【正文】 而言是一把雙刃劍，從短期看是弊大于利，從長期看是利大于弊。 雖然在短期內(nèi)對(duì)企業(yè)出口帶來壓力，但 通過這些措施的實(shí)施，無疑會(huì)使國 內(nèi)企業(yè) 在進(jìn)行對(duì)外貿(mào)易時(shí)加強(qiáng) “ 綠色 ” 概念，注重對(duì)生態(tài)環(huán)境的保護(hù)，最終實(shí)現(xiàn)我國 經(jīng)濟(jì) 建設(shè) 的可持續(xù)發(fā)展。特別是嚴(yán)格的技術(shù)標(biāo)準(zhǔn)，細(xì)化的技術(shù)要求，再加上持續(xù)不斷的升級(jí)，會(huì)對(duì)出口國貿(mào)易產(chǎn)品順利通關(guān)形成強(qiáng)烈的壓力，從而迫使其既要不斷研制新品，又要對(duì)原有產(chǎn)品的生產(chǎn)流程、工藝和方法進(jìn)行革新，實(shí)現(xiàn)產(chǎn)品的更新?lián)Q代，并通過產(chǎn)品結(jié)構(gòu)的調(diào)整帶動(dòng)和實(shí)現(xiàn)產(chǎn)業(yè)結(jié)構(gòu)的調(diào)整和優(yōu)化。通過實(shí)施技術(shù)性貿(mào)易措施，起到 限制國外達(dá)不到國內(nèi)相關(guān)標(biāo)準(zhǔn)的有關(guān)商品進(jìn)入國內(nèi)市場(chǎng)的作用，從而規(guī)范我國進(jìn)出口市場(chǎng)，保護(hù)消費(fèi)者的合法權(quán)益。 而 根據(jù)美國商務(wù)部 1998 年的報(bào)告和歐盟的研究，僅受技術(shù)法規(guī)影響的出口產(chǎn)品就占世界出口總額的 25%，全世界出口因此減少 15%25%，因標(biāo)準(zhǔn)和認(rèn)證減少的出口相當(dāng)于出口總 額的 %%。 在世貿(mào)組織爭(zhēng)端解決案例中，有 28 個(gè)是與技術(shù)壁壘有關(guān)的。相關(guān)調(diào)查顯示： 2021 年，中國有 71%的出口企業(yè)遭遇到國外技術(shù)性貿(mào)易壁壘不同程度的限制，有 39%的出口產(chǎn)品受到不同程度的影響，造成的損失逾 170 億美元，這相當(dāng)于去年出口總額的 %。湖南、貴州等內(nèi)陸地區(qū)接受調(diào)查的進(jìn)出口企業(yè) 100%認(rèn)為出口受到技術(shù)壁壘的影響；浙江、山東、福建等沿海地區(qū)接受調(diào)查的進(jìn)出口企業(yè)分別有 86%、 76%、 68% 6 認(rèn)為出口受到國外技術(shù)壁壘的影響。 三、我國出口產(chǎn)品屢遭技術(shù)性貿(mào)易壁壘限制的原因 有些學(xué)者認(rèn)為，近年來我國出口貿(mào)易迅速發(fā)展，一些發(fā)達(dá)國家為了保護(hù)本國市場(chǎng)和產(chǎn)業(yè)，而對(duì)我國產(chǎn)品實(shí)施技術(shù)性貿(mào)易措施，其實(shí)不然，我國產(chǎn)品屢遭國外技術(shù)性貿(mào)易措施限制的主要原因是： （一）我國出口產(chǎn)品和產(chǎn)業(yè)的相對(duì)弱質(zhì)性 近年來，盡管我國外貿(mào)出口有了長足發(fā)展，但由于總體科技發(fā)展水平相對(duì)落后，許多出口產(chǎn)品技術(shù)含量低，質(zhì)量不高，相對(duì)于國外同類產(chǎn)品的生產(chǎn)技術(shù)，產(chǎn)品質(zhì)量 與標(biāo)準(zhǔn)的不斷提高，我國出口產(chǎn)品的弱質(zhì)性就會(huì)明顯表現(xiàn)出來 。