Bilingual Teaching of International Law 3 Section one Introduction To be a subject of international law an entity must have “international personality”。 ※ the capacity to possess international rights and duties (享有國際權(quán)利和承擔國際義務(wù) ) Must have ※ the capacity to maintain such rights by bringing international claims. (國際求償能力 ) Bilingual Teaching of International Law Section one Introduction ? 國際法主體（ the subject of international law）是指國際法律關(guān)系的參加者和由此而產(chǎn)生的國際權(quán)利和義務(wù)的承受者。 ? An international person is one who possesses legal personality in international law， meaning one who is a subject of international law so as itself to enjoy rights， duties or powers established in international law， and， generally， the capacity to act on the international plane either directly， or indirectly through another state. 4 ? 國際法主體具有以下基本特性： ? 第一， 國際法主體是國際法律關(guān)系的獨立參加者。 ? 第二，國際法主體是國際法權(quán)利義務(wù)的直接承擔者。 ? 第三，國際法主體是依國際法確定的國際法律人格者。 5 Section one Introduction 國際法主體的范圍 目前較為流行的觀點主要是這樣幾種： 認為國家是國際法的唯一主體； 認為國際法的主體除了國家這個主要的主體以外，還有國際組織和一些爭取獨立的民族； 認為國家、國際組織、爭取獨立的民族和個人都是現(xiàn)代國際法的主體。 分歧最大的就是個人能不能成為國際法的主體的問題。 7 Section Two Principal Subjects of International Law Bilingual Teaching of International Law ?國家曾經(jīng)是國際法的唯一主體，隨著國際關(guān)系的發(fā)展，國際法中其他主體的形成和發(fā)展，國家逐漸成國家作為國際法的基本主體主要取決于以下因素： ?第一，國家具有主權(quán)，可以自主參與和發(fā)展各類國際法律關(guān)系，為國際法的基本主體。 ?第二，國家是國際法規(guī)范的基本對象。 ?第三，國家既是制定和發(fā)展國際法的基本主體，又是遵守和實施國際法的基本主體。 8 State 國家 ★ . Normally the rules of conduct that it prescribes are rules which states are to observe，and in the same way treaties may impose obligations which the signatory states alone agree to perform.
