【正文】 eextremelyunqualifiedortherearegreathazardsofepidemicspread。(5)anyofthecircumstancesthatwilltriggerawarningofgradeBoccursagainwhentheforeignsupplierisstillbeingsubjecttoawarningofgradeB。(6)refusingtocooperateinreturningashipment。(7)transportingtheunqualifiedWastesourcedRawMaterialswhichhavealreadybeenreturnedtotheMainlandofChinaagain。or(8)refusingtoacceptsupervisionandadministrationorbeingdiscoveredtofailtosatisfytheprovisionsofArticle8ofthe“MeasuresforSupervisionandAdministrationoverInspectionandQuarantineoftheImportedSolidWastesthatCanbeUsedasRawMaterials”(OrderNo.119oftheSAQSIQ)uponsubsequentonthespotsupervisionandinspection.第二十四條已取得注冊登記資格的國外供貨商發(fā)生下列情況之一的,由國家質(zhì)檢總局發(fā)布A類預(yù)警,撤銷其注冊登記資格:(一)提供虛假入境證明文件的。(二)將注冊登記證書或注冊登記編號(hào)轉(zhuǎn)讓其他企業(yè)使用的。(三)輸出廢物原料時(shí)存在弄虛作假等欺詐行為。(四)輸出廢物原料環(huán)保項(xiàng)目嚴(yán)重不合格或存在嚴(yán)重疫情風(fēng)險(xiǎn)的。(五)B類預(yù)警期間,再次發(fā)生觸發(fā)B類預(yù)警情形之一的。(六)不配合退運(yùn)的。(七)對(duì)已退運(yùn)的不合格廢物原料再次運(yùn)抵中國大陸地區(qū)的。(八)不接受監(jiān)督管理或后續(xù)現(xiàn)場監(jiān)督檢查發(fā)現(xiàn)不符合《進(jìn)口可用作原料的固體廢物檢驗(yàn)檢疫監(jiān)督管理辦法》(國家質(zhì)檢總局令第119號(hào))第八條規(guī)定的。Article25 TheSAQSIQshallissueawarningofgradeBthereto,andtheinspectionandquarantineinstitutionshallcarryoutaonehundredpercentinspectionof90daysontheWastesourcedRawMaterialsexportedbythesupplier,ifaforeignsupplierwhichhasacquiredtheregistrationqualificationfallswithinanyofthefollowingcircumstances:(1)thereareaggregatelymorethan3batches(inclusive)ofexportedWastesourcedRawMaterialswherethegoodsfailtomatchcertificatesortheenvironmentalprotectionprojectsareunqualifiedwithin1year。(2)failingtopassthequarantineandtherearerelativelygreathazardsofepidemicsituation。(3)beingreregisteredafterdisqualificationaccordingtotheprovisionsofArticle24oftheseRules。or(4)anydefectofthequalitycontrolsystemisdiscoveredupononthespotinspection.第二十五條已取得注冊登記資格的國外供貨商發(fā)生下列情況之一的,國家質(zhì)檢總局發(fā)布B類預(yù)警,檢驗(yàn)檢疫機(jī)構(gòu)對(duì)其輸出的廢物原料實(shí)施為期90日的全數(shù)檢驗(yàn):(一)一年內(nèi)貨證不符或者環(huán)保項(xiàng)目不合格累計(jì)3批以上(含3批)的。(二)檢疫不合格并具有較大疫情風(fēng)險(xiǎn)的。(三)依據(jù)本細(xì)則第二十四條的規(guī)定被撤銷后重新獲得注冊登記的。(四)現(xiàn)場檢查發(fā)現(xiàn)質(zhì)量控制體系存在缺陷的。Article26 Ifaforeignsupplierconcealsrelevantsituationorprovidesfalsematerialsinthecourseofapplyingforregistration,theSAQSIQshallrejecttheapplicationorshallnotregisterthesupplier.Theforeignsuppliershallnotreapplyfortheregistrationwithin1year.Ifaforeignsupplierisregisteredbyimpropermeanssuchasdeceptionorbribery,theSAQSIQshallpunishitaccordingtolaw.Theforeignsuppliershallnotreapplyfortheregistrationwithin3years.ChapterVSupplementaryProvisions第二十六條國外供貨商隱瞞有關(guān)情況或者提供虛假材料申請注冊登記的，國家質(zhì)檢總局不予受理或者不予注冊登記。該國外供貨商一年內(nèi)不得再次申請?jiān)撟缘怯洝夤┴浬桃云垓_、賄賂等不正當(dāng)手段取得注冊登記的，國家質(zhì)檢總局應(yīng)當(dāng)依法給予處罰。該國外供貨商三年內(nèi)不得再次申請注冊登記。第五章附則Article27 ForthepurposeoftheseRules,thefollowingexpressionsshallhavethemeaningshereunderassignedtothem:Theexpression“ImportedSolidWastesthatCanbeUsedasRawMaterials”shallmeanthesolidwasteswhichareincludedintothe“CatalogueofSolidWastesthatCanbeUsedasRawMaterialsWhichareRestrictedfromImport”andthe“CatalogueofSolidWastesthatCanbeUsedasRawMaterialsWhichareAllowedtoImportAutomatically”andareimportedasrawmaterialsuponapprovalofthepetentdepartmentofenvironmentalprotectionofState,“ImportedWastesourcedRawMaterials”forshort.Theexpression“OnehundredpercentInspection”shallmeanthemethodofcarryingoutanunstuffingorunloadinginspectionovereachcontainerorautomobilecarryingWastesourcedRawMaterialsorovereachcarriageofatraincarryingWastesourcedRawMaterials,andcarryingoutanunloadinginspectionovereachholdcarryingWastesourcedRawMaterialsinbulk.第二十七條本細(xì)則下列用語的含義:進(jìn)口可用作原料的固體廢物,是指列入《限制進(jìn)口類可用作原料的固體廢物目錄》和《自動(dòng)許可進(jìn)口類可用作原料的固體廢物目錄》、經(jīng)國家環(huán)境保護(hù)主管部門批準(zhǔn)進(jìn)口的用作原料的固體廢物,簡稱進(jìn)口廢物原料。全數(shù)檢驗(yàn)指對(duì)以集裝箱、汽車或列車裝運(yùn)的廢物原料每箱、車、車皮均實(shí)施掏箱或落地檢驗(yàn),散運(yùn)的廢物原料每艙均實(shí)施落地檢驗(yàn)。Article28 Theproceduresforentertaining,evaluationandapprovaloftheapplicationforchangingorextendingaregistrationshallbeimplementedwithreferencetotheproceduresofChapterII.第二十八條變更和延續(xù)注冊登記申請的受理、評(píng)審和批準(zhǔn)程序比照第二章的程序?qū)嵤?。Article29 TheregistrationofsuppliersofWastesourcedRawMaterialsfromHongKong,MacaoandTaiwanRegionshallbesubjecttotheseRules.第二十九條香港、澳門和臺(tái)灣地區(qū)的廢物原料供貨商注冊登記依照本細(xì)則執(zhí)行。Article30 Ifitisnotpointedoutspecifically,theexpression“days”asreferredtointheseRulesshallmeancalendardays.第三十條如無特指,本細(xì)則中所稱“日”均為自然日。Article31 TheseRulesshallbeinterpretedbytheSAQSIQ.第三十一條本細(xì)則由國家質(zhì)檢總局負(fù)責(zé)解釋。Article32 TheseRulesshallbeeffectiveasofNovember1,2009.第三十二條本細(xì)則自2009年11月1日起施行。
