【正文】 湖南商學(xué)院學(xué) 年 論 文 題 目電子商務(wù)中相關(guān)法律問題的探討學(xué)生姓名夏 朝學(xué) 號080140020學(xué) 院經(jīng)濟與貿(mào)易學(xué)院專業(yè)班級商務(wù)0801指導(dǎo)教師陳娟職 稱副教授二 〇 一 一年四月電子商務(wù)中相關(guān)法律問題的探討[摘要] 國際互聯(lián)網(wǎng)的全球化熱潮使人類社會進入了一個新的信息時代。由于互聯(lián)網(wǎng)具有不受時間、地域限制的特性，電子商務(wù)一種與傳統(tǒng)交易形態(tài)截然不同的通過國際互聯(lián)網(wǎng)進行交易的方式應(yīng)運而生。但是，由于法律本身的滯后性，傳統(tǒng)法律尚未針對網(wǎng)絡(luò)交易這一新型交易方式進行補充或修正，造成許多衍生的法律問題無法用現(xiàn)行法律進行規(guī)范與調(diào)整。這使得許多準備從事網(wǎng)絡(luò)交易的商家望而卻步，影響到這一商業(yè)運作方式的迅速發(fā)展。因此積極加強對網(wǎng)絡(luò)交易的研究，建立規(guī)范網(wǎng)絡(luò)交易的靈活法律框架，不僅可保障進行網(wǎng)絡(luò)交易各方面的利益，而且還可保障網(wǎng)絡(luò)交易的順利進行。本文擬就有關(guān)問題進行探討。[關(guān)鍵字] 電子商務(wù)；立法；[ABSTRACT] the wave of Internet globalization drive humanity step into a new information age.
