【正文】 正當(dāng)手段取得董事（理事）、高級(jí)管理人員任職資格的；（四）依法應(yīng)當(dāng)撤銷任職資格核準(zhǔn)決定的其他情形。擬任職所在地銀監(jiān)會(huì)派出機(jī)構(gòu)應(yīng)向原任職所在地銀監(jiān)會(huì)派出機(jī)構(gòu)征求監(jiān)管評(píng)價(jià)意見。第十九條金融機(jī)構(gòu)董事長（理事長）、副董事長（副理事長）的離任審計(jì)報(bào)告應(yīng)至少包括對以下情況及其所負(fù)責(zé)任（包括領(lǐng)導(dǎo)責(zé)任和直接責(zé)任）的評(píng)估結(jié)論：（一）貫徹執(zhí)行國家法律法規(guī)、各項(xiàng)規(guī)章制度的情況。第十三條 金融機(jī)構(gòu)擬任、現(xiàn)任董事（理事）和高級(jí)管理人員的任職資格基本條件包括：（一）具有完全民事行為能力；（二）具有良好的守法合規(guī)記錄；（三）具有良好的品行、聲譽(yù)；（四）具有擔(dān)任金融機(jī)構(gòu)董事（理事）、高級(jí)管理人員職務(wù)所需的相關(guān)知識(shí)、經(jīng)驗(yàn)及能力；（五）具有良好的經(jīng)濟(jì)、金融從業(yè)記錄；（六）個(gè)人及家庭財(cái)務(wù)穩(wěn)?。唬ㄆ撸┚哂袚?dān)任金融機(jī)構(gòu)董事（理事）、高級(jí)管理人員職務(wù)所需的獨(dú)立性；（八）能夠履行對金融機(jī)構(gòu)的忠實(shí)與勤勉義務(wù)。第三條
