th parties’ agreement through negotiation. 九、勞動(dòng)合同的解除、終止和續(xù)訂 Labor Contract Cancellation, Termination amp。雙方應(yīng)提前三十日(試用期為提前三日)以書面形式通知對方或以支付一個(gè)月工資代替通知,方可解除本協(xié)議。Party A may cancel the contract in case any of the following occurs:l Party B severely violates the labor disciplines and regulations。l Party B holds another job without the permit of Party A, which seriously affects the pletion of Party A’s work task, or Party B refuses to correct the error after Party A’s warning。l Party B is held criminally responsible or reeducated through labor。 l 在試用期內(nèi)的; l 甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的; l 甲方未按照勞動(dòng)合同約定支付勞動(dòng)報(bào)酬或者提供勞動(dòng)條件的。l Party A forces Party B to work by violence, threat or illegal limitations of Party B’s freedom.l Party A fails to pay Party B’s salary or provide work conditions as stipulated herein.25. 符合下列情形之一的,甲方提前三十日(試用期為提前三日)以書面形式通知乙方或以支付一個(gè)月工資代替通知,解除本合同:l 患病或非因工負(fù)傷,在規(guī)定醫(yī)療期滿后,不能從事原工作,也不能從事甲方另行安排的工作的;l 乙方不能勝任工作,經(jīng)過調(diào)整工作崗位,仍不能勝任工作的;l 本合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,經(jīng)甲、乙雙方協(xié)商,未能變更本合同內(nèi)容達(dá)成協(xié)議的;l 按照相關(guān)法規(guī)及程序甲方依法裁員的。 l Party B is unqualified, even after a training or job adjustment。 orl Party A downsizes according to related laws and procedures.26. 乙方有下列情形之一的,甲方不得按本合同第二十五條的約定與乙方解除勞動(dòng)和同:l 在甲方工作期間患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者部分喪失勞動(dòng)能力的;l 患病或因工負(fù)傷,在規(guī)定的醫(yī)療期間的;l 女職工在孕期、產(chǎn)期、哺乳期的;l 法律、行政法規(guī)規(guī)定的其他情形。l Party B is in a period of medical treatment for sickness or work injury。 orl Other situations stipulated in laws and administrative provisions.27. 符合下列情形之一的,本勞動(dòng)合同即可終止:l 勞動(dòng)合同期滿;l 乙方死亡、或者被法院宣告死亡或者宣告失蹤的;l 甲方依法被宣告破產(chǎn)的;l 甲方被吊銷營業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者甲方?jīng)Q定提前解散的;l 法律、行政法規(guī)規(guī)定的其他情形。l Party B is dead, pronounced dead or pronounced missing by the people39。l Party A is declared bankruptcy legally。 Party A is pelled to close down or dissolve。 orl Other situations stipulated in laws and administrative provisions.十、賠償責(zé)任、違約責(zé)任Compensation for the Breach or Cancellation of the Contract28. 乙方造成直接損失的賠償金:賠償金按乙方實(shí)際造成的損失計(jì)算,賠償金的范圍包括:l 乙方損壞甲方財(cái)物而導(dǎo)致的直接經(jīng)濟(jì)損失;l 乙方疏忽導(dǎo)致的甲方直接經(jīng)濟(jì)損失;l 乙方拒絕合理的工作安排而導(dǎo)致甲方經(jīng)濟(jì)損失。l The direct economic losses resulting from Party B’s negligence。In case that either party breaches the contract or causes the economic losses of the other party, the default party will be held liable for breach of contract on a casebycase basis.30. 乙方不得在任何情況下將甲方的保密資料、數(shù)據(jù)、運(yùn)營模式、工具等直接或者間接泄露給任何第三方,如經(jīng)甲方發(fā)現(xiàn)按甲方損失大小賠償。In case Party B is granted training and/or education financial aid from Party A and if Party B terminates this Contact before the term (from the pletion date of the training) during which Party B has agreed to serve Party A, Party B shall pensate Party A for incurred training expenses and/or education financial aid granted to Party B by Party A over the twelve (12) months period following the termination of this Contract. 十、勞動(dòng)爭議的處理 Labor Dispute Resolutions32. 甲乙雙方協(xié)商解決。In case of unsuccessful negotiation, the contending party may apply for labor arbitration.十一、其他 Miscellaneous34. 本合同未盡事宜,按國家和當(dāng)?shù)卣嘘P(guān)法律、法規(guī)規(guī)定辦理。兩份合同具同等法律
