【正文】 加強質(zhì)量管理，產(chǎn)品質(zhì)量必須符合國家藥品標準。研究試制完畢后按有關(guān)新藥審批的辦法辦理，并要嚴栺試制品的保管與使用手續(xù)，防止流失。全國麻醉藥品的供應(yīng)計劃由國家醫(yī)藥管理局挃定的部門提出，報衛(wèi)生部、國家醫(yī)藥管理局審查批準后下達執(zhí)行。經(jīng)營單位只能按規(guī)定限量供應(yīng)經(jīng)衛(wèi)生行政部門批準的使用單位，不得向其他單位和個人供應(yīng)。罌粟殼的分配必須根據(jù)衛(wèi)生部和國家醫(yī)藥管理局共同審查批準的計劃調(diào)撥。藥品生產(chǎn)企業(yè)為配制中成藥所需罌粟殼計劃，由所在省、自治區(qū)、直轄市醫(yī)藥管理部門審核后，報衛(wèi)生行政部門核定下達執(zhí)行。 第四章 麻醉藥品的運輸 第十三條 運輸藥用阿片時，必須憑衛(wèi)生部簽發(fā)的國內(nèi)運輸憑照辦理運輸手續(xù)，原植物的種植單位調(diào)給國家醫(yī)藥管理局倉庫的藥用阿片由發(fā)貨單位派人押運，由倉庫調(diào)往藥品生產(chǎn)企業(yè)的由收貨單位派人押運。 運輸憑照由衛(wèi)生部統(tǒng)一印制。 第十五條 運輸單位承運麻醉藥品和罌粟殼，必須加強管理，及時運輸，縮短 在車站、碼頭、機場存放時間。 第十六條 運輸途中如有丟失，承運單位必須認真查找，并立即報告當(dāng)?shù)毓矙C關(guān)和衛(wèi)生行政部門查處。麻醉藥品進出口的年度計劃應(yīng)當(dāng)報衛(wèi)生部審批。 第十九條 出口麻醉藥品，應(yīng)向衛(wèi)生部提出申請并交驗進口國政府主管部門簽發(fā)的進口準許證，經(jīng)衛(wèi)生部審查發(fā)給《麻醉藥品出口準許證》后，方可辦理出口手續(xù)。 第六章 麻醉藥品的使用 第二十一條 麻醉藥品只限用于醫(yī)療、教學(xué)和科研需要。 教學(xué)、科研單位所用的麻醉藥品，由需用單位向當(dāng)?shù)匦l(wèi)生行政部門的上一級衛(wèi)生行政部門提出申請，經(jīng)批準后，向麻醉藥品經(jīng)營單位購用。 第二十二條 麻醉藥品使用單位在采購麻醉藥品時，須向麻醉藥品經(jīng)營單位填送 麻醉藥品申購單 。供應(yīng)數(shù)量按照衛(wèi)生部規(guī)定的麻醉藥品品種范圍及每季購用限量的規(guī)定辦理。但往來單據(jù)、證件均須掛號寄發(fā)。并憑蓋有 麻醉藥品專用章 的發(fā)票作為向郵局辦理郵寄的證明。管理范圍內(nèi)沒有的制劑或因醫(yī)療單位特殊需要的制劑，有麻醉藥品使用權(quán)的醫(yī)療單位經(jīng)縣以上衛(wèi)生行政部門批準，可以自行配制，其他任何單位不得自行配制。 進行計劃生育手術(shù)的醫(yī)務(wù)人員經(jīng)考核能正確使用麻醉藥品的，在進行手術(shù)期間有麻醉藥品處方權(quán)。麻醉藥品處方應(yīng)書寫完整，字跡清晰，簽寫開方醫(yī)生姓名，配方應(yīng)嚴栺核對，配方和核對人員均應(yīng)簽名，并建立麻醉藥品處方登記冊。 第二十七條 經(jīng)縣以上醫(yī)療單位診斷確需使用麻醉藥品止痛的危重 病人，可由縣以上衛(wèi)生行政部門挃定的醫(yī)療單位憑醫(yī)療診斷書和戶籍簿核發(fā)《麻醉藥品專用卡》，患者憑專用卡到挃定醫(yī)療單位按規(guī)定開方配藥。 第二十八條 醫(yī)療單位應(yīng)加強對麻醉藥品的管理。醫(yī)療單位要有專人負責(zé)，專柜加鎖，專用帳冊，專用處方，專冊登記。醫(yī)療單位對違反規(guī)定，濫用麻醉藥品者有權(quán)拒絕發(fā)藥，并及時向當(dāng)?shù)匦l(wèi)生行政部門報 告。 第七章 罰則 第三十條 凡違反本辦法的規(guī)定，有下列行為之一者，可由當(dāng)?shù)匦l(wèi)生行政部門沒 收全部麻醉藥品和非法收入，并視其情節(jié)輕重給予非法所得的金額五至十倍的罰款，停業(yè)整頓，吊銷《藥品生產(chǎn)企業(yè)許可證》、《藥品經(jīng)營企業(yè)許可證》、《制劑許可證》的處罰： （一）擅自生產(chǎn)麻醉藥品或者改變生產(chǎn)計劃，增加麻醉藥品品種的； (二 )擅自經(jīng)營麻醉藥品和罌粟殼的； （三）向未經(jīng)批準的單位或者個人供應(yīng)麻醉藥品或者超限量供應(yīng)的； （四）擅自配制和出售麻醉藥品制劑的； （五）未經(jīng)批準擅自進口、出口麻醉藥品的； （六）擅自安排麻醉藥品新藥臨床，不經(jīng)批準就投產(chǎn)的。 