Strengthening the contract management is to guarantee the contracting people fully fulfill their contractual obligations, realize the goal is to ensure that the construction (quality, investment, time limit) the important means. This paper the construction project contract management concept is explained, at present our country the construction project contract management present situation, this paper lists the main existing problems. Discussion is made on how to strengthen the management of the construction project contract meaning, status and functions, according to the present contract for construction project management in our country are the main problems, and put forward the corresponding measures to refuse. Finally, this paper briefly put forward for doing contract management from several aspects that should be paid attention to. 【 Key Words】 A contract for construction project。 Strengthening the contract management。隨著我國建筑業(yè)的不斷發(fā)展，建設(shè)工程項目的合同管理研究工作將會越來越被重視和普及。目前我國建設(shè)市場管理尚不完善，建設(shè)交易行為尚不規(guī)范，使得建設(shè)施工合同管理中存在諸多問題。使用合同來引導和管理建筑市場，順應了政府轉(zhuǎn)變職能，應用法律、法規(guī)和經(jīng)濟手段調(diào)節(jié)和管理市場的大趨勢。簡而言之，合同是當事人之間設(shè)立、變更或者終止權(quán)利義務的協(xié)議。廣義上的合同，指一切生產(chǎn)權(quán)利義務的協(xié)議。反映交易關(guān)系的合同指狹義上的合同，亦《中華人民共和國合同法》調(diào)整的合同。其中編制、簽訂、履行、變更、轉(zhuǎn)讓、解除、終止等是合同管的內(nèi)容；計劃、評審、監(jiān)督、控制、協(xié)調(diào)等是合同管理的手段。 廣義上講，建設(shè)工程合同管理有兩個層次，第一個層次是政府對工程合同的宏觀管理，第二個層次是合同當事人各方對合同實施的具體管理。 建設(shè)工程合同根據(jù)承包的 內(nèi)容不同，可分為建設(shè)工程勘察合同、建設(shè)工程設(shè)計合同與建設(shè)工程施工合同。 2)工程設(shè)計合同，是指設(shè)計人 (承包人 )根據(jù)發(fā)包人的委托，完成對建設(shè)工程項目的設(shè)計工作，由發(fā)包人支付報酬的合同。 3)工程施工合同，是指施工人 (承包人 )根據(jù)發(fā)包人的委托，完成建設(shè)工程項目的施工工作，發(fā)包人接 受工作成果并支付報酬的合同。 建設(shè)工程合同根據(jù)合同聯(lián)系結(jié)構(gòu)不同，可分為總承包合同與分別承包合同，還可分為總包合同與分包合同。總承包人就整個工程對發(fā)包人負責
