論出于何種理由選擇了不辦理它所收到的托收或任何相關(guān)的托收指示，它必須毫不延誤地采用電訊，或者如果電訊不可能時(shí)采用其它快捷的工具向他收到該項(xiàng)指示的當(dāng)事人發(fā)出通知。Article 2Definition of Collection第二款 托收的定義For the purposes of these Articles: 就本條款而言：a.“Collection” means the handling by banks of documents as defined in subArticle 2 (b), in accordance received, in order to: 托收是指銀行依據(jù)所收到的指示處理下述（2）款所限定的單據(jù)，以便于：I. obtain payment and/or acceptance, or取得付款和/或承兌；或II. deliver documents against payment and/or against acceptance, or憑以付款或承兌交單；或III. deliver documents on other terms and conditions. 按照其他條款和條件交單。b.“Documents”means financial documents and/or mercial documents: 單據(jù)是指金融單據(jù)和/或商業(yè)單據(jù)。I. “Financial documents”means bills of exchange, promissory notes, cheques, or other similar instruments used for obtaining the payment of money。 金融單據(jù)是指匯票、本票、支票或其他類似的可用于取得款項(xiàng)支付的憑證；II. “Commercial documents” means invoice, transport documents, documents of title or other similar documents, or any other documents whatsoever, not being financial documents.商業(yè)單據(jù)是指發(fā)票、運(yùn)輸單據(jù)、所有權(quán)文件或其他類似的文件，或者不屬于金融單據(jù)的任何其他單據(jù)。c.“Clean collection” means collection of financial documents not acpanied by mercial documents.d.“Documentary collection”means collection of: 光票托收是指不附有商業(yè)單據(jù)的金融單據(jù)項(xiàng)下的托收。I. financial documents acpanied by mercial documents。 附有商業(yè)單據(jù)的金融單據(jù)項(xiàng)下的托收；II. For the purposes of these Articles the “parties thereto” are: 就本條款而言，托收的關(guān)系人有：I. the “principal” who is the party entrusting the handling of a collection to a bank。 委托人即委托銀行辦理托收的有關(guān)人；II. the “remitting bank” which is the bank to which the principal has entrusted the handling of a collection。 寄單行即委托人委托辦理托收的銀行；III. “collecting bank” which is any bank, other than the remitting bank, involved in processing the collection。 代收行即除寄單行以外的任何參與處理托收業(yè)務(wù)的任何銀行；IV. the “presenting bank” which is the collecting bank making presentation to the drawee.b. The “drawee” is the one to whom presentation is to be made in accordance with the collection instruction. 付款人即根據(jù)托收指示向其提示單據(jù)的人。B．Form and Structure of Collections托收的形式和結(jié)構(gòu)Article 4Collection Instruction第四款 托收指示A i. All documents sent for collection must be acpanied by a collection instruction indicating that the collection is subject to URC522 and giving plete and precise instructions. Banks are only permitted to act upon the instructions given in such collection instruction, and in accordance with these Rules. 所有送往托收的單據(jù)必須附有一項(xiàng)托收指示，注明該項(xiàng)托收將遵循《托收統(tǒng)一規(guī)則》第522號(hào)文件并且列出完整和明確的指示。銀行只準(zhǔn)允根據(jù)該托收指示中的命令和本規(guī)則行事；ii.
