【正文】 ed inspection and verification shall be worked out and published for implementation separately. 第二十四條紡織品臨時(shí)出口許可證不得轉(zhuǎn)讓、買(mǎi)賣(mài)、偽造和變?cè)臁７厕D(zhuǎn)讓、買(mǎi)賣(mài)或偽造、變?cè)斐隹谠S可批準(zhǔn)文件或出口許可證的，依照《中華人民共和國(guó)外貿(mào)法》、《中華人民共和國(guó)海關(guān)法》、《中華人民共和國(guó)貨物進(jìn)出口管理?xiàng)l例》及《貨物出口許可證管理辦法》相關(guān)規(guī)定處罰。商務(wù)部可以同時(shí)取消其已獲得的紡織品臨時(shí)出口許可數(shù)量。 Article 24. Temporary export licenses for textiles shall not be transferred, sold or bought, forged or altered. Parties involved in the transfer, selling or buying, or forging of export license documents or export licenses shall be subject to punishments in line with related provisions of the Foreign Trade Law of the People39。s Republic of China, Customs Law of the People39。s Republic of China, Regulations of the People39。s Republic of China on the Administration of Import and Export Commodities and Measures Governing Goods Subject to Export Licenses. The MOFCOM may also revoke the quantity of temporary export licenses of textiles obtained by the violators at the same time. 第二十五條出口樣品的，對(duì)于每批商品數(shù)量不超過(guò)50件（含50件、套、雙、公斤或其它商品單位，不包括打、打雙、打套、噸數(shù)量單位）的，可免領(lǐng)出口許可證； Article 25. For modities subject to temporary export licenses, if these are already subject to automatic export license of textiles before the implementation of this set of rules, the Automatic License for Exportation of Textiles obtained by operators shall not be used as a certificate on which the customs would give customs clearance, starting from the day of the implementation of the temporary export licenses. 第二十八條對(duì)于將原產(chǎn)于中國(guó)的商品避開(kāi)本辦法的規(guī)定，經(jīng)第三國(guó)或者地區(qū)轉(zhuǎn)口至《管理商品目錄》規(guī)定的國(guó)家或者地區(qū)的經(jīng)營(yíng)者，一經(jīng)查實(shí)，商務(wù)部將予以公告，自相關(guān)行政處罰決定生效之日起1年內(nèi)禁止從事所有與臨時(shí)出口許可管理產(chǎn)品相關(guān)的出口經(jīng)營(yíng)活動(dòng)。 Article 28. For acts whereby operators export products that are originated from China listed in the Catalogue of Commodities subject to Licenses via a third country or region to countries or regions to avoid the provisions of this set of rules the MOFCOM shall publish the names of the violators upon verification and shall ban the violators from engaging in any exportation activities related to goods that are subject to temporary export licenses for a year starting from the day when the related administrative sanction enters into force. 第二十九條除另有規(guī)定外，對(duì)許可證的簽發(fā)、執(zhí)法部門(mén)的調(diào)查、發(fā)證機(jī)構(gòu)的核查，以及對(duì)違反本辦法有關(guān)規(guī)定的發(fā)證機(jī)構(gòu)和轉(zhuǎn)讓、買(mǎi)賣(mài)或偽造、變?cè)煸S可證的經(jīng)營(yíng)者的處罰，按照《貨物出口許可證管理辦法》的有關(guān)規(guī)定辦理。 Article 29. The related provisions of the Measures Governing Licenses for Commodities39。 Export shall be referred to in the case of issuance of licenses, investigations launched by law enforcement bodies, inspection by the license issuing bodies, and the imposition of punishments to license issuing bodies in violation of the provisions of this set of measures and operators that transfer, sell or buy, forge or alter a license, unless otherwise specified. 第三十條通過(guò)外發(fā)加工方式（OPA）在內(nèi)地加工且原產(chǎn)地非中國(guó)內(nèi)地的紡織品不適用本辦法。 Article 30. This set of measures shall not be applicable to textiles that are processed by way of OPA in Mainland China and whose place of origin is not identified as Mainland China. 第三十一條本辦法由商務(wù)部負(fù)責(zé)解釋。 Article 31. MOFCOM shall be entitled to the interpretation right of this set of measures. 第三十二條本辦法自2005年7月20日起施行。 Article 32. This set of measures shall enter into force as of July 20, 2005.9 / 9
