【正文】 IATA 標(biāo)準(zhǔn)地面服務(wù)協(xié)議 2020 主協(xié)議 amp。附件 A Standard Ground Handling Agreement 2020 標(biāo)準(zhǔn)地面服務(wù)協(xié)議 2020 年版 Main Agreement 主協(xié)議 Article 1 第一章 PROVISION OF SERVICES 提供服務(wù) General 總則 The services will be made available within the limits of possibilities of the Handling Company and in accordance with the applicable IATA and/or ICAO and/or other governing rules, regulations and procedures. 協(xié)議中服務(wù)的提供應(yīng)以代理人所能提供服務(wù)的能力范圍為限，并且符合IATA 和 /或 ICAO 或其它有關(guān)當(dāng)局的相關(guān)規(guī)定、規(guī)章和程序。 It is not considered necessary or possible to specify every detail of the services it being generally understood what such services prise and the standards to be attained in their performance. 在本協(xié)議中無(wú)可能也無(wú)此必要對(duì)服務(wù)的每個(gè)細(xì)節(jié)進(jìn)行描述，雙方在協(xié)議履行中對(duì)服務(wù)內(nèi)容和標(biāo)準(zhǔn)都應(yīng)存在共識(shí)。 Documents for Ground Handling 地面服務(wù)業(yè)務(wù)文件 Documents used for ground handling will be the Handling Company’s own documents, where applicable, provided these documents ply with standardized formats that may apply under IATA and/or ICAO and/or other governing rules, regulations and procedures. 在可能的情況下，地面代理人應(yīng)使用自己的文件、票證為承運(yùn)人提供代理服務(wù)，并且這些文件應(yīng)符合 IATA 和 /或 ICAO 或其它有關(guān)規(guī)定、規(guī)章和程序中所描述的標(biāo)準(zhǔn)格式。 Scheduled Flights 定期航班 The Handling Company agrees to provide for the Carrier’s Aircraft for flights operating on an agreed schedule at the location(s) mentioned in the Annex(es) B, those services of Annex A as are listed in the Annex B for the respective locations. The Carrier, in turn, agrees to inform the Handling Company as soon as possible about any changes of schedule and/or frequencies and/or types of aircraft. 代理人同意向承運(yùn)方的飛機(jī)在附件 B 中所列出的地點(diǎn)就在協(xié)議班期內(nèi)執(zhí)行的航班提供服務(wù)，附件 A 中的相關(guān)服務(wù)內(nèi)容應(yīng)在包含上述服務(wù)地點(diǎn)的附件 B中予以列明。承運(yùn)人相應(yīng)地應(yīng)向代理人盡快地通報(bào)任何有關(guān)航班時(shí)刻、班期或飛機(jī)機(jī)型等變化的信息。 Extra Flights 非定期航班 The Handling Company will also provide the services to the Carrier’s Aircraft for flights in addition to the agreed schedule at the same locations, provided that reasonable prior notice is given and the provision of such additional services will not prejudice mitments already undertaken. 如果在適當(dāng)?shù)臅r(shí)候得到提前通知，且服務(wù)條款不違反雙方先前協(xié)議的規(guī)定時(shí)，代理方可在相同服務(wù)地點(diǎn)為承運(yùn)方的非定期航班提供協(xié)議中所規(guī)定的服務(wù)。 Priority 優(yōu)先權(quán) In case of multiple handling, priority shall, as far as possible, be given to aircraft operating on schedule. 在同時(shí)代理多個(gè)航班的情況下，代理方應(yīng)優(yōu)先為在規(guī)定時(shí)刻內(nèi)運(yùn)營(yíng)的飛機(jī)提供服務(wù)。 Emergency Assistance 緊急援助 In case of emergency, including but not limited to , forced landings, accidents or acts of violence, the Handling Company shall without delay and without waiting for instructions from the Carrier take all reasonable and possible measures to assist passengers and crew and to safeguard and protect from loss or damage baggage, cargo and mail carried in the aircraft. 當(dāng)發(fā)生如迫降、失事或其它暴力行為時(shí)，代理方無(wú)需等待承運(yùn)方的指示，應(yīng)立即采取一切有效措施協(xié)助旅客、機(jī)組并保障所承運(yùn)的行李、貨物、郵件的安全以避免損失或損害。 The Carrier shall reimburse the Handling Company at cost for any extra expenses incurred in rendering such assistance. 代理方在實(shí)施上述緊急援救中所發(fā)生的一切費(fèi)用應(yīng)由承運(yùn)方向代理方償還。 