【正文】 則（ A credit is irrevocable even if there is no indication to that effect.）均明確信用證是 不可撤銷 的。 國際商會的明確立場：強化信用證不可撤銷的屬性，以加強對受益人的保護，從而維護信用證作為支付工具的功能。 (UCP500第 6條可撤銷與不可撤銷信用證被刪除 ) ? 由于 UCP的慣例地位，如果當事人愿意使用可撤銷信用證，則應該在信用證中對此做出明確規(guī)定。 ?Case8： 中國某公司 A從德國 B公司進口一批機器，合同規(guī)定以不可撤銷即期信用證支付。合同簽訂后，中國銀行廣西分行（開證行）根據買方指示向賣方開立一份未注明是否可撤銷的信用證。貨物裝運完畢后，賣方獲得全套合格單據并辦理議付。此時載貨船只在航行途中遭受意外，貨物損失嚴重。開證行收到議付行寄來的全套單據，我方得知貨物受損消息，因而要求開證行對此信用證項下的單據拒付，但遭到開證行拒絕。請問，開證行做法是否合理？為什么？ 即期信用證 （ sight L/C） 遠期信用證 （ usance L/C, time L/C ） ,可分為 : 延期付款信用證 (Deferred Payment L/C) （銀行）承兌信用證 (Acceptance L/C） 真遠期信用證 ,賣方遠期信用證 (Seller’s Usance L/C) 假遠期信用證 ,買方遠期信用證 (Buyer’s Usance L/C) 議付信用證 （ negotiation L/C） 公開議付信用證 即期議付信用證 限制議付信用證 遠期議付信用證 延期付款信用證 又稱 遲期付款信用證 或 無承兌遠期信用證 特點： 受益人無須開具匯票，無須承兌，不能貼現(xiàn)。僅憑符合信用證要求的單據，至付款到期日付款的信用證。確定付款日期的方法有： ? 交單后若干天 ? 裝運日后若干天 ? 固定將來日期。 用途： 多用于金額較大，付款期較長的資本貨物的交易，常與政府出口信貸相結合。 ?合同規(guī)定即期付款； ?信用證規(guī)定，受益人開具遠期匯票，但指定的銀行負責對遠期匯票承兌和貼現(xiàn)，一切利息和貼現(xiàn)的費用由進口人承擔。 ?The usance draft are payable on a sight basis, all interests and discount charges are for applicant’s(buyer’s) account. 假遠期信用證 ?對出口人 ①表面上 遠期收款 (開遠期匯票 )； ②實際上 即期收款 (指定的銀行負責貼現(xiàn)，有關的費用由進口人承擔 )； ③如見票后 90天匯票，貼現(xiàn)時， 90天的利息和貼現(xiàn)費用由進口人支付 . ?對進口人 ①仍是遠期付款； ②承擔貼現(xiàn)的利息和費用 . ?假遠期信用證實際上是套用了付款行的資金 . 可轉讓信用證 (transferable L/C) 不可轉讓信用證 (untransferable L/C) 循環(huán)信用證 (revolving L/C),可分為 自動循環(huán) (automatic revolving) 半自動循環(huán) (semi automatic revolving) 非自動循環(huán) (non automatic revolving) 受益人在一定時間內利用規(guī)定金額后能夠重新恢復信用證原金額并再度使用，周而復始，直到達到該證規(guī)定次數或累計總金額用完為止的信用證。 受益人在規(guī)定時期內裝運貨物議付后，毋需等開證行通知即可自動恢復到原金額再度使用的循環(huán)信用證。 受益人在規(guī)定時期內裝運貨物議付后，在若干天內開證行未提出不能恢復原金額的通知，即可自動恢復到原金額再度使用的循環(huán)信用證。 受益人在規(guī)定時期內裝運貨物議付后，須開證行通知，才可恢復到原金額再度使用的循環(huán)信用證。 ?背對背信用證 (BacktoBack Credit) ?對開信用證 (Reciprocal Credit) ?預支信用證 (Anticipatory L/C) ?備用信用證 (Standby Letter of Credit) 支付條款 ? “ The Buyers shall open with a bank to be accepted by both the Buyers and Sellers an irrevocable transferable letter of credit, allowing partial shipment, transshipment in favor of the Sellers and addressed to Sellers payable at sight against first presentation of the shipping document to Opening Bank. The covering letter of credit must reach the Sellers 30 days before shipment and remain valid in China until the 21st days (inclusive) from the date of shipment.” ?“ The Buyers shall duly accept the documentary draft drawn by the Sellers at 30 days sight upon first presentation and make payment on it’s maturity. The shipping documents are to be delivered against payment only” ?“ 50％ of the total contract value as advance payment shall be remitted by the Buyer to the Seller through T/T within 15 days after signing this contract. Payment to be effected by the Buyer shall not be later than 7 days after receipt of the documents listed in the contract by T/T.”
