【正文】 ar?evi ? ’s theory that legal translation is a municative act and under the guidance of the three legal exchange principles proposed by Du Jinbang, . the principle of language deferring to law, the principle of tolerance for difference and pursuit of concord, and the principle of imitation and pliment, intends to search for the methods for translating deixis in legal text from the four aspects of person deixis, place deixis, time deixis, and discourse diexis.Keyword: principles of legal exchange。 principle of imitation and pliment一、引 言隨著中外法律交流日益發(fā)展，中國(guó)法律翻譯者的任務(wù)也越來(lái)越艱巨。指示語(yǔ)是用來(lái)連接話語(yǔ)和語(yǔ)境的。譯者要從目的語(yǔ)讀者的指示角度重建原信息同時(shí)避免源語(yǔ)的語(yǔ)言模式的影響。（ 2 ）求同存異原則；譯者在翻譯過(guò)程中應(yīng)盡量采取目的法體系中的原有術(shù)語(yǔ)或概念，對(duì)于不可避免的差異可以保留。二、人稱(chēng)指示語(yǔ)人稱(chēng)指示語(yǔ)，即話語(yǔ)傳達(dá)信息的指代稱(chēng)呼，主要指言語(yǔ)行為的參與者，包括說(shuō)話人，聽(tīng)話人，除說(shuō)話人聽(tīng)話人之外話語(yǔ)所涉及到的其他人。在法律漢語(yǔ)中“它”“它的”等人稱(chēng)指示語(yǔ)的使用非常普遍，我們?cè)诜g過(guò)程中可以使用和法律漢語(yǔ)具有同等效果的“ it ”“ its ”等物主代詞。3 ． a. 凡涉及我國(guó)人類(lèi)遺傳資源國(guó)際合作項(xiàng)目的，須有中方合作單位辦理報(bào)批手續(xù)，中央所屬單位按隸屬關(guān)系報(bào)國(guó)務(wù)院有關(guān)部門(mén)，地方所屬單位無(wú)上級(jí)主管部門(mén)或隸屬關(guān)系的單位報(bào)該單位所在地的地方主管部門(mén)，審查同意后，向中國(guó)人類(lèi)遺傳資源管理辦公室提出申請(qǐng)，經(jīng)審查批準(zhǔn)后方可正式簽約：b. Where human genetic resources in our country are involved in any international collaborative project, the Chinese collaborative party shall go through the formalities of reporting for approval. Central subordinated units shallreport thereonto the relevant department of the State Council according to the relationship of administrative subordination and local subordinate units or units without a specific supervisory department or without subordination shallreport thereonto the local administrative departments of the places where the units are located, and with their consent after examination, may apply to the Office of Human Genetic Resources Management of China for examination and verification, and upon approval may enter into official agreement.（《 國(guó)務(wù)院辦公廳轉(zhuǎn)發(fā)科學(xué)技術(shù)部、衛(wèi)生部〈人類(lèi)遺傳管理暫行辦法〉的通知》第一章第一條）在 (3a) 中“報(bào)”所指的對(duì)象很含糊，不便明確指出，而“報(bào)”所對(duì)應(yīng)的英文“ report ”是及物動(dòng)詞，必須指出賓語(yǔ)，這時(shí)在前文已經(jīng)說(shuō)明情況的前提下（ Where human genetic resources in our country are involved in any international collaborative project ）可以用“ thereon ”帶過(guò)，如果用和中文相對(duì)應(yīng)的英語(yǔ)物主代詞不會(huì)引起歧義，我們完全可以用英語(yǔ)的物主代詞來(lái)表示指示關(guān)系，實(shí)際上在很多國(guó)際條約中這些物主代詞的使用也很頻繁。4 ． a.
