【正文】 nd other welfares for the Employee according to the relevant laws after it receives the borrowing fees from Party B. The standards of the aforementioned contents will be subject to the terms and conditions of this contract and its appendixes, as well as the relevant rules and policies of Party A in relation with the welfares and reimbursement of medical treatment fees. (六)為派遣員工提供雙方確定的服務(wù)內(nèi)容。to provide other services which are agreed by two parties. (七)聽取乙方意見和建議,不斷改進工作。to accept the advices and suggestions provided by Party B, and improve its work accordingly. 第八條 甲方享有如下權(quán)利:Article 8 Party A shall enjoy the following rights: (一)如遇特殊情況,甲乙雙方不能達成一致意見時,甲方有權(quán)撤回派遣員工和解除本合同,但應(yīng)提前30天以書面形式通知乙方和派遣員工(派遣員工在試用期內(nèi)除外),同時甲方按下列方式向乙方一次性支付補償費: 派遣員工被派遣時間每滿一年,補償費為一個月的借用費,不足一年的部分按一年計算。補償費以派遣員工被撤回當(dāng)月的借用費為計算標(biāo)準(zhǔn)。In case in some special situations when two parties cannot reach an agreement, Party A shall have the right to recall its dispatched employee, but a 30 days’ prior written notice shall be made by Party A (except the dispatched employee is in the probation period), and shall be sent to Party B and the dispatched employee. Besides, Party A shall pay Party B pensation according to the following way.The pensation payment shall be made based on the working time of the dispatched employee, which shall be one month’s borrowing fee for each full year worked. Any period of not less than one year shall be counted as one year. The standard of pensation fee shall be the borrowing fee of the same month when the dispatched employee is recalled. ?。ǘ┘追接袡?quán)對乙方違反本合同有關(guān)條款或損害派遣員工合法權(quán)益的行為提出書面意見,進行交涉。乙方應(yīng)在收到甲方書面意見后六個工作日內(nèi),以書面形式回復(fù)甲方。 Party A is entitled to bring forward its opinions in written when Party B violates this Contract or damages the legal rights of the dispatched employee. And Party B shall reply in written within six (6) working days after it receives the aforementioned written notice made by Party A. (三)乙方若無故拖欠派遣員工的工資或借用費,甲方可隨時無條件解除本合同,并向乙方追索所欠費用。Party A is entitled to terminate this contract at any time for no reason, and claim for pensation from Party B, if Party B fails to pay the dispatched employee39。s wages, or fails to pay the borrowing fees. (四)派遣員工若侵害了乙方的合法權(quán)益,甲方可協(xié)助乙方追究員工的相關(guān)責(zé)任。 (4) Party A may offer assistance to Party B in asking the dispatched employee to take his liabilities, if the dispatched employee damages the legal rights of Party B. 第三章 乙方的義務(wù)與權(quán)利CHAPTER THREE THE OBLIGATIONS AND RIGHTS OF PARTY B第九條 乙方承擔(dān)下列義務(wù):Article 9 Party B shall assume the following obligations:(一)尊重派遣員工不同的民族習(xí)慣和宗教信抑,不歧視派遣員工。to respect the custom, religion and belief of the dispatched employee, and not to make any discrimination. ?。ǘ榕汕矄T工提供符合中國政府有關(guān)勞動保護規(guī)定的工作場所和條件,確定其工作崗位和工作內(nèi)容,并依法為派遣員工提供各項社會保險及住房公積金費用。否則,產(chǎn)生的后果由乙方自行承擔(dān)。 shall provide the dispatched Employee with necessary working condition which is in accordance with the relevant statutes in relate to labor protection, and clarify the working position and job description to the dispatched employee. Also, Party B shall pay the social insurance premiums and housing fund for the dispatched employee. Otherwise, Party B will be responsible for the results arising therefrom.