據(jù)商務(wù)部 調(diào)查顯示，歐盟、美國、日本是實(shí)施技術(shù)性貿(mào)易壁壘的主要國家和地區(qū)，其對(duì)中國出口企業(yè)造成的損失占比達(dá) 95%，所采用的主要方式有 “ 提高標(biāo)準(zhǔn) ” 、 “ 增加檢驗(yàn)檢疫項(xiàng)目 ” 和 “ 技術(shù)法規(guī)變化 ” 等，并有不斷調(diào)高和提高技術(shù)要求的趨勢(shì)。 （四）對(duì)技術(shù)貿(mào)易壁壘的重視不夠 我國宏觀管理層次上存在某些漏洞，對(duì)國際通用的國際標(biāo)準(zhǔn)和技術(shù)管理措施知之甚少，對(duì)主要貿(mào)易對(duì)象國的技術(shù)手段缺乏了解 ，不能對(duì)我國出口企業(yè)在宏觀上予以指導(dǎo) 。這 在一定程度上 反映了發(fā)達(dá)國家技術(shù)水平和環(huán)保意識(shí)的持續(xù)提高，也存在某些國家利用技術(shù)性貿(mào)易壁壘搞貿(mào)易保護(hù)主義的傾向。同時(shí)，鑒于技術(shù)壁壘，不僅涉及諸多技術(shù)問題，而且涉及行政管理問題，技術(shù)性、政策性很強(qiáng)，一般出口企業(yè)往往不甚了解，也提不出有針對(duì)性的對(duì)策，在這方面，政府應(yīng)起主導(dǎo)作 用，協(xié)助企業(yè)打破國外的技術(shù)壁壘，擴(kuò)大出口。例如，美國的國家標(biāo)準(zhǔn)技術(shù)院，向幾個(gè)主要國家派出代表，調(diào)查研究駐在國的標(biāo)準(zhǔn)化、技術(shù)法規(guī)的情況，美國還派人常駐布魯塞爾，專門收集歐洲標(biāo)準(zhǔn)化和認(rèn)證的情況；日本、澳大利亞、新西蘭等國也密切注視歐洲標(biāo)準(zhǔn)化和認(rèn)證工作的發(fā)展動(dòng)向，以便研究對(duì)策。我國應(yīng)充分利用這個(gè)窗口，了解各成員的政府、工商、經(jīng)貿(mào)團(tuán)體采取的技術(shù)壁壘的細(xì)節(jié)，為國內(nèi)企業(yè)提供服務(wù)，特別是可通過因特網(wǎng)進(jìn)行咨詢，及早得到其他成員制訂的技術(shù)法規(guī)和合格評(píng)定的信息，及早采取相應(yīng)的措施。 整頓外貿(mào)進(jìn)出口秩序 針對(duì)國內(nèi)有部分企業(yè)為一己私利，往往不顧行業(yè)整體的利益， 惡意傾銷，給出口市場(chǎng)造成極大的危害，國家應(yīng) 及時(shí)制止外貿(mào)企競(jìng)相殺價(jià)、惡性競(jìng)爭(zhēng) ，維持外貿(mào)出口的健康發(fā)展。在我國的出口商品結(jié)構(gòu)中，粗加工、低附加值的初級(jí)產(chǎn)品仍占很大比例，相當(dāng)一部分農(nóng)副產(chǎn)品及 11 工業(yè)品達(dá)不到進(jìn)口國的產(chǎn)品、環(huán)境標(biāo)準(zhǔn)。通過獲得相關(guān)國際標(biāo)準(zhǔn)的認(rèn)證，有利于促進(jìn)我國質(zhì)量管理水平向國際 水平靠攏， 取得通往國際市場(chǎng)的通行證 ，獲得良好的國際市場(chǎng)信譽(yù)。 ll wait in the line for one hour to get a ticket, and another two hours at the site, to only see a tiny bit of the place due to the crowds.
