【正文】 屋用于經(jīng)營使用、需要將租賃房屋作為承租人的公司住所辦理工商注冊登記或者其他類似登記,在簽訂合同之前先進(jìn)行核查,如不能實現(xiàn)目的即不應(yīng)簽署合同;如初步核查可行,也應(yīng)在合同中明確約定該具體用途;如是否能注冊存在不確定性,合同應(yīng)約定不能注冊時的處理辦法,如解除合同、退還預(yù)付租金、押金等。實踐中因為約定不明,發(fā)生糾紛的不少。合同應(yīng)約定擅自改變用途時承租人的違約責(zé)任、出租人的解約權(quán)等。對承租人而言,如果要改變租賃用途,一定要事前取得出租人的書面許可。根據(jù)合同法規(guī)定,承租人未按照約定的方法或者租賃物的性質(zhì)使用租賃物,致使租賃物受到損失的,出租人可以解除合同并要求賠償損失。約定租賃期間租賃合同應(yīng)明確約定租賃的起止日期;根據(jù)合同法的規(guī)定,租賃期限不得超過二十年。超過二十年的,超過部分無效。租賃期間屆滿,當(dāng)事人可以續(xù)訂租賃合同,但約定的租賃期限自續(xù)訂之日起不得超過二十年。租賃期限六個月以上的,應(yīng)當(dāng)采用書面形式。當(dāng)事人未采用書面形式的,視為不定期租賃。租賃期未約定或約定不明的視為不定期租賃。當(dāng)事人可以隨時解除合同,但出租人解除合同應(yīng)當(dāng)在合理期限之前通知承租人。租金的計算與支付租金起算點(diǎn)要明確;如有裝修時間,不計算租金的(所謂免租期),也應(yīng)明確。合同法第二百二十六條規(guī)定,承租人應(yīng)當(dāng)按照約定的期限支付租金。對支付期限沒有約定或者約定不明確,依照本法第六十一條的規(guī)定(補(bǔ)充協(xié)議約定或合同相關(guān)條款、交易習(xí)慣)仍不能確定,租賃期間不滿一年的,應(yīng)當(dāng)在租賃期間屆滿時支付;租賃期間一年以上的,應(yīng)當(dāng)在每屆滿一年時支付,剩余期間不滿一年的,應(yīng)當(dāng)在租賃期間屆滿時支付。合同法第二百二十七條規(guī)定,承租人無正當(dāng)理由未支付或者遲延支付租金的,出租人可以要求承租人在合理期限內(nèi)支付。承租人逾期不支付的,出租人可以解除合同。好的合同可以避免或減少糾紛的發(fā)生。如何審查房屋租賃合同,其實也似簽訂房屋租賃合同應(yīng)當(dāng)注意的事項。這次主要分析的是:租賃合同違約金;房屋裝修;房屋的交接等。(歡迎關(guān)注:elawyers)裝修與提前解約合同宜約定,承租人裝修房屋和裝修方案應(yīng)獲得出租人書面同意;裝修不應(yīng)破壞房屋基本結(jié)構(gòu);對裝修的其他約定。承租人提前解除合同,不得要求退還裝修費(fèi)。押金的支付與返還租賃合同通常約定承租人支付相當(dāng)于數(shù)月租金的押金給出租人,主要用于1)擔(dān)保租金的支付,防止欠租;2)對房屋的合理使用,防止對房屋及其附屬設(shè)備的損害;3)防止拖欠水電費(fèi)等相關(guān)費(fèi)用。對出租人而言,一定要收到押金后再交付出租房屋;交房后再收押金就難了。在退租時,租賃雙方應(yīng)檢查房屋狀況,除房屋和設(shè)備的正常損耗外,如不存在損壞,進(jìn)行費(fèi)用結(jié)算后,出租人應(yīng)將押金退還承租人。違約金房屋租賃合同中可以針對不同情形分別約定違約金。遲延支付租金的違約金。擅自改變用途的違約金。提前解除合同的違約金。房屋及附屬設(shè)施的維修責(zé)任通常由出租人承擔(dān)房屋和附屬設(shè)施的維修費(fèi)用;對于一些微小的維修,雙方也可以在合同中另行約定,但一定要明確范圍,最好能列一個清單,避免含糊不清將來發(fā)生糾紛。房屋附屬設(shè)備、水電氣等相關(guān)手續(xù)租賃合同應(yīng)當(dāng)對房屋附屬設(shè)施的情況作出明確的約定;對房屋使用相關(guān)的水、電、天然氣、暖氣、絡(luò)、電話、有線電視等使用和繳費(fèi)應(yīng)作出約定。對房屋的鑰匙交接、物業(yè)交接等做出約定,并按照約定進(jìn)行交接、作出記錄。第四篇:房屋租賃合同英文一、出租人:(“甲方”)landlord:(part
