【文章內(nèi)容簡介】 shall within 72 hours after the shipment of the goods, advise the shipping department of buyer by fax of Contract No., goods name, quantity, value, number of packages, gross weight, measurements and the estimated arrival time of the goods at the destination. :賣方保證合同產(chǎn)品使用最好的材料,由頭等有經(jīng)驗人員制成,并且是 全 新、未經(jīng)使用過,此外,在各方面均符合合同中所規(guī)定的質(zhì)量標準及規(guī)格 , 保證期應是 自雙方簽署驗收報告之日起12 個月 。 在保證期內(nèi),產(chǎn)品的質(zhì)量出現(xiàn)問題,由賣方無償修理或更換 ,各種費用由賣方負擔(維修費、備件費、國際運保費、進出 關(guān)服務費、檢驗費等);超過保修期的,賣方只收取維修成本,并不承擔貨物維修后返回買方的運保費。 經(jīng)買方通知 2 個工作 日內(nèi)賣方應 通過電話、郵件對事故進行處理,確需現(xiàn)場解決的需 14日內(nèi)到達現(xiàn)場核實并處理。 若賣方 在規(guī)定時間內(nèi) 不來處理,每天需向買方支付本合同款千分之五違約金。在保證期內(nèi)產(chǎn)品經(jīng)賣方處理仍達不到本合同約定的質(zhì)量標準,買方有權(quán)解除本合同,賣方應退還已收貨款,并支 4 付本合同總貨款 30%的的違約金。 GUARANTEE OF QUALITY: The Sellers guarantee that the modity hereof is made of the best materials with first class workmanship, new and unused, and plies in all respects with the quality and specification stipulated in this Contract. The guarantee period shall be 12 months counting from the date of the final acceptance of the goods. During warranty period, if the products find a problems and need to replace the parts or return to the manufacturer, the replacement cost, transportation cost, inspection and custom cost ,all must be borne by the Seller. When the buyer meet a problems with the system, the Seller must give a respond within 2 working daysby telp call or to solve the problems,if the problems can’t be solved by em or , the Seller must send an engineer to the user’s workshop to solve the problems within 14 days. If the Seller can’t solve the problems within the time, the Selelr must pay % penalty to the Buyer. If during warranty period, the Seller still can’t solve the problems as per products quality, the Buyer has the right to terminate the contract and return the goods to the Seller. The Seller must refund the money of the contract value and must pay 30% of the contract value for penalty. :產(chǎn)品到達目的地后 90 天內(nèi),如發(fā)現(xiàn)質(zhì)量、規(guī)格及數(shù)量不符合合同規(guī)定,除保險公司或船主承擔責任外,買方有權(quán)依據(jù)中國商品檢驗局所開具的檢驗證書,要求更換新品或賠償損失 ;其它所有費用(包 括 但不限于 例如檢驗費、產(chǎn)品運返費、更換品運費、保險費、存儲及裝船卸船費等)應由賣方負責。對于質(zhì)量問題,賣方應保證產(chǎn)品到達目的地之日起 12 個月內(nèi),如由于質(zhì)量低劣、制造技術(shù)不良或使用劣等材料而致使應用過程中發(fā)生損壞,則買方可立即 以書面形式通知賣方并依據(jù)中國商品檢驗局所開具的檢驗證書要求賠償 ,并有權(quán)退貨 ,賣方應退還已收貨款,并支付總貨款 30%的違約金。 應以按上述方式得到的證書作為索賠的依據(jù)。賣方應根據(jù)買方的要求立即采取消除缺陷的措施,全部或部分更換產(chǎn)品或按故障情況對產(chǎn)品作降價處理,必要時買方可自己決定自行排除故 障,但所需費用應由賣方承擔,如賣方在收到上述索賠要求后 兩周 內(nèi) 不向買方答復,則可認為該索賠要求已被賣方所接受。 CLAIMS: Within 90 days after the arrival of the goods at destination, should the quality, specification, or quantity be found not in conformity with the stipulations of the Contract except those claims for which the insurance pany or the owners of the vessel are liable, the Buyers, on the strength of the Inspection Certificate issued by the China Commodity Inspection Bureau, have the right to claim for replacement with new goods, or for pensation, and all the expenses(such as inspection charges, freight for returning the goods and for sending the replacement, insurance premium, storage and loading and unloading charges etc.) shall be borne by the Sellers. As regards quality, the Sellers guarantee that if, within 12 months from the date of arrival of the goods at destination, damages occur in the course of operation by reason of inferior quality, bad workmanship or the use of inferior materials the Buyers shall immediately notify the Sellers in writing and put forward a claim supported by Inspection Certificate issued by the China Commodity Inspection Bur
