有權(quán)終止本合同,收回出租房屋,并且保證金不予退還。如乙方于本合同下的權(quán)益受此等所有權(quán)人或第三者所影響或損害,甲方須負(fù)責(zé)補(bǔ)償乙方的所有損失、損害、支出及費(fèi)用。 Party A may deduct a negotiated amount of security deposit towards Payments of any actual damages Party A shall have incurred or suffered as a result of Party B’s breach of this Agreement. In case the security deposit is not sufficient to cover such amounts, Party B must pay the deficient within 10 days of the receipt of a demand from Party A. 五 、 甲方的義務(wù) Obligations of Party A: 1. 甲方 須按時(shí)將出租房屋以良好狀態(tài)交付乙方使用。 On expiry of the tenancy, Party A has the right to take back the entire leased property and Party B shall deliver the leased property to Party A. Party B shall apply for extension in writing to Party A one months before the expiration if Party B intends to continue the lease, the new lease contract shall be signed after getting Party A’s approval. 三 、租金 Rental: 1. 雙方議定租金為每月 人民幣 元整 (¥ ) 包括 房屋的物業(yè)管理費(fèi) , 包括(不包括 )發(fā)票費(fèi)用。 In accordance with relevant Chinese laws, decrees and pertinent rules and regulations, Party A and Party B have reached an agreement through friendly consultation to conclude the following contract. 一、物業(yè) Property: 甲方同意將其所有的位于 上海市 _ 房屋及其設(shè)施在良好及可租賃的狀態(tài)下租給乙方居住使用 , 產(chǎn)權(quán)證號(hào)為: , 出租房的建筑面積總計(jì) 平方米。 Payment of rental will be one installment every month(s). The first installment will be paid before (month) (day) (year). Each successive installment will be paid before the day each paying month. Party B will pay the rental before using the property and attached facilities (In case Party B pays the 2 rental in the form of remittance, the date of remitting will be the day of payment and the remittance fee will be borne by the remitter.) Party A will issue a written receipt after receiving the payment. 3. 如乙方逾期支付租金超過十天,則每天以月租金的 %支付滯納金;如乙方逾期支付租金超過十五天,則視為乙方自動(dòng)退租,構(gòu)成違約,甲方有權(quán)收回房屋,并追究乙方違約責(zé)任。 Provided Party B paying the rent and performing and observing Party B’s terms and conditions herein contain shall peaceably hold and enjoy the leased property throughout the term of this Agreement without any interruption by Party A or any other person save and except as required by the law of the People’s Republic of China. 3 4. 房屋基本設(shè)施和結(jié)構(gòu)(不包括乙方損壞的家私和器具)損壞時(shí),甲方有修繕的責(zé)任并承擔(dān)有關(guān)的費(fèi)用,并對(duì)其作定期修保。租賃期滿后恢復(fù)原狀或可正常出租狀態(tài)(正常損耗除外),并承擔(dān)其費(fèi)用,經(jīng)甲方驗(yàn)收認(rèn)可后歸還甲方。 The formation of this Agreement, its validity, interpretation, execution and settlement of any disputes arising hereunder shall be governed by and construed in accordance with the laws of the People’s Republic of China. 5 十、爭(zhēng)議的解決 Dispute Resolution: 凡因執(zhí)行合同所產(chǎn)生的或與本合同有關(guān)的一切爭(zhēng)議,雙方應(yīng)通過友好協(xié)商解決;協(xié)商不成,應(yīng)提交上海仲裁委員會(huì),按其仲裁規(guī)則和中華人民共和國(guó)仲裁法在上海進(jìn) 行仲裁, 仲裁裁決是終局的,對(duì)雙方都有約束力
