【正文】 數(shù)據(jù)、計算軟件和專利技術(shù)。未經(jīng)設(shè)計人同意，發(fā)包人對設(shè)計人交付的設(shè)計資料及文件不得擅自修改、復(fù)印或向第三人轉(zhuǎn)讓或用本合同外的項目，如發(fā)生以上情況，發(fā)包人應(yīng)負(fù)法律責(zé)任，設(shè)計人有權(quán)向發(fā)包人提出索賠。： 設(shè)計人應(yīng)按國家技術(shù)規(guī)范、標(biāo)準(zhǔn)、規(guī)程及發(fā)包人提出的設(shè)計要求，進行工程設(shè)計，按合同規(guī)定的進度要求提交質(zhì)量合格的設(shè)計資料，并對其負(fù)責(zé)。 設(shè)計人采用的主要技術(shù)標(biāo)準(zhǔn)是：與設(shè)計人承擔(dān)的設(shè)計范圍、內(nèi)容相關(guān)的國家技術(shù)標(biāo)準(zhǔn)與規(guī)范。 設(shè)計合理使用年限為年。 設(shè)計人按本合同和二條和第四條規(guī)定的內(nèi)容、進度及份數(shù)向發(fā)包人交付資料及文件。 設(shè)計人交付設(shè)計資料及文件后，按規(guī)定參加有關(guān)的設(shè)計審查，并根據(jù)審查結(jié)論負(fù)責(zé)對不超出原定范圍的內(nèi)容做必要調(diào)整補充。設(shè)計人按合同規(guī)定時限交付設(shè)計資料及文件，本所內(nèi)項目開始施工，負(fù)責(zé)向發(fā)包人及施工單位進行設(shè)計交底、處理有關(guān)設(shè)計問題和參加竣工驗收。在一年內(nèi)項目尚未開始施工，設(shè)計人仍負(fù)責(zé)上述工作，但應(yīng)按所需工作量向發(fā)包人適當(dāng)收取咨詢服務(wù)費，收費額由雙方商定。 設(shè)計人應(yīng)保護發(fā)包人的知識產(chǎn)權(quán)，不得向第三人泄露、轉(zhuǎn)讓發(fā)包人提交的產(chǎn)品圖紙等技術(shù)經(jīng)濟資料。如發(fā)生以上情況并給發(fā)包人造成經(jīng)濟損失，發(fā)包人有權(quán)向設(shè)計人索賠。 設(shè)計人應(yīng)負(fù)責(zé)裝飾報建圖的蓋章(有政府相關(guān)部門認(rèn)可的設(shè)計資質(zhì))。第七條 違約責(zé)任： 在合同履行期間，發(fā)包人終止或解除合同，設(shè)計人未開始設(shè)計工作的，不退還發(fā)包人已付的定金。已開始設(shè)計工作的，發(fā)包人應(yīng)根據(jù)設(shè)計人已進行的實際工作量，不足一半時，按該階段設(shè)計費的一半支付超過一半時，按該階段設(shè)計費的全部支付。，每逾期支付一天，應(yīng)承擔(dān)支付金額千分之二的逾期違約金。每逾支付一天，逾期超過15天以上時，設(shè)計人有權(quán)暫停履行下階段工作，并書面通知發(fā)包人。發(fā)包人的上級或設(shè)計審批部門對設(shè)計文件不審批或本合同項目停緩建。由于設(shè)計人員錯誤造成工程質(zhì)量事故損失，設(shè)計人除負(fù)責(zé)采取補救措施外，應(yīng)免收直接受損失部份的設(shè)計費。損失嚴(yán)重的根據(jù)損失的程度和設(shè)計人責(zé)任大小向發(fā)包人支付賠償金，%。，延誤了按本合同第四條規(guī)定的設(shè)計資料及設(shè)計文件的交付時間，每延誤一天，應(yīng)減收該項目應(yīng)收設(shè)計費的千分之二。 合同生效后，設(shè)計人要求終止或解除合同，設(shè)計人應(yīng)雙倍返還定金。第八條 其它，在合同的施工期內(nèi)(裝修施工開始后240天內(nèi))，設(shè)計人應(yīng)派出項目設(shè)計師，按照平均每周1~2次的標(biāo)準(zhǔn)，赴施工現(xiàn)場提供設(shè)計跟進服務(wù)。服務(wù)內(nèi)容為：施工前的技術(shù)交底與圖紙會審，施工中的材料色樣確認(rèn)，設(shè)計效果的監(jiān)控、施工圖的修正、完善與補充，參加每周工程例會，就施工中存在的問題主動提出意見和解決方法，并以紀(jì)要形式通知有關(guān)各方，以及參加竣工驗收(以上服務(wù)與施工監(jiān)理責(zé)任無關(guān))，當(dāng)驗收完成后設(shè)計人出具竣工圖紙。如乙方未能及時履行上述責(zé)任而導(dǎo)致工期延誤或出現(xiàn)質(zhì)量問題，甲方有權(quán)追究乙方責(zé)任。如發(fā)包人要求設(shè)計人派專人留駐施工現(xiàn)場進行配合與解決有關(guān)問題時，雙方應(yīng)另行簽訂補充協(xié)議或技術(shù)咨詢服務(wù)合同。
