【正文】 第一篇：中英文船員雇傭合同樣本外聘船員合同書external crew contract甲方：（以下簡稱甲方）First party：(call A as follow乙方：（以下簡稱乙方）Second party:(call B as follow)甲乙雙方本著平等，自愿的原則，簽訂本合同，雙方同意并承諾共同遵守以下合同條款：A and B signed this contract 個(gè)月，自上船之日起計(jì)算。合同期滿，雙方未辦理合同終止或者續(xù)訂手續(xù)的，視為本合同自動(dòng)延續(xù)，任何一方都有權(quán)利通知對(duì)方終止合同。但合同屆滿時(shí)或延續(xù)期間，如船舶在國外或者航行中或者不方便離船的港口，則合同自動(dòng)延續(xù)至船舶到達(dá)可離船的港口之日為止。A appoint BasonMV:The ，病并經(jīng)醫(yī)生證明，或者由于不可抗力原因，造成乙方不能繼續(xù)在船工作的，合同自行終止。合同期內(nèi)，如發(fā)生賣船，更換船東等，甲方可以提前終止合同，乙方的遣返費(fèi)由甲方負(fù)擔(dān)。Bcan not work on board due to injury or illness(should be proofed by doctor)or ，在征得甲方同意后可以安排下船。乙方因?yàn)閭€(gè)人原因，無正當(dāng)理由下船的，其下船的船差費(fèi)，代理費(fèi)等由乙方自負(fù)。由此造成甲方損失及更換船員費(fèi)用增加的，乙方負(fù)責(zé)賠償。B can get off when meet his relatives death and A agree to exchange crew during the contract B get off the ship without reasonable excuse by himself ,B have to pay the agent fee and other this cause A economic loss, B should pay for the ．工資福利待遇 salary and benefits，月工資標(biāo)準(zhǔn)是美元（包括基薪，固定加班費(fèi)，養(yǎng)老保險(xiǎn)，醫(yī)療保險(xiǎn)，工傷保險(xiǎn)，生育保險(xiǎn)）。乙方按照甲方的規(guī)定領(lǐng)取外派工資和相關(guān)津貼，甲方按照國家規(guī)定的繳費(fèi)基數(shù)即平均工資的三倍繳納養(yǎng)老保險(xiǎn)，醫(yī)療保險(xiǎn)。失業(yè)保險(xiǎn)，工傷保險(xiǎn)，生育保險(xiǎn)。如不滿一個(gè)月，按照實(shí)際天數(shù)/當(dāng)月天數(shù)*月工資計(jì)算，上下船工資結(jié)算時(shí)間為上船當(dāng)日起至下船前一日止（以交接單日期為準(zhǔn)）。B works onboard，the salary isOne month(include base salary，fixed overtime，endowment insurance，medical insurance，injury insurance，maternity insurance)，B get the salary regularly，A pay the endowment calculated from the first day onboard to the last two day get off on the passon sheet。，每月以銀行匯款方式于15日—20日之間結(jié)清上月工資，下船工資的結(jié)算時(shí)間為收到正常下船差費(fèi)，交接清單后一并結(jié)清。A pay off last month salary subsidy，但乙方必須按照甲方的規(guī)定的標(biāo)準(zhǔn)執(zhí)行，超出部分非特殊情況下甲方不予承擔(dān)，未完成合同提前下船的差費(fèi)乙方承擔(dān)。A offer the normal ship sent fee for B according to the pany regulation，if B don’t have reasonable excuse ,the beyond part should be paied by B off the ship before the ending of the contract ,Bpay all the ，甲方負(fù)責(zé)為乙方提供風(fēng)險(xiǎn)保障：如死亡，受傷，生病等情況，甲方根據(jù)Pamp。I協(xié)會(huì)條款或者保險(xiǎn)公司條款為乙方提供保障，但以下情況除外：A offer risk guarantee for death，injury，illness etc according to Pamp。I association，but except：（1）并非在船上是發(fā)生的受傷，死亡 injury or death not on board（2）受傷或者患病是由于乙方的故意行為，違章，酗酒或者不正當(dāng)舉止所致 injury or illness caused by intentional action，peccancy intemperance or other incorrect action（3）簽訂合同時(shí)故意隱瞞疾病等 hide the truth when sign the contract，自修費(fèi)，勞務(wù)費(fèi)等地分配。B have the right to share the reward，selfmaintenance fee，labor fee ect三，雙方的權(quán)利和義務(wù)both sides’ right and duty，保證持有有效的主管機(jī)關(guān)簽發(fā)的有效的船員服務(wù)薄，基本安全培訓(xùn)合格證，海員證，職務(wù)證書以及公約要求的其他技術(shù)證書。根據(jù)需要乙方應(yīng)接受甲方的ISM 培訓(xùn)，遵守甲方的SMS 體系文件的規(guī)定。B should be ensure not only healthy and have valid crew service book，the basic safety training certificate，seamen’s certificate，post certificate and other technical certificate required by international should receive the ISM training and obey the SMSregulations made by the ，正常情況下所發(fā)生的費(fèi)用由乙方自負(fù)，在船工作滿個(gè)月之后所發(fā)生的費(fèi)用，酌情報(bào)銷。Aarrange the foreign certificate and exit formalities for B，B pay all the bill，can apply for some refund，乙方需要值班的，船長要求必須會(huì)操作使用船上的通導(dǎo)設(shè)備。If discharge required，B should can operate the munication equipments on board，應(yīng)忠于職守，遵紀(jì)守法，盡職盡責(zé)，如有下列行為者，甲方有權(quán)終止合同，乙方除自行承擔(dān)后果外，對(duì)甲方造成的損失應(yīng)負(fù)賠償責(zé)任，甲方亦有權(quán)根據(jù)乙方行為后果的嚴(yán)重程度給予相應(yīng)的經(jīng)濟(jì)處罰：B should be on duty and responsible for his act onboard，if B do the following action，A have rights to end the contract at once and ask for pensation，and have rights to punish B with economic methods（1）乙方工作失職，給船舶安全性或者正常航行造成危險(xiǎn)或者損失的 B neglect his duty cause danger or loss（2）乙方不遵守甲方的管理制度或者不服從公司管理的B break pany rules or management regulations（3）乙方漏船或者擅自離船的 Bget off the ship without permission（4）乙方參與盜竊，走私，偷渡，販毒，色情等活動(dòng)的 B join the following act ：steal Smuggle，stowaway，drug trade，eroticism ect（5）乙方不遵守所在港國家法令等被追究地方責(zé)任給甲方造成損失的B break port station rules，is punished by the state，caused problems or loss（6）乙方私自與ITF 及其他國際公會(huì)組織接觸的B contact with ITF or other international associations privately（7）其他嚴(yán)重違法違紀(jì)情形other seriousillegal acts四，違約責(zé)任 defaultresponsibilities合同履行期間任何一方違約將導(dǎo)致合同終止，違約方應(yīng)向?qū)Ψ街Ц逗贤趦?nèi)月工資總額的10%的違約金。each side break the contract lead to the ending of the contract and the breaker should pay 10% salary of one
