摘 要 隨著改革開(kāi)放進(jìn)程的加快,我們國(guó)家金融市場(chǎng)的持續(xù)發(fā)展,金融市場(chǎng)的專業(yè)化水平一直上升,金融業(yè)的混業(yè)經(jīng)營(yíng)模式持續(xù)增添了許多的新的活力,我國(guó)市場(chǎng)的消費(fèi)水平呈現(xiàn)上升的趨勢(shì),加之國(guó)民對(duì)于消費(fèi)水準(zhǔn)的要求有了很大的提升。金融商品提供者想要實(shí)現(xiàn)自身利潤(rùn)的最大化就不得不對(duì)金融市場(chǎng)進(jìn)行分割,這一系列行為突出的使金融消費(fèi)者自身合法權(quán)益受到越來(lái)越多的來(lái)自金融機(jī)構(gòu)的侵害??墒乾F(xiàn)階段我國(guó)沒(méi)有有關(guān)規(guī)制金融消費(fèi)者權(quán)益的專屬法律,以“一行三會(huì)”為代表的來(lái)自金融機(jī)構(gòu)的工作重點(diǎn)則更多的放在對(duì)金融機(jī)構(gòu)的監(jiān)管之上;在沒(méi)有法律明文規(guī)定、沒(méi)有有力的監(jiān)管機(jī)關(guān)的情況下,結(jié)果自身合法權(quán)益遭到不法侵害時(shí),只能以《消費(fèi)者權(quán)益保護(hù)法》作為基準(zhǔn)法進(jìn)行自身權(quán)益的維護(hù)或者直接向法院提起訴訟,用司法方式來(lái)解決。但是,維權(quán)結(jié)果往往并不樂(lè)觀。針對(duì)上述提到過(guò)的維權(quán)時(shí)潛在的諸多問(wèn)題,本文指出:我國(guó)要盡快公布《金融消費(fèi)者權(quán)益保保障法》并予以執(zhí)行。本文首先在概念上界定了金融消費(fèi)者與普通消費(fèi)并將其在法理上做了區(qū)分。深入分析了金融消費(fèi)者的權(quán)利的特征,以真實(shí)案件來(lái)系統(tǒng)闡述當(dāng)今我們國(guó)家在消費(fèi)者權(quán)利遭到損害的具體情況,并對(duì)緣由進(jìn)行了研究。在鑒戒西方發(fā)達(dá)國(guó)家先進(jìn)監(jiān)管的技術(shù)指導(dǎo)下,進(jìn)一步建議我們國(guó)家必須加快創(chuàng)立、完美的金融消費(fèi)者權(quán)利保護(hù)相關(guān)的法律規(guī)章的速度、還要逐步使金融監(jiān)管制度更能很好的規(guī)制金融市場(chǎng),所要達(dá)成的計(jì)劃是為金融消費(fèi)者合法權(quán)益的保護(hù)提供各個(gè)角度各個(gè)層次的深入探討!本文還介紹了西方發(fā)達(dá)國(guó)家有關(guān)金融消費(fèi)者權(quán)益保護(hù)的制度改革與創(chuàng)新的新做法,并進(jìn)而提供了一個(gè)建議就是:我國(guó)應(yīng)采用國(guó)際上改革的先進(jìn)經(jīng)驗(yàn),以中國(guó)的基本國(guó)情作為基礎(chǔ),以區(qū)分金融消費(fèi)者的含義和金融消費(fèi)者核心的權(quán)利為切入點(diǎn), 立法設(shè)想和權(quán)益保障的方式要明晰,創(chuàng)建一個(gè)能夠順應(yīng)我們國(guó)家金融業(yè)市場(chǎng)不斷變化發(fā)展的要求的法律軌制。國(guó)際上關(guān)于保護(hù)金融消費(fèi)者的總結(jié)起來(lái)有四種方式:第一:將保護(hù)金融消費(fèi)者的合法權(quán)益作為監(jiān)管機(jī)構(gòu)的監(jiān)管方向;第二:加強(qiáng)金融監(jiān)管組織關(guān)于金融消費(fèi)者權(quán)益保護(hù)的工作情況;第三:深化各個(gè)金融行業(yè)內(nèi)設(shè)自律組織機(jī)制;第四:新設(shè)專項(xiàng)解決金融消費(fèi)者投訴的機(jī)制。通過(guò)系統(tǒng)地研究探討世界各國(guó)涉及維權(quán)的最新經(jīng)驗(yàn)可以得出結(jié)論:中國(guó)在金融消費(fèi)者權(quán)益保障體制的不斷充實(shí)首當(dāng)其沖要從法律框架入手:首先,應(yīng)當(dāng)對(duì)金融消費(fèi)者權(quán)益保護(hù)進(jìn)行專門立法,以法律的形式對(duì)金融消費(fèi)者予以保護(hù);其次,加強(qiáng)各個(gè)金融監(jiān)管組織涉及到金融消費(fèi)者正當(dāng)權(quán)力的保護(hù)層次上的工作分擔(dān);再次,根據(jù)金融消費(fèi)者的弱勢(shì)地位,在金融服務(wù)提供者違反約定的情況下,要強(qiáng)化對(duì)金融服務(wù)提供者的責(zé)任上的制約。比如信息披露義務(wù),安全保障義務(wù)等等。最后,我們更應(yīng)該健全金融消費(fèi)者糾紛的救濟(jì)制度。關(guān)鍵詞:金融消費(fèi)者;金融消費(fèi)者保護(hù);監(jiān)管職責(zé) AbstractWith the acceleration of the process of reform and opening up and sustained development of our country39。s financial markets , financial markets professional level has been rising , the financial sector continued Mixed mode adds a lot of new vitality , the consumption level of the market showed an upward trend , coupled with the requirements of national standards for the consumer has been greatly improved .
