【正文】 本協(xié)議的過(guò)程中，甲乙雙方造成第三人損害，或者第三人造成甲方或乙方損害的，應(yīng)當(dāng)依照有關(guān)法律的規(guī)定承擔(dān) 相應(yīng)的責(zé)任。2. Where Party A or Party B causes any damage or loss to a third party due to performance of this Agreement, or where a third party causes any damage or loss to Party A or Party B, the party concerned shall bear corresponding liability in accordance with provisions of relevant laws.甲方或者乙方因執(zhí)行船舶污染事故應(yīng)急指揮機(jī)構(gòu)或者海事管理機(jī)構(gòu)的指令或要求而未能履行或未能完全履行本協(xié)議約 定的義務(wù)的，可免除其承擔(dān)違約責(zé)任，但是，對(duì)于乙方根據(jù)本協(xié) 議已經(jīng)履行的污染控制和清除行動(dòng)的部分，甲方應(yīng)當(dāng)根據(jù)第三條 的約定支付污染控制和清除費(fèi)用。3. Where Party A or Party B fails to perform or pletely perform the obligations under this Agreement due to executing the orders or requirements of Ship Pollution Accident Emergency Commanding Organ or MSA, such party may be exempted from undertaking the liability for breach of contract. However, Party A shall, in accordance with the stipulation of Article 3 of this Agreement, pay Party B the expenses incurred in pollution control and cleanup actions that Party B has actually conducted in accordance with this Agreement.第八條 適用法律及管轄Article 8 Applicable Law and Jurisdiction本協(xié)議及其項(xiàng)下?tīng)?zhēng)議適用中華人民共和國(guó)法律。1.