第三十二條 違反本辦法規(guī)定，擅自種植罌粟的，或者非法吸食麻醉藥品的，由公安機關(guān)依照 治安管理處罰條例或有關(guān)的規(guī)定給予處罰。 第三十四條 當(dāng)事人對行政處罰不服的，可在接到處罰通知之日起十五日內(nèi)，向作出處理的機關(guān)的上一級機關(guān)申請復(fù)議。對答復(fù)不服的，可在接到答復(fù)之日起十五日內(nèi)，向人民法院起訴。 第八章 附則 第三十五條 軍隊、武裝警察部隊衛(wèi)生醫(yī)療單位麻醉藥品的供應(yīng)、使用，由衛(wèi)生部會同中國人民解放軍總后勤部、中國人民武裝警察部隊后勤部根據(jù)本辦法，制定具體管理辦法 第三十六條 獸用麻醉藥品的供應(yīng)、使用，由衛(wèi)生部、農(nóng)牧漁業(yè)部根據(jù)本辦法，制定具體管理辦法。 第三十八條 本辦法自發(fā)布之日起施行。 MEASURES FOR THE CONTROL OF NARCOTIC DRUGS Important Notice: (注意事項 ) 英文本源自中華人民共和國務(wù)院法制局編譯 , 中國法制出版社出版的《中華人民 共和國涉外法規(guī)匯編》 (1991年 7月版 ). 當(dāng)發(fā)生歧意時 , 應(yīng)以法律法規(guī)頒布單位發(fā)布的中文原文為準 . Whole Document (法規(guī) ) MEASURES FOR THE CONTROL OF NARCOTIC DRUGS (Promulgated by the State Council of the People39。s Republic of China, for the purpose of tightening control over narcotic drugs so as to ensure their safe use in medical treatment units, medical colleges and medical research institutions. Article 2 Narcotic drugs refer to those drugs that may cause dependence and addiction after continuous administration. Article 3 Narcotic drugs include opium, cocaine, marijuana, synthetic anaesthetic drugs and those defined by the Ministry of Public Health as addictforming drugs, anaesthetic raw herbs and the products made from them. Article 4 The State shall strictly supervise and control the cultivation of the mother plants of narcotics and the production, supply, export and import of narcotic drugs. Narcotic drugs shall not be used except for the purpose of medical treatment, teaching and research when necessary. Chapter II The Cultivation of Mother Plants of Narcotics and the Production of Narcotic Drugs Article 5 The units that cultivate mother plants of narcotics must be examined and approved jointly by the Ministry of Public Health, the Ministry of Agriculture, Animal Husbandry and Fishery and the State Administration for Medicine. A copy of the report shall be sent to the Ministry of Public Security. The units that produce narcotic drugs must be examined and approved jointly by the Ministry of Public Health and the State Administration for Medicine.
