【正文】 xxxxx學(xué)院 畢 業(yè) 論 文 論文題目 ： 淺析工程量清單計價模式下的合同管理 所屬系別 建筑工程系 專業(yè)班級 xxxxx 姓 名 xxx 學(xué) 號 xxxxx 指導(dǎo)教師 xxx 摘 要 建設(shè)工程合同是承包人進(jìn)行工程建設(shè)，發(fā)包人支付工程價款的合同，是約束雙方履行義務(wù)享受權(quán)力的具有法律效力的文書，也是監(jiān)理單位實施監(jiān)理工作的依據(jù)。合同內(nèi)容從雙方的一般責(zé)任、工程計量與支付、材料設(shè)備供應(yīng)、工程變更、竣工與結(jié)算到爭議與違約、索賠和其他方 面都作了明確規(guī)定。因此，做好合同管理是項目參與各方的主要內(nèi)容。但是，目前在我國工程造價管理由傳統(tǒng)的“量價合一”的計劃模式向“量價分離”的市場模式轉(zhuǎn)變時期，尚沒有工程量清單計價新模式的合同文本相配套，而且在實施過程中也沒有相應(yīng)合同管理措施。為此，根據(jù)相關(guān)規(guī)定和條件，對清單計價合同的訂立、履行及索賠處理進(jìn)行 一些探討。 本文 闡述了工程量清單計價模式下的合同管理，提出了編制合同范本的建議，并針對合同管理面臨的問題分析了相應(yīng)的對策。建筑合同是參建各方進(jìn)行項目建設(shè)與結(jié)算價款的主要依據(jù)， 關(guān)鍵詞： 工程量清單計價，合同 管理，合同變更，工程索賠 Abstract The construction contract contractor performs project construction， the developer pay the contract price of the contract is binding on both parties to fulfill the obligations of the power of a legally binding instrument， based on implementation of the supervision work of supervision units. The contents of the contract from both general liability， engineering measurement and payment， supply of materials and equipment， engineering change，pletion and settlement to the dispute with the breach of contract claims and other explicitly. Therefore， good contract management is the main content of the parties involved in the project. However， in our project cost management by the amount of the price of one plan mode transition period to the pricevolume market model of the separation， yet the bill of quantities of a new model contract text matching， and in the implementation process not appropriate contract management measures. To this end， in accordance with the relevant provisions and conditions， list pricing contract entered into performance and claims processing some research. This paper describes the engineering bill pricing mode of contract management， and proposed remendations for the preparation of model contracts ， and contract management issues facing the corresponding countermeasures.
