【正文】 ant shall be inspected, examined and tested by the Owner, and the Contractor shall give the Owner reasonable notice in writing of the date on which the Plant will be ready for testing.　　4. The Contractor shall provide such assistance, labour, materials, electricity , fuels, apparatus, stores and instruments as may be required and as may be reasonably demanded to carry out such tests by the Owner properly and efficiently.　　5. When the Plant shall have passed the above tests, the Owner shall furnish the Contractor with a certificate in writing to that effect. No Plant shall be delivered until any faults discovered during inspection are satisfactorily rectified.　　第七條 工地　　1. 承包商應(yīng)在工地上提供所有令業(yè)主滿意的材料、勞力、設(shè)備、服務(wù)和便利，以便順利施工和完工。　　3. 承包商應(yīng)遵守當(dāng)?shù)胤梢?guī)定的所安全及其他條例?！　rticle 7Inspection　　1. The Contractor shall provide at the Site to the reasonable satisfaction of the Owner all materials, labour, equipment, services and facilities that may be necessary for the proper execution and pletion of the Works.　　2. Without prejudice to the generality of the above, the Contractor shall provide, as may be necessary, the following:　　a. Construction equipment.　　b. Means of transport within the Site including temporary roadways.　　c. Fencing, lighting and guarding and all other materials and services necessary for the safety and security of persons and property.　　d. Temporary stores, offices and other buildings or structures for materials and persons engaged in the Words, including persons employed by the Owner.　　e. Telephones, firefighting equipment and firstaid equipment until the whole Works have been taken over.　　f. Sanitary and canteen facilities for the use of persons engaged in the Works.　　3. The Contractor shall observe all safety and other regulations imposed on the Site by local laws.　　4. The Contractor shall at all times keep the Owner39。　　2. 合同簽署后，承包商應(yīng)指定一名項(xiàng)目經(jīng)理，在工程進(jìn)行過程中全權(quán)代表承包商。業(yè)主向項(xiàng)目經(jīng)理發(fā)出的所有指示，如同發(fā)給承包商本人一樣，同樣具有約束力?！　rticle 8Inspection　　1. The Contractor will supply at his own cost food, transprot and all necessary facilities for all his own personnel.　　2. On signing the Contract, the Contractor shall appoint a project manager who will represent the Contractor at all times be present at the Site during working hours. All munications issued by the Owner to the project manager shall be binding as if given to the Contractor.　　3. The Owner may request the removal and replacement of any person employed by the Contractor on the Site if such person is in the Owner39。然而，如果根據(jù)本合同，這類損壞的責(zé)任不在承包商，而業(yè)主要求予以修復(fù)，承包商應(yīng)按業(yè)主指示辦理，但費(fèi)用由業(yè)主負(fù)擔(dān)?！　?. 如果業(yè)主因某種原因遭受索賠或訴訟，而按本條款規(guī)定承包商應(yīng)該或可能對(duì)該事由承擔(dān)法律責(zé)任，則業(yè)主應(yīng)立即書面通知承包商。如承包商要求，業(yè)主應(yīng)向承包商提供承包商為處理此類索賠或訴訟所需要的所有資料和幫助?！　. 為承包商和分包商的所的雇員投保雇員賠償險(xiǎn)，或者根據(jù)適用的法律和法規(guī)投保類似的法定社會(huì)保險(xiǎn)?！　. 對(duì)承包商或其分包商在執(zhí)行本合同中使用的所有車輛投保綜合汽車責(zé)任險(xiǎn)。保險(xiǎn)單應(yīng)包含保險(xiǎn)人放棄對(duì)業(yè)主及其工程師、顧問、雇員及代理人的代位權(quán)之條款。