Additional Services 額外服務(wù) As far as possible, the Handling Company will, upon request, provide to the Carrier any additional services. Such services may be governed by special conditions to be agreed between the Parties. 在可能的情況下，代理方應(yīng)根據(jù)承運(yùn)方的要求提供相關(guān)的額外服務(wù)，這部分服務(wù)可按雙方商定的特別條款執(zhí)行。 Other Locations 其它地點(diǎn) In case of occasional flights of the Carrier’s Aircraft at locations which are not designated in the present Agreement, where the Handling Company maintains a ground handling anization, the Handling Company shall, on request, make every effort, subject to the means locally available, to furnish necessary services. 當(dāng)承運(yùn)方的飛機(jī)偶爾停靠于非協(xié)議制定的服務(wù)地點(diǎn)，而代理方在該地機(jī)場(chǎng)擁有地面代理的相關(guān)機(jī)構(gòu)時(shí)，代理方應(yīng)根據(jù)承運(yùn)方的要求和當(dāng)?shù)貙?shí)際情況，盡力為承運(yùn)方的飛機(jī)提供必要的服務(wù)協(xié)助。 Article 2 第二章 FAIR PRACTICES 公平做法 The Handling Company will take all practicable measures to ensure that sales information contained in the Carrier’s flight documents is made available for the purposes of the Carrier only. 代理方應(yīng)采取一切可行措施，確保承運(yùn)方隨機(jī)業(yè)務(wù)文件中所包含的銷售信息只提供給承運(yùn)方使用。 Neither Party to this Agreement shall disclose any information contained in Annex(es) B to outside parties without the prior consent of the other Party, unless such information is specifically required by applicable law or by governmental or authorities’ regulations, in which case the other Party will be notified accordingly. 此協(xié)議中的任何一方事先未得到另一方同意時(shí)，不得將附件 B 中的任何信息透露給第三方， 除了是應(yīng)現(xiàn)行法律或政府或官方特別規(guī)定要求提供上述信息。 Article 3 第三章 SUBCONTRACTING OF SERVICES 協(xié)議服務(wù)的分包 The Handling Company is entitled to delegate any of the agreed services to subcontractors with the Carrier’s consent, which consent shall not be unreasonably withheld. It is understood that, in this case, the Handling Company shall nevertheless be responsible to the Carrier for the proper rendering of such services as if they had been performed by the Handling Company itself. Any subcontracting of services and provider(s) thereof, will be recorded in the Annex(es) B. 代理人在征得承運(yùn)方同意后可將協(xié)議服務(wù)分包給其它代理人，無(wú)正當(dāng)理由時(shí)，承運(yùn)方不得拒絕。在此情況下，代理方應(yīng)將分包方提供的服務(wù)視同為自己的服務(wù)，并承擔(dān)相關(guān)責(zé)任。任何上述分包服務(wù)和服務(wù)提供方應(yīng)在附件 B中予以注明并記錄。 The Carrier shall not appoint any other person, pany or anization to provide the services which the Handling Company has agreed to provide by virtue of this Agreement, except in such special cases as shall be mutually agreed between the Parties. 若代理人已同意按本協(xié)議的條款為承運(yùn)人提供代理服務(wù)，則承運(yùn)人不得再另行指定任何第三人、公司或組織為其提供同類服務(wù)，特殊情況下經(jīng)雙方協(xié)商同意除外。 Article 4 第四章 CARRIER’S PRESENTATIONS 承運(yùn)方代表 The Carrier may maintain at its own cost, its own representative(s) at the location(s) designated in the Annex(es) B. Such representative(s) and representative(s) of the Carrier’s Head Office may inspect the services furnished to the Carrier by the Handling Company pursuant to this Agreement, advise and assist the Handling Company and render to the Carrier’s clients such assistance as shall not interfere with the furnishing of services by the Handling Company. 承運(yùn)人可在協(xié)議附件 B 中的服務(wù)地點(diǎn)自行派駐 代表，該代表和承運(yùn)方總部派出的代表有權(quán)檢查代理方對(duì)協(xié)議的履行情況，建議或協(xié)助代理方以及向承運(yùn)