業(yè)主有權(quán)隨時(shí)索取保單、背書、續(xù)保和保險(xiǎn)費(fèi)收據(jù)的復(fù)印件。　　Article 10Inspection　　1. Without limiting the Contractor39。s and subcontractor39。s rights of subrogation against the Owner, its engineer, consultant and employees and agents.　　3. The Contractor shall maintain the aforesaid policies in full force and effect until the discharge of his obligations under this Contract, and the Owner shall have the right to demand from time to time copies of the policies, endorsements and renewals and receipts for payment of insurance premiums. If the Contractor fails to maintain any of these policies in full force and effect, the Owner shall have the right to rake out such policies and pay all relative premiums on behalf of the contractor and to deduct the relevant costs from and sums owing to the Contractor.　　第十一條 完工　　1. 一俟工廠的全部建設(shè)和安裝工程完工，承包商應(yīng)通知業(yè)主，并根據(jù)附錄的規(guī)定進(jìn)行機(jī)械安裝完成測(cè)試工作，直至業(yè)主滿意。在完工證明書簽發(fā)之前，不得給工廠進(jìn)料?！　rticle 11Inspection　　1. On pletion of all construction and erection work of the Plant, the Contractor shall inform the Owner and shall carry out mechanical erection pletion tests specified in Appendix (…) to the satisfaction of the Owner.　　2. On satisfactory pletion of such tests the Owner will issue a certificate of pletion of erection of the Plant. No feedstock shall be fed into the Plant until a certificate of pletion of erection has been issued.　　3. In the event of minor deficiencies in the construction and erection work which do not prevent erection pletion and/or in the event of defects revealed by the tests which do not prevent the startup of the Plant, the Owner shall issue a certificate of pletion of erection and the Contractor shall be obliged to rectify the deficiencies as quickly as possible thereafter.　　第十二條 最后驗(yàn)收　　1. 完工證明書頒發(fā)之后，承包商應(yīng)提前天將工廠性能測(cè)試的時(shí)間通知業(yè)主?！　?. 性能測(cè)試將按附示的規(guī)定進(jìn)行?！　?. 如果工廠未能通過性能測(cè)試，承包商在進(jìn)行他認(rèn)為必要的調(diào)整之后，應(yīng)在業(yè)主在場(chǎng)的情況下重新進(jìn)行測(cè)試，時(shí)間由雙方商定，條件照舊。如工廠未能通過性能測(cè)試，業(yè)主仍可酌情頒發(fā)最后驗(yàn)收合格證書，條件是承包商必須盡快糾正工廠存在的問題。承包商將根據(jù)附錄的規(guī)定向業(yè)主支付違約賠償費(fèi)，費(fèi)率不超過合同價(jià)格的%?！　?. 承包商應(yīng)根據(jù)附錄規(guī)定的格式開立一份以業(yè)主為受益人、金額為合同價(jià)格%的保證書，作為其履行本條款項(xiàng)下義務(wù)的保證。s delay liquidated damages of（…）% of the Contract Price up to a maximum of （…）% of the Contract Price in accordance with Appendix（…）.　　3. The Contractor shall establish, in favour of the Owner, a guarantee for（…）% of the Contract Price in the form set out in Appendix（…） in support of his obligations under this Article.　　第十四條 保修　　1. 承包商保證，在最后驗(yàn)收合格證書簽發(fā)日起個(gè)月內(nèi)或本合同生效日期個(gè)月內(nèi)（以先到日期為準(zhǔn)），所提供的工廠無設(shè)計(jì)、材料和工藝上的缺陷。承包商應(yīng)更換或修理所有有缺陷的零部件。如果承包商因某種特殊情況未能在適當(dāng)期限內(nèi)進(jìn)行雙方同意的補(bǔ)救工作，業(yè)主有權(quán)自行修復(fù)，但費(fèi)用由承包商負(fù)擔(dān)。如果業(yè)主未經(jīng)承包商同意試圖自行修正，則本保修條款無效。　　5. 如果承包商遵照上更換任何設(shè)備、材料或工藝，則本保修條款的規(guī)定也適用于經(jīng)修理或更換的設(shè)備、材料或工藝，期限為從修理或更換完成之日起1年。s representative is on Site or within（…）days if not, to the Contractor39。s expense.　　3.